**I. POLICY:** **The purpose of the Tohono O'odham Nation Corrections Incident Report policy is to ensure the prompt and accurate reporting of occasions that impede the daily operations of the Tohono O'odham Nation Corrections Facility (TOCF).** **II. REFERENCES:** ***ACA Standards: 4-ALDF-2B-07; 4-ALDF-6C-03; 4-ALDF-6C-04*** **III. APPLICABILITY:** This order applies to all Corrections personnel within the TOCF observing such occasions as expressed in the incident reports definitions. **IV. DEFINITIONS:** **[Incident reports] -- The written d**ocumentation of instances or events such as inmate misconduct (including criminal and non-criminal activity), security violations or security threats, destruction to Tohono O'odham Nation property, or any other unusual occurrences. **V. PROCEDURES:** **NOTE:** The incident report will be completed as required and forwarded to the on-duty supervisor **PRIOR** to reporting off-duty. [The **Reviewing of Incident Reports** shall consist of, but not be limited to:] ### {#section.ListParagraph} The on-duty supervisor will review all incident report forms and ensure the following: A. Essential facts of the incident are contained in the report. B. All areas of the report are completed correctly. C. If a rule violation is filed in conjunction with the report, that the rule violation is clearly stated in the report. D. All staff present and involved is identified in writing in the report. E. If the incident involved use of force and a Supervisory Supplemental Use of Force form is appropriate, one is completed and attached. F. The supervisory comment section of the report reflects any pertinent and appropriate supervisory observations and any information necessary to subsequent investigation or follows up. G. The single comment "CONCUR\" is considered insufficient as supervisory remarks. H. Completed incident reports are considered property of the TOPD and any release of information will only be in accordance with departmental policy. I. Original copies will be forwarded to the Corrections Administrator. Reports containing the inmate's name will be placed in the inmate's file kept by the Classifications Unit after review. J. Each person completing an incident report will sign their name on the signature line and note their identification number. K. BIO-HAZARD ITEMS -- When forwarding incident reports that contain items used for tattoo activity, cutting behavior, etc., the item should be isolated in a separately marked container indicating BIO-HAZARD and disposed of. This will prevent the accidental exposure to any BIO-HAZARD material. L. The Central Control Room Operator will issue an Incident Report number that shall be assigned to each Incident Report. M. If no inmate is involved and it is a Corrections incident, a report will be documented in a memorandum and forwarded to the supervisor. N. Incident Reports will include an incident number consisting of the year, month, day, and report number for the day (example: 05061201). O. The Corrections Incident Log will be kept in the Central Control Room. The Corrections Incident Log is to be kept up to date, and will be forwarded to the Corrections Administrator or Assistant Corrections Administrator at the end of each month. **I. POLICY:** The purpose of the Tohono O'odham Nation Corrections Facility is to provide for the effective management of inmates by personnel utilizing skills and knowledge gained from specific training toward the safe and secure detention of individuals committed to the Corrections Facility. Personnel charged with the responsibility of the management of these individuals shall adhere to the highest level of standards established for professional correctional personnel. **II. APPLICABILITY:** This order applies to all Corrections staff assigned duties within the TOCF. **IV. DEFINITIONS:** **[TOPD] -- Tohono O'odham Nation Police Department** **[TOCF] -- Tohono O'odham Nation Corrections Facility** **V. PROCEDURES:** **NOTE: All personal cell phones will be strictly prohibited within the facility for all Corrections personnel with the exception of the supervisory staff's departmental issued cell phone.** **Any violation of this order will result in disciplinary action.** **[The Supervising Staff's expectations, authority, and responsibilities shall consist of, but not be limited to:]** A. Supervisors shall direct their efforts toward the effective performance and functions of the TOCF and shall require the same from subordinates. a. **Supervisory staff should not perform the duties of subordinates unless subordinates are not available to do so.