What are some characteristics of inclusion in the workplace? Employees are valued, supported, respected, and able to reach their full potential. 2. Describe at least two laws which help to create an inclusive workplace. Answers may include: Equal Pay Act of 1963 - prohibits sex-based wage discrimination between men and women in the same establishment who perform jobs that require substantially equal skill, effort and responsibility under similar working conditions. Civil Rights Act of 1964 - makes it illegal to discriminate against a person on the basis of race, color, religion, sex (including pregnancy, sexual orientation, and gender identity), or national origin. Age Discrimination Act of 1967 - protects individuals who are 40 years of age or older from employment discrimination based on age. Equal Employment Opportunity Act of 1972 – makes it illegal to discriminate against a job applicant or an employee because of the person's race, color, religion, sex (including pregnancy, transgender status, and sexual orientation), national origin, age (40 or older), disability or genetic information. Americans with Disabilities Act of 1990 - prohibits employment discrimination on the basis of disability by private employers. Family & Medical Leave Act of 1993 - requires certain employers to grant leave to eligible employees who need time off because of a serious health condition that they or someone in their family is experiencing. 3. Define protected characteristics and list at least eight covered under the law. Protected characteristics are attributes or traits of a person which cannot be used as a basis for workplace action or treatment. Answers may include: Race Gender Genetic Information Color Religious belief Debts Military service/affiliation Citizenship status National origin Pregnancy Physical or mental disability Age, for people over 40 4. Define discrimination. Discrimination is an adverse or hostile job action based on a protected characteristic, such as refusing to hire, termination, denying a promotion, paying a person less, withholding needed job information, or giving a person an impossible task. What is one way bullying is different from harassment and discrimination? Bullying is not based on a protected characteristic. 6. Define harassment. Harassment is unwelcome behavior based on a protected characteristic that is either severe or repeated enough to create a hostile work environment. No adverse job action is directly taken. 7. List at least two ways you can show ethical behavior and uphold the integrity of your workplace or school. Define confidentiality and explain why it is important. Confidentiality means respecting someone’s privacy and not sharing sensitive personal or business information. It could cause someone to lose their job or their reputation, it could cause the loss of customers, or it could be used to commit illegal acts such as fraud. 2. Describe three types of confidential information. Personal Information: sensitive, private data that can be linked to a specific employee or person, such as an employee’s social security number or a customer’s credit card number. Management Information: includes data about employee issues, such as performance reviews, disciplinary actions, planned lay-offs, salaries, and terminations. Business Information: important business data not known to the public that might give a business an economic advantage over its competition, such as customer history. 3. List five ways confidential information is protected. Secure systems Employee confidentiality policies Employee training Customer privacy policies Common sense 4. Define a violation of confidentiality. A violation of confidentiality is the unauthorized disclosure of personal or business data. 5. List three things you can do if you experience a confidentiality breach. Consult your employee handbook or confidentiality policy. Discuss the matter with HR and/or your supervisor.
