CITY OF NAPLES PERSONNEL POLICIES & PROCEDURES MANUAL Section No.: 8 SUBJECT: SEPARATION/RETIREMENT Revision Date: 12/19/06 Effective Date: 06/01/95 History: Eff. 6/1/95; Rev. 12/19/06, 1/9/04 POLICY: The City of Naples will provide separating employees with the necessary documentation and information regarding the disbursement of retirement funds, and continuation of available benefits. OPERATING PROCEDURES SEPARATION (Voluntary or Involuntary): The employee should advise their supervisor with at least two (2) weeks working notice that they plan to voluntarily sever their employment with the City of Naples. Notice should be provided in written format and include the date it was submitted as well as the employee’s intended last day of work. Supervisors should advise employees that medical documentation will be required for any non-FMLA sick leave time taken during the notice period (See Part III for Administration). In the event of an involuntary separation, all documentation must be approved by the department director and the Human Resources Director in advance of being administered to the employee. Management should also advise non-union employees of their right to utilize the established City grievance procedures at this time. Bargaining unit employees should consult their appropriate contract for the correct grievance procedure to utilize. (Please refer to Discipline section for additional information.) The employee’s termination date is considered to be the last day the employee reported to work as scheduled and performed his or her assigned duties. RETIREMENT: Employees who are eligible for City retirement under their respective pension plan should notify their supervisor and the Human Resources Department to obtain an Application for Retirement. The completed application form may be returned to the Finance Department or Human Resources Department in order that it may be forwarded to the appropriate pension board at least ninety (90) days in advance of the expected retirement date. All retirement requests must be approved by the appropriate board and are effective on the first calendar day of the month of the retirement date. The termination date is considered to be the last day the employee reported to work as scheduled and performed assigned duties. Questions regarding pension disbursements should be addressed to the Finance Department. ADMINISTRATION: Supervisors are responsible for completing an Official Personnel Action form and the employee is responsible for completing a Separation Report which should include both the employee's and supervisor’s signatures. The form is to be forwarded to Human Resources prior to the last day of work. Supervisors should ensure that the employee schedules an exit interview with the Human Resources Department prior to their separation from employment. This meeting is to answer any questions an employee may have regarding their separation and inform them of their benefit status. The recruitment process for filling the vacancy can begin by completing a Personnel Requisition form in accordance with the City’s Recruitment and Selection policy. FORFEITURE OF BENEFITS: Chapter 112.3173 of the Florida Statutes requires the forfeiture of retirement benefits, except for the return of the employee's accumulated contributions as of the termination date, by public officers and employees who are convicted of, or whose employment is terminated because of committing certain offenses involving a breach of the public trust. The specified offenses are: The committing, aiding, or abetting of an embezzlement of public funds. The committing, aiding, or abetting of any theft by a public officer or employee from his employer. Bribery in connection with the employment of a public officer or employee. Any felony specified in Chapter 838, Florida Statutes (bribery, misuse of public office). The committing of any felony by a public officer or employee who, willfully and with intent to defraud the public, or the public agency in which he is employed, realizes or obtains, or attempts to realize or obtain, a profit, gain, or advantage for himself or for some other person through the use or attempted use of the power, rights, privileges, duties or position of his public office or employment position. PENSION BUY-BACK: In accordance with the City's Code of Ordinances, a person who becomes re-employed with the City may be eligible to buy-back his or her pension and previous credited service. The buy-back provision will apply to employees who received a lump-sum payment. Additional information may also be obtained by contacting the Finance Department. GENERAL PENSION: A written request must be made to the Human Resources Department soon after completing one (1) year of re-employment. The Pension Board will review the request, and the employee will be notified of the status and obligations to fulfill the repayment of the pension funds within the required time period. POLICE AND FIRE PENSIONS: A request must be made to the Human Resources Department immediately upon re-employment and full repayment, including interest, must be made within the required time period.