** b. Supervisors must also ensure that subordinates are aware of policy and procedures. c. Supervisors will not only be responsible for their conduct and performance but that of subordinates. d. Supervisors shall always demonstrate fairness, efficiency, promptness, trustworthiness, courtesy, and competency. B. Supervisors shall not unnecessarily countermand orders of department members below their rank or needlessly interfere with specific duties of other departmental members. C. Supervisors shall promptly obey orders of their superiors. e. They shall give such orders or instructions, written or verbal, as may be necessary for the efficient operations of the TOCF. f. They shall be responsible for the proper execution of orders by their subordinates. D. Supervisors shall report any delinquent or immoral conduct, laxity in performance of duty or observance of departmental rules, regulations or procedures on the part of their subordinates in writing to the Corrections Administrator. g. Supervisors that are informed by another of any such violations as noted above are also responsible to immediately report such violations in writing. Such reports shall be submitted immediately upon discovery or notification of such conduct. h. Supervisors shall ensure that subordinates produce all required reports promptly, accurately and completely on proper departmental forms. E. Supervisors shall be responsible for the maintenance and care of all departmental property assigned, and shall inspect it regularly for condition. F. Supervisors shall ensure that all subordinates who do not report for scheduled duty have been authorized such leave or report the absence as misconduct and take appropriate action. G. Supervisors should submit reports when subordinates risk their lives under circumstances requiring a high degree of courage or risk their lives in the course of their job duties. i. Supervisors should also recognize a subordinate who performs a difficult and important community service requiring the highest degree of tact, diligence, initiative and ability. **[Standards of Conduct for Corrections personnel shall consist of, but not be limited to:]** **NOTE:** All Correctional personnel shall conduct themselves in a manner that will reflect upon them and the TOPD in a favorable and not adverse manner, both on and off duty. A. Personnel who know of other personnel violating any rule or regulation on and off duty shall report it immediately in writing. B. All personnel shall treat supervisors, subordinates, peers, inmates and the general public with respect displaying courtesy and professionalism at all times. C. Personnel shall report honestly and accurately all facts about investigations or other matters that concern the TOPD. Personnel will not make false reports or knowingly cause to be entered in any TOCF record any inaccurate or false information. D. No personnel shall in an official capacity willfully misrepresent any matter, sign any false official statement, report, give false testimony, or commit perjury before any Tribal Court, Official, board or hearing body. E. Personnel shall not solicit or accept any gift, gratuity or reward for services rendered relative to their employment unless authorized by law or with departmental approval. F. Personnel shall perform their duties completely, avoiding harsh, violent, profane or insolent language and shall remain calm regardless of provocation. G. Personnel will be punctual reporting for duty and shall report any lateness or absence a minimum of one hour prior to commencement of assigned duty hours. H. Personnel shall not report to duty under the influence of intoxicants or drugs nor be unfit for duty. I. Personnel shall not purchase or drink any alcoholic beverage while on duty or in uniform. J. Personnel shall not sleep on duty. K. Personnel are prohibited from conducting personal business while on duty without the approval of an immediate supervisor. L. Any property that personnel have received either departmental or from inmates shall not be converted for personal use. M. Personnel shall give their name and identification number to any person who requests it. N. Personnel who become aware that an immediate relative or social acquaintance is in the custody of the TOCF shall immediately notify their supervisor and submit a written report. Appropriate limitations may be imposed on the departmental member. O. Personnel shall not bring into or cause the introduction of contraband into the TOCF. Personnel who become aware of such activity shall immediately report this activity to their supervisor and submit the information in writing. P. Any Corrections personnel involved in an off-duty incident will submit a written report detailing the incident to the Corrections Administrator the next working day. If the off-duty incident is of a serious nature, which involves arrest, the Corrections personnel involved will immediately contact their supervisor. If the immediate supervisor is not available, the Corrections personnel will contact the Corrections Administrator. This directive requires a written report whether or not law enforcement responds to the situation. Q. All personnel will report to duty on time and in accordance with the Tohono O'odham Nation's Policies and Procedures. R. If an emergency occurs while traveling to or from work, the shift supervisor will be notified immediately. S. Any Corrections personnel involved or present at a police action that occurs when off-duty shall submit a written report detailing the situation. This report shall be submitted on the next working day. If it is a serious situation involving arrest, you are to contact your supervisor or the Corrections Administrator immediately. This directive requires reporting whether or not law enforcement responds to the situation. T. **Maintain cleanliness throughout the Corrections Facility including areas restrictive to inmates, such as staff restrooms, staff break room, and Central Control Room.