Effective Date: October 20, 2023 Personnel To: All TABLE OF CONTENTS 1.0 PURPOSE.................................................................................................................................. 1 2.0 DEFINITIONS............................................................................................................................ 1 3.0 POLICY...................................................................................................................................... 1 4.0 COMPENSATION...................................................................................................................... 2 Inclement Weather/Emergencies 1 1.0 PURPOSE - To inform Manatee County Sheriff`s Office employees regarding issues related to announcements of agency closings due to inclement weather or other emergency conditions, the identification of essential personnel, and employee compensation due to absences necessitated by authorized closings. 2.0 DEFINITIONS 3.0 2.1 AUTHORIZED CLOSING - The closing of any or all MCSO facilities for specific periods of time, as needed. An authorized closing may be for an entire day or a partial day, or for extended periods. 2.2 ESSENTIAL PERSONNEL - Those employees required to work during an authorized closing, or due to emergency conditions, because their positions have been designated by their chain of command as necessary or essential to agency operations or to the public safety. Essential personnel may be required to work during days or times they are not regularly scheduled to work. 2.3 EMERGENCY CONDITIONS - Those conditions, as determined by Executive Staff, that prevent employees from traveling to and from work, or remaining at work (such as inclement weather, utility failure, fire, or other forced evacuations). 2.4 NON-ESSENTIAL PERSONNEL - Those employees who are not required to work during an authorized closing or emergency because their positions have not been designated as essential during emergency conditions. An employee’s “non-essential” status may change to “essential” as the chain of command determines the necessity, however, the affected employees will be notified in advance of any such change in status as soon as practicable. POLICY - Every effort will be made to keep agency locations and functions open in bad weather. This means that the MCSO may remain open even though state offices and local government offices and public schools are closed. 3.1 PROCEDURES 3.1.1 When weather conditions or other emergencies mandate closing of MCSO facilities, the decision will be conveyed via the chain of command. 3.1.1.1 The Administrative Bureau Chief will use the RAVE system to alert employees of facilities closing. 3.1.2 Personnel designated as essential shall make every effort to report to their duty station or assignment. 3.1.2.1 Inclement Weather/Emergencies All employees are urged to use sound judgment in their attempt to honor this policy. In some instances, road conditions might be 1 extremely hazardous and taking the risk of driving might not be in the best interest and welfare of the employee. 3.1.2.2 4.0 Supervisors will utilize their own discretion to justify whether or not to initiate disciplinary proceedings for employees arriving late or absent. COMPENSATION 4.1 ESSENTIAL PERSONNEL 4.1.1 Exempt personnel required to work during authorized closings or emergencies will not be compensated beyond their regular pay, regardless of hours worked. 4.1.1.1 In the event of a federally declared disaster, the following shall be initiated. 4.1.1.1.1 In county - The Sheriff/Chief Deputy may authorize exempt personnel to receive deployment per diem in a monetary amount to be determined by the Management Team. 4.1.1.1.2 Out-of-county - The Sheriff/Chief Deputy may authorize exempt personnel assigned to out-of-county disaster relief, in a declared disaster area that has been assigned a Florida Sheriff’s Association tasking number to receive deployment per diem in a monetary amount to be determined by the Management Team. 4.1.2 Non-exempt essential personnel required to work during authorized closings or emergencies will be compensated at their regular rate of pay up to their authorized hours for the pay period, and paid at the overtime rate for hours over that amount. 4.1.2.1 Time off on an hour for hour basis may be given prior to the end of the pay period, at the discretion of the supervisor. 4.1.2.2 Compensatory time may be credited, if the employee is in a position with prior approval for earning such time. 4.1.3 Essential personnel who do not report to work during authorized closings as required will have the hours not worked charged to vacation or holiday leave. Supervisors may initiate disciplinary procedures at their discretion. 4.1.3.1 Inclement Weather/Emergencies If an essential employee is on pre-approved leave during an authorized closing, no disciplinary actions will be considered. The 2 leave time will be charged against the type of advanced leave approved. 4.1.3.2 An essential employee on Family Medical Leave, Workers Compensation Leave, Disability Leave, etc. is not required to report to work. 4.1.3.3 When road conditions and transportation difficulties cause an essential employee to arrive late to work, the lost time will not be charged to the employee’s leave balances to leave without pay, if the supervisor determines that the conditions and difficulties justify the tardiness. 4.1.4 If called out to work in any capacity during an emergency, and it is not the employee’s regular duty shift,.5 hours travel time will be paid for the employee to travel to his/her assigned location and an additional.5 hours to return to his/her residence at the end of the assigned shift. 4.2 NON-ESSENTIAL PERSONNEL 4.2.1 A non-essential employee will be paid for the hours that the employee was scheduled to work on the authorized closing day. 4.2.1.1 Administrative Leave with Pay will be credited for hours not worked on the authorized closing day. 4.2.1.2 If the authorized closing occurs during a scheduled shift and the employee is sent home, ALWP will be used to make up the difference in hours scheduled and hours worked. 4.2.1.2.1 The sum of hours worked and ALWP shall not exceed the regularly scheduled workday. 4.2.2 Employees whose scheduled day(s) off falls on a day of an authorized closing will not receive compensatory time or other compensation for that day(s). 4.2.3 A non-essential employee who reports to work as usual during an authorized closing shall be paid his/her regular rate of pay, but shall not be credited with compensatory time or overtime, unless the regular number of normally authorized work hours is exceeded. 4.2.4 Part-time employees will receive pay for hours actually worked.
