NORTHWEST VISTA COLLEGE REGISTERED STUDENT ORGANIZATION (RSO) & ATHLETIC TEAMS: RISK MANAGEMENT AND COMPLIANCE REVIEW UPDATED: 4/11/22 NVC COLLEGE AND COMPLIANCE TEXAS EDUCATION CODE § 51.9361 REPRESENTATIVES ARE RESPONSIBLE FOR REVIEWING, UNDERSTANDING AND ENFORCING THE APPROPRIATE RISK MANAGEMENT SAFETY PROCEDURES MEMBERS ARE NOT PERMITTED TO VIOLATE OR CONDONE ANY ACTIONS THAT GO AGAINST LOCAL, STATE, OR FEDERAL LAW OR COLLEGE REGULATIONS. STUDENT ACTIVITIES, RISK MANAGEMENT, MANDATORY REVIEW: EACH ADVISOR/COACH AND DESIGNATED OFFICER IS REQUIRED TO HAVE REPRESENTATIVES COMPLETE THIS RISK TRAINING OVERVIEW. “ADVISOR” MEANS A PERSON WHO SERVES IN AN ADVISORY CAPACITY TO A STUDENT ORGANIZATION TO PROVIDE GUIDANCE TO THE ORGANIZATION AND ITS MEMBERS; IS OLDER THAN 21 YEARS OF AGE; AND IS NOT A STUDENT OF THE COLLEGE IF A STUDENT ORGANIZATION DOES NOT HAVE OFFICERS OR POSITIONS ARE VACANT, THE RSO/TEAM SHALL IDENTIFY AND DESIGNATE AN EQUIVALENT POSITION ATHLETIC COMPLIANCE 34 C.F.R. 104.43(D),.47(A)- TREATMENT OF STUDENTS; GENERAL A RECIPIENT THAT OFFERS OR OPERATES OR SPONSORS INTERCOLLEGIATE, CLUB, OR INTRAMURAL ATHLETICS SHALL PROVIDE TO QUALIFIED STUDENTS WITH DISABILITIES AN EQUAL OPPORTUNITY FOR PARTICIPATION IN THESE ACTIVITIES. LIABILITY & NEGLIGENCE Liability: Who takes the legal responsibility Can be assumed by: Both organization Leaders & members College & Alamo College District Negligence: Failure to take proper care in doing something Both organization Leaders & members have the duty to ensure the wellbeing of one another RSO/TEAM PROGRAMMING MODE: Virtual, on campus and off campus Funded by RSO revenue funds (i.e. fundraising) Funded by the College or Student Activity Fee Programming that does not involve any funding RISK TYPES Physical Reputation Emotional Financial Facilities RISK TYPES Physical Risks: Includes food poisoning and physical activity injuries Reputational Risks: Negative publicity for the organization & college Emotional Risks: Cause a participant to feel alienated or negatively impacted Financial Risks: Negatively impact the fiscal stability of the organization & college Facility Risks: Cause property damage and/or prevent event from being held (bad weather, not enough space, etc). RISK MANAGEMENT PROCESS EDUCATION CODE 51.9361(F); EDUCATION CODE 51.9361(G); EDUCATION CODE 51.9361(H)–(I) -Required for all NVC RSO advisors/coaches and/or officers/captains. -Must be shared with other members. AREAS OF REVIEW Behavior at student organization events Alcohol & Illegal Drugs Hazing Sexual Assault, Harassment, & Misconduct Fire Safety & Use of Firearms Travel & Transportation BEHAVIOR AT STUDENT ORG/TEAM EVENTS Student free inquiry/ expression are essential to grow and to develop. However, students must exercise these freedoms with responsibility. RSOs/Teams shall provide an enjoyable environment for learning and socializing requires all participants to: Adhere to the student code of conduct and Obey the law Refrain from intentionally causing harm to others & destroying, damaging, or theft of property Remember, you are a representation of both your group and college! ALCOHOL & ILLEGAL DRUG OFFENSES Alamo Colleges Board Policy: F.4.5 (Policy) Alcohol and Drug Use Students who violate federal or state statutes, the Student Code of Conduct, College District policy, or other applicable requirements related to alcohol and drug use shall be subject to appropriate disciplinary action. Such disciplinary action may include referral to drug and alcohol counseling or rehabilitation programs or student assistance programs, suspension, expulsion, and referral to appropriate law enforcement officials for prosecution. The Alamo College District’s policy prohibits the unlawful possession, use, or distribution of illicit drugs and alcohol, a description of the applicable legal sanctions under local, state, or federal law, and a description of the health risks associated with the use of illicit drugs and the abuse of alcohol. The sanctions for this violation range from mandatory counseling to expulsion. HAZING Any intentional, or reckless act, occurring on or off the campus of an educational institution, by one person alone or acting with others, directed against a student, that endangers the mental or physical health or safety of a student for the purpose of pledging, being initiated into, affiliating with, holding office in, or maintaining membership in any organization whose members are or include students at NVC. HOW YOU CAN PREVENT HAZING Be proactive! Don’t wait for a problem to develop! Educate your new and active members! Confront inappropriate behavior among your members When problems do arise, take corrective action! Follow your organization’s policies and procedures Report the issue(s) to the Student Life office immediately SEXUAL MISCONDUCT Sexual Harassment Nonconsensual sexual intercourse Stalking Consent SEXUAL MISCONDUCT Consent: Knowing, voluntary, and clear permission, to engage in mutually agreed upon sexual activity. Sexual Harassment: Unwelcome conduct of a sexual nature that creates an intimidating, hostile, or offensive environment. Nonconsensual sexual intercourse/sexual assault: any sexual intercourse or penetration , with any object, by a person upon another person, that is without consent and/or by force. Stalking: Intentional and repeated harassment or following (in person or virtual) of another person, which places that person in reasonable fear of their safety. Domestic Violence: Violence committed by the victim’s current or former spouse or cohabitant. Sexual Violence: a type of sexual discrimination and harassment including nonconsensual sexual intercourse, nonconsensual sexual contact, domestic violence, dating violence, and stalking. SEXUAL MISCONDUCT: WHAT CAN YOU DO? Have written policies consistent with the law and the Alamo Colleges District policies regarding alcohol and illegal drugs Inform your members and guests of possible consequences for their behavior Utilize your organization’s judicial process – have a zero- tolerance attitude Serve non-alcoholic beverages and food SEXUAL MISCONDUCT: WHAT CAN YOU DO? Title IX/VII/ADA/504 Director/Coordinator Advocacy Center 911 FIRE SAFETY There are several common causes of accidental college fires: Unattended cooking grills Overloaded extension cords and power outlets Leaves and debris located near buildings Improper use of surge protectors WHAT CAN YOU DO?