** A. Corrections staff members shall always use the entrance/exit located near the vehicular sallyport. B. Public visitors shall only enter through the lobby and lobby sallyport through a metal detector. C. Inmate movement will be through the vehicular sallyport. D. All law enforcement and emergency medical personal shall enter through the vehicular sallyport. E. Food and Laundry Service must use the same entrance as Corrections staff. F. Vendor deliveries will either be made to the lobby or delivery dock. A. Personnel will report for duty in the appropriate uniform that is neat, pressed, and clean and is in good repair. B. All leather, plastic and metal articles shall be shined, clean, and in presentable order. C. Shirtsleeves shall not be rolled up. D. Personnel must wear a white or black crew neck shirt under the uniform shirt. E. All uniformed Corrections personnel shall wear approved utility belts approved by the TOPD. F. Departmental patches shall be in good repair and not faded. They shall be sewn on both sleeves of the uniform shirt and jacket. G. The authorized nametag shall be worn at all times, be silver in color, and contain the first initial and last name and centered above the right pocket button. H. Only authorized footwear may be worn and must be in good repair and polished to a shine. I. Supervisors shall always be an example of uniform appearance and inspect personnel for compliance on a regular basis according to TOCF standards. J. The black T-shirt with gold lettering indicating "Tohono O'odham Nation Corrections" may be worn only during community service. K. Supervisors may order any personnel to go home and change to appropriate attire. The Corrections officer shall return to work as soon as possible and will not be compensated for the time away from work. The individual may make up the hours the same day or be carried without pay. [The **Class A** uniform shall consist of:] A. Grey Flying Cross Long-sleeve Shirt B. Black Fechheimer Pant C. Black Boots (polished to a shine) D. Black Basket Weave Duty Belt E. Black Champaign Smokey Hat a. Officer - Silver Cords b. Sergeant & Specialist -- Gold Cords F. Black Tie with Tie Bar c. Officer -- Silver Tie Bar d. Sergeant & Specialist -- Gold Tie Bar [The **Class B** uniform shall consist of:] A. Grey Flying Cross Short-sleeve Shirt B. Black Fechheimer Pant C. Black Boots (polished to a shine) D. Black Basket Weave Duty Belt or approved Nylon Duty Belt [The **Class C** uniform shall consist of:] A. Authorized Golf-type Shirt B. Black Fechheimer Pant C. Black Boots (polished to a shine) D. Black Basket Weave Duty Belt or approved Nylon Duty Belt [**Food Service, Facility Maintenance, and Corrections Support Specialists uniform and appearance** standards shall consist of, but not be limited to:\ ] A. All non-Officer personnel will be dressed in an approved uniform for their individual program. B. All uniforms will be in good repair. C. All individuals will be well groomed and maintain good hygiene. [Other **Appearance Standards** shall consist of: ] A. All Corrections personnel will have the badge worn centered just above the left breast pocket. B. All Corrections personnel will have the name tag centered one-quarter (1/4) inch above the right breast pocket. The name tag will consist of the first initial of the first name and the entire last name. a. Officer -- Silver Name Tag b. Supervisor -- Gold Name Tag C. Black Bonnie Hats will be authorized for Community Service only. D. Black BDU Pants will be authorized for Community Service only. E. Black T-shirt with Tohono O\'odham Nation Corrections will be authorized for Community Service only. F. Black Baseball Caps will be authorized with the lettering, "Tohono O'odham Nation Corrections" (with Corrections centered directly under Tohono O'odham Nation). G. A White or Black T-shirt is required to be worn under the uniform shirt. H. Black Windbreaker with Tohono O\'odham Nation Corrections in gold lettering on the back and badge on front left breast will be authorized. I. Black Heavy Duty Jacket with patches on both arms will be authorized. J. The Duty Belt will consist of: c. Basket Weave or Nylon d. Handcuff Case e. Belt Keepers f. Flashlight Holder g. Latex Glove Holder h. OC Holder i. ASP Holder (only officers certified can carry) j. Key Holder k. Radio Holder K. Handcuffs (chain/hinge) L. Flashlight (i.e.: Mag Light, Stinger, Scorpion, or any other authorized flashlight) M. Name Tag (first initial of first name and entire last name) l. Officer -- Silver m. Sergeant -- Gold N. Under Belt (to be worn under the Duty Belt) O. The Corrections Officer buttons on Basket Weave items will be silver with silver buckle P. The Sergeants button on Basket Weave items will be gold with gold buckle Q. All Basket Weave and Nylon items will be in good repair. **. POLICY:** It shall be the policy of the Tohono O'odham Nation Corrections to expedite the lawful release of inmates awaiting adjudication in another jurisdiction. The following procedure will be followed when an inmate has had all Tribal charges adjudicated, and has the circumstances noted in this order. **II. REFERENCES:** None. **III. APPLICABILITY:** This general order applies to all Corrections personnel working within the TOCF. **IV. DEFINITIONS:** Spillman -- The jail management software used in conjunction with Corrections activities. **V. PROCEDURES:** [The **Documentation** for releasing an individual to another agency shall consist of:] A. The Corrections staff member will release the inmate from the Spillman system, and also log down the name, badge number, and agency of the Receiving Officer. B. The Receiving Officer will also sign the inmate(s)' booking form with the above mentioned information (their signature is required). C. This event will also be documented into the daily activity log. [A release to an **FBI Warrant** shall consist of:] A. The FBI will be contacted and advised that effective from time of contact that they have 24 hours to pick up the subject. B. This notification and pick up time is applicable seven days a week with no exception. C. A release to the US Marshals follows the same procedure described for the release due to FBI warrant. **NOTE:** The only exception to the 24-hour pick up would be notification by the FBI or USM that the FCI-Tucson is full and is not accepting new inmates. In this case, we will contact the FCI and determine an estimated time that they may be available and arrange pick up based on that information. As in all cases, the FCI-Florence may be used as an alternative by the FBI/USM. [**Notifying TOPD Criminal Investigations and City/County Law Enforcement Agencies** shall consist of, but not be limited to: ] A. Corrections staff will notify the Criminal Investigations Unit upon receiving information that an inmate has an FBI/USM warrant or a writ. B. The Prosecutor's Office will be provided with a copy of the warrant or writ as soon as possible. C. In some cases, CI may transport the subject to the FCI or at an agreed upon location. If staffing allows, Corrections staff can transport to an agreed upon location to meet with FBI/USM. D. The Corrections Division will contact the Criminal Investigations Unit and advise them of the outstanding warrant for the affected agency. E. Additionally, the Prosecutor's Office will be contacted and a coordinated effort will be taken to domesticate the warrant so the person can be released to that agency. F. Should Tribal charges be pending and a writ is presented, the above units will be notified and release will be coordinated. G. In the event of a domesticated warrant, the agency will have 24 hours to pick up the subject consistent with policy and procedure. [Protocol of **Federal arrests** shall consist of:] A. The TOCF will not hold or accept any arrestee on a Federal detainer alone; the arrestee must have Tribal charges pending with the exception of the Corrections Administrator or Assistant Corrections Administrator approval. B. A supervisor will be contacted immediately if any questions arise. C. All information received will be documented on the Shift Activity Log in Spillman. **I. POLICY:** *It shall be the policy of the Tohono O'odham Nation Corrections Facility (TOCF) to maintain a system for handling rule violations by inmates of the TOCF.* **II. REFERENCES:** **III. APPLICABILITY:** This order applies to all Corrections personnel within the TOCF. **IV. DEFINITIONS:** *[Disciplinary Hearing Process] \-- An administrative process to assure the orderly operation of the TOCF.* *[Programs Supervisor] -- Is the Corrections Sergeant that supervises the classifications division.* **V. PROCEDURES:** *[**Inmate disciplinary process** shall consist of but not be limited to:]* A. *The rules will be provided to inmates in the Inmate Handbook that will be issued to each inmate remanded to custody of the TOCF by the Judiciary Courts of the Tohono O'odham Nation.* B. *The Corrections staff that discovers a rule violation will write an incident report and charge the inmate accordingly on the DISCIPLINARY CHARGE form.* C. *All documentation will then be forwarded to the Corrections Administrator and Classification/Programs Unit for appropriate actions.* D. *Any inmate charged with a rule violation will be ensured a fair and impartial hearing and will be free from excessive punishment or treatment not within the scope of professional and constitutional practices.* E. *All inmates will have the opportunity to appeal the outcome of any disciplinary hearing to the Corrections Administrator.* F. *The Classification/Programs Unit will conduct inmate disciplinary hearings.* G. *The individual assigned to conduct the hearing may not do so if they were involved in the incident that resulted in the inmate being charged.* H. *Inmates will not be subjected to any form of discipline by another inmate.* I. *The restriction of food and/or medical attention or any other constitutionally afforded right, or the use of corporal punishment, will be used as a disciplinary measure.* J. *Shift Supervisors and Corrections Officers can address minor charges if deemed necessary.* K. *The inmate will be given a copy of the Disciplinary Charge form and informed that a disciplinary hearing may be held within 72 hours excluding weekends and holidays.* L. *However, the hearing may be held at any time prior to the expiration of the 72 hours.* M. *Any extension will be made in writing and signed by the inmate acknowledging the extension.* *[**Purpose of disciplinary process** shall consist of but not be limited to:]* A. *Maintaining security and control* B. *Ensuring fair and consistent disciplinary practices* C. *Promoting positive inmate behavior* D. Ensuring inmates are provided a fair and impartial disciplinary process. *[**Disciplinary Process Training and Orientation** shall consist of but not be limited to:]* A. All Corrections staff will receive training as to the purpose, philosophy and process of the disciplinary procedures. B. Any questions regarding the disciplinary process can be addressed to the Classification Unit. C. All inmates remanded to the TOCF by the Tribal Court and after his or her initial appearance will receive an Inmate Handbook during Initial Classification and Orientation. D. The Specialist will ensure that the inmate can read the book and understand its contents. E. Should the inmate not be able to understand or read the book the Corrections Specialist will be responsible to explain the contents to the inmate. F. The Corrections Specialist will then have the inmate sign the ACKNOWLEDGMENT OF RECEIPT and will sign the receipt witnessing the inmate's signature. G. Should the inmate refuse to sign, the Corrections Specialist will note the same. All receipts will be placed in the inmate's Classification record by the issuing officer. H. *Should the inmate be incapable to participate in the signature process (due to intoxication or other condition), the program supervisor will be notified and a report will be completed.* I. *The program supervisor will ensure arrangements are made to follow-up on the signature process once the inmate is capable.* *[**Disciplinary leading to criminal charges** shall consist of but not be limited to:]* A. *If a particular rule violation alleges the inmate committed a criminal offense, the inmate will be advised as such prior to conducting the hearing.* B. *A criminal offense does preclude charging an inmate with an in-house rule violation.* C. *An inmate that may have committed a criminal offense has the right to invoke the option of remaining silent.* D. *The right to remain silent should not be interpreted as an indication of guilt.* E. *The hearing officer will note that the inmate was advised of this information.* F. *Any inmate may be prosecuted for any violation of Tribal or Federal Law while in custody.* G. *If an inmate is non-English speaking, an interpreter will be provided to translate during the hearing process.* *[**Procedures for Correction Officers assigned to hearings** shall consist of but not be limited to:]* A. *Conduct fair and impartial hearing.* B. *Ensure all appropriate policy and procedures are adhered to regarding the disciplinary hearing process.* C. *Receive all incident reports and charge sheets involving the incident and inmates involved.* D. *Maintain the DISCIPLINARY HEARINGS LOGBOOK, documenting all hearings, inmates name, charge, findings, and sanction imposed.* E. *Ensure complete documentation of the hearing is completed.* F. *Determine a finding based upon substantiated evidence and testimony presented and that the reports articulate the violation.* G. *Recommend a sanction proportionate to the offense committed.* H. *Hear testimony and review evidence from the accused inmate, witnesses and staff.* I. *Provide the inmate with a copy of the findings, the sanctions, and the right to appeal.* *[**Procedures for the Hearing Process** shall consist of but not be limited to:]* A. *Consistency in the hearing process.* B. *At the start of the hearing, explain the hearing process to the inmate.* C. *The incident reports filed that relate to the incident and inmate will be read to the inmate.* D. *Advise the inmate that they may request witnesses. Ascertain from the inmate what each witness may say and then determine who you may call to testify. The inmate may submit to you questions they want you to ask. The inmate does not have the right to be present when taking testimony from witnesses.* E. *When the Hearing Officer declines to interview a witness, that decision shall be documented on the hearing form.* F. *If an anonymous witness is used or if a confidential source of information lead to the discovery of the incident, then all matters pertaining to that person will be kept in confidence and not revealed to the charged inmate.* G. *If at anytime the hearing process must be continued, such decision will be documented. No continuance will last more than five (5) working days. In all cases, the inmate will be informed of such continuance.* H. *Should an inmate choose not to attend or the behavior of that inmate would pose a threat to the security of the facility, staff or inmates, such non-attendance will be documented along with the reason for non-attendance. In either case, the hearing will go on and the findings noted.* I. *At the conclusion of the hearing, the Hearing Officer will inform the inmate of the findings and sanctions. The inmate will also be informed of their right to appeal such findings to the Corrections Administrator. Any request by the inmate must be in writing and directed to the Corrections Administrator.* J. *All appeals will be reviewed and the inmate advised of the outcome within three (3) working days of receipt of the written appeal.* K. *The inmate does not have the right to representation by legal counsel or another inmate.* L. The Shift Supervisor will review all reports of violations of TOCF Rules and Regulations and may, along with the reporting officer, decide to handle the charges as a minor violation. M. Other (Major Violation) disciplinary reports will be forwarded to the Classification/ Programs Unit. N. Minor charges must be disposed immediately (or within 24 hours). O. The disciplinary hearing Officer may impose any or all penalties for that (MAJOR VIOLATIONS) rule category according to the severity of the offence. P. More than three (3) minor rule violations within a 90-day period will be treated as a major rule violation. Q. For major charges, the inmate must be given at least 24 hours between delivery of the charges and the hearing, except when: a. The inmate waives the 24-hour period, or b. The inmate's release date does not allow 24 hours for notification. *\ **RULE VIOLATIONS*** ***THE FOLLOWING RULE VIOLATIONS MAY BE CRIMINAL OFFENSES AND MAY BE SUBMITTED TO THE COURTS FOR CONSIDERATION OF CIVIL OR CRIMINAL PROSECUTION. THE RULE VIOLATION WILL ALSO BE TREATED WITHIN THE INMATE DISCIPLINARY PROCESS AS MAJOR RULE VIOLATIONS.*** ***GROUP "A" VIOLATIONS: MAJOR*** *A01 Inciting or participating in a riot, disturbance, or demonstration.* *A02 Taking a hostage, kidnapping, or barricading.* *A03 Intentionally causing death or great bodily injury to another person.* *A04 Escape, planning an escape, attempt escape, or encouraging another to escape.* *A05 Unauthorized uses of mail or telephone for the purposes of threatening any person with bodily harm.* *A06 Assault, battery, striking any other person with any weapon or object including your fists, feet, or hands.* *A07 Threatening any person with bodily harm.* *A08 Fighting.* *A09 Sexual assault or threatening sexual assault.* *A10 Extortion.* *A11 Tampering with any security or life/safety device or equipment.* *A12 Possession, manufacturing, consumption of or trafficking in any drug, narcotic, intoxicant, stimulant, depressant, drug paraphernalia, prescribed medication, or non-prescribed medication.* *A13 Willingly engaging in any sexual act including indecent exposure, sexual advances, or stalking.* *A14 Loss, destruction, or damaging Tohono O'odham Nation property.* *A15 Counterfeiting or forging any official documents.* *A16 Smuggling, introducing, or causing to be introduced any contraband into TOCF.* *A17 Possession or manufacturing of dangerous contraband including weapons.* *A18 Setting or causing a fire to be set.* *A19 Writing on or defacing any of the Nation's property.* *A20 Violation of the Tribal Code.* *A21 No physical contact on Corrections staff including items on duty belt.* *A22 Giving or receiving tattoos or possession of tattoo paraphernalia.* **THE FOLLOWING ARE RULE VIOLATIONS THAT WILL BE ADDRESSED THROUGH THE INMATE DISCIPLINARY HEARING PROCESS OF THE TOCF AS MINOR RULE VIOLATIONS. MINOR RULE VIOLATIONS CAN BE TREATED AS A MAJOR VIOLATION ACCORDING TO THE SEVERITY OF THE OFFENSE.** **GROUP "B" VIOLATIONS: MINOR** B01 Arguing or refusing to obey orders directed by Corrections Staff. B02 Making inappropriate demands or requests. B03 Barter, borrow, beg, or gamble with other inmates. B04 Tampering with smoke or fire detectors, fire sprinklers, light fixtures, or any other life safety equipment. B05 Participating in horseplay or rough house antics. B06 Placing blankets, towels, clothing, or any item to obstruct the view of the Corrections Staff in cell areas. B07 Shouting or use of profanity. B08 Sitting or standing on top of tables. B09 Tampering with windows and fixtures. B10 Loitering near cell doors or loitering on the upper level of dormitories or stairways. B11 Entering any other cell you are not assigned to. B12 Storing food items in your cell. B13 Placing or pasting photos or other items on the walls. B14 Lying or presenting false or misleading information to staff. B15 Obstructing, hindering, or impeding correctional staff in the performance of their duties. B16 Theft or possession of another inmate's property. B17 Giving or offering a bribe or anything of value to any staff member or other departmental member. B18 Disrespect in the form of profanity, obscene, or abusive language or gestures. B19 Gambling or possession of gambling paraphernalia. B20 Disorderly conduct. B21 Failure to be fully dressed outside your cell. B22 Interfering or disrupting headcount. B23 Throwing or projecting an item or object (to include "in-house mail kites"). B24 Possession of clothing or items greater than numbered issued. B25 Feigning an illness or malingering. B26 Failure to participate and/or maintain assigned area in compliance with facility sanitation and cleanliness requirements. B27 Being absent from your assigned area. B28 Failure to adhere to outdoor recreation regulations. B29 Failure to keep oneself or assigned area clean. B30 Unauthorized entrance to upper level dormitory when not assigned upper level bunk. B31 Kicking or banging on cell doors or walls. B32 No items shall be worn on head or covering face including shirts, sheets, towels, etc. B33 Weight lifting of any kind with mats, water jugs, or water bags. **MAJOR SANCTIONS** *[**Sanctions** that inmates are subject to for a major violation shall consist of but not be limited to:]* A. Loss of outdoor recreation up to 15 days. B. Room restriction for up to 15 days. C. Loss of visitation for up to 15 days. D. Loss of participation in special events. E. Loss of worker status. F. Restriction from television. G. Restriction from program activities (not to include religious services) up to 15 days. H. Lockdown in isolation up to 15 days. I. Loss of Release Status (work, education, etc.). *[**Sanctions** that an inmates may be subject to for a minor role violation shall consist of but not be limited to:]* A. Verbal counseling, warning, or reprimand. B. Loss of outdoor recreation up to two (2) days. C. Room restriction up to 23 hours. D. Loss of visitation up to two (2) days. E. Loss of participation in a special event. F. Loss of worker status up to two (2) days. G. Restriction from television up to 23 hours. H. Restriction from program activities (not to include religious services) up to two (2) days. **NOTE:** Corrections personnel are encouraged to utilize the minor sanction as a means to manage inmates that are minimally disruptive **I. POLICY:** Tohono O'odham Nation Corrections Officers will conduct documented security rounds of inmate housing units and of the TOCF for the safety and security of staff, visitors, and inmates. **II. REFERENCES:** ***ACA Standards: 4-ALDF-2A-54; 4-ALDF-2A-55; 4-ALDF-2A-58*** **III. APPLICABILITY:** This order applies to all Corrections personnel within the TOCF. **IV. DEFINITIONS:** **[Security Rounds] \--** consist of a walking tour of a specifically assigned area or a tour of the entire Corrections Facility. A security round consists of physically walking through or within an area to observe inmate behavior, activity, and well-being. If the area contains inmate housing rooms or dormitories, the round will include full observation into those areas. Each round and any significant observation will be documented. Also be referred to as security checks. [Shift Activity Log] \-- are designed to create a record of activity occurring on a shift for a specified area. This will be created at the beginning of each shift and entered into the Spillman Jail Management software. Items recorded will include headcounts, equipment checks, incidents, releases, physical plant status, and any other activity. Supervisory personnel will be required to review and record on the activity log a minimum of every two hours. This log is to be submitted with the shift summary at the end of each shift. This form will also contain notation of security rounds as directed in accordance with policy and procedures. [Roving Officer] \-- A Corrections Officer that performs the post duty (refer to Security Officer Post Orders) of security rounds. **V. PROCEDURES:** **[Completing a Security Round shall consist of, but not be limited to:]** A. Security rounds will be conducted continuously by the Roving Officers to ensure the safety and security of inmates, the facility, staff, and visitors. B. Security rounds for high observation, medical isolation, and maximum security areas will occur every 15 minutes or within a period of that time by the Roving Officers. C. Other security round times may be directed for special populations or circumstances. D. Roving Officers conducting those rounds will document such activity on a Shift Activity Log on the jail management software (Spillman) immediately upon the conclusion of the activity. E. During the course of conducting a security round of housing units or dormitories, a minimum of two officers will be assigned. a. One officer will stand by the entrance of the housing unit while the other officer enters the unit to conduct the security round. b. This security check involves active association to ensure security (i.e., doors, locks, vents, bunks, etc.) and safety of inmates. F. While an Officer is conducting security rounds within the housing units, particular attention will be paid to the inspection of toilets, showers, and lighting. G. The Roving Officer should conduct an inquiry of the inmates; if any problems exist regarding these or any other areas document it and report to supervisor. H. The Roving Officers should also test toilet plumbing, etc. to ensure proper operation. **[Security Rounds for Suicidal Inmates shall consist of, but not be limited to:]** A. **Inmates that are suicidal will be placed on a suicide watch inside a high observation cell.** B. **The documentation of security rounds on these inmates will be kept on a separate log with the name of the inmate, the time frequency of welfare checks, and the inmates' current disposition.** C. **This activity will be constant until Behavior Health has had a chance to evaluate the inmates' situation. (Refer to Suicide Watch policy).** **[Perimeter Security Rounds shall consist of, but not be limited to:]** A. Perimeter security rounds will be conducted a minimum of twice during midnight shift. B. Day shift and swing shift will conduct a minimum of one check. C. Perimeter security rounds will be noted on the Shift Activity Log. **NOTE:** Personnel assigned to this task should pay special attention to breeches in perimeter fencing, entrances, and the building structure. Attention should also be given to suspicious vehicles and people. *Any security breach or suspicious situation should be reported immediately to the on-duty supervisor and documented accordingly. Actions taken will be noted and the report will be forwarded to the Corrections Administrator.* [**Security Rounds for Inmate Programs** shall consist of, but not be limited to:] **NOTE:** Inmate Programs are conducted in a variety of locations depending on the program being offered. The program may occur in the Day Room of the housing unit, outdoor recreation yard, classroom, or the Inmate Programs Rooms. A. In any location, security rounds will occur regularly and noted as such on the Shift Activity Log. B. Prior to a program beginning in the Outdoor Recreation Yard, the area will be searched as directed in the OUTDOOR RECREATION policy and INMATE PROGRAMS policy. **I. POLICY:** **All individuals released from the custody of the Tohono O'odham Nation Corrections Facility (TOCF) will be released in accordance with lawful and authorized procedures.** **II. REFERENCES:** **ACA Standards: 4-ALDF-2A-16; 4-ALDF-5B-18; 4-ALDF-7F-02** **III. APPLICABILITY:** This general order applies to all Corrections personnel working within the TOCF. **IV. DEFINITIONS:** **[Spillman] --** The jail management software used in conjunction with Corrections activities. **V. PROCEDURES:** **[The Verification of releases shall consist of, but not be limited to:]** **NOTE:** The Corrections Staff member involved in the release of an inmate shall positively identify the inmate against the name and photo of the inmate on record. A. All information including court case numbers, citations, detainers, and court orders shall be reviewed prior to release of an individual. Corrections staff involved in the release of an inmate shall assure that all corresponding paperwork is in compliance with existing court paperwork and documents contained within the inmate's file. B. The Corrections staff member conducting the release of an inmate will ensure that all documents are in order. In the event of a question, the Court, Prosecutor's Office, and a supervisor may be contacted as appropriately indicated. C. In order to ensure the proper release of confined individuals, the following steps will be taken: a. **Match the case numbers on the booking records to the case numbers on the release order.** b. ***Cross check all booking records with the Spillman ARREST/OFFENSE tables to ensure that all charges are accounted for in the release order.*** c. ***Check the Spillman HOLDS Table to ensure no holds were been placed.*** d. ***Check the INITIAL APPEARANCE booking record in-box to ensure no new charges not yet entered into the computer (Spillman records) have been filed.*** e. ***Call Dispatch for any other existing warrants.*** f. ***Ensure warrant is not active on the Spillman Names Table.*** D. Prior to the release of the inmate, the on-duty supervisor will be required to review ALL documentation to ensure the release is lawful and authorized. [ADDITIONALLY, THE INMATE SHALL BE RELEASED OUT OF THE COMPUTER PROGRAM (SPILLMAN) PRIOR TO PHYSICALLY RELEASING THE INMATE TO ENSURE THERE ARE NO HOLDS, WARRANTS, OR CHARGES PENDING.]{.smallcaps} [**Temporary releases, bonds, and/or prosecution declination** shall consist of, but not be limited to:] A. Any temporary release of an inmate will require the same process as described above. Any detainers that are in place for an inmate temporarily released to another agency will be given to the transporting agency and/or personnel. B. No Bonds or Fine payments will be accepted. Persons shall be directed to Judiciary for this activity. C. After an individual is booked into the TOCF and before they have an initial appearance, the Prosecutor's Office conducts a review and then determines if charges will be filed with the court. a. In the event the Prosecutor's Office decides not to file charges, the Prosecutor's Office will issue a written declination, which will contain the individual's name and the case number(s) for which they were arrested and booked. b. Once in receipt of this, a copy should be placed in the individual's file and the individual will be released. In the event that all the charges are not covered, then the Corrections staff member should contact the Prosecutor's Office and get a clarification and/or another declination as the situation indicates. c. In the event the individual has a HOLD, then procedures for addressing the HOLD shall occur. **I. POLICY:** The issuance and access to the Tohono O'odham Nation Corrections Facility key box will be strictly controlled to prevent an inmate escape, unauthorized access, or other breech of security from the TOCF. **II. REFERENCES:** ***ACA Standards: 4-ALDF-2A-1; 4-ALDF-1C-09*** **III. APPLICABILITY:** This general order applies to all Corrections personnel within the TOCF. **IV. DEFINITIONS:** **[Key box] -- A secure electronically accessed key vault; allowing only Corrections personnel access to certain sets of keys dependant on their security clearance. This box will allow the Corrections Administrator to set varying levels of clearance for certain keys and only those individuals have access to those keys.** **[Key Control] -- The authorized Corrections personnel's secure handling and constant tracking of keys through key inventories and auditing of the key box during each shift daily.** **[Security override] \-- The complete temporary stoppage of operations and total lockdown of inmates in order to restore key control.** **[Emergency key set] \-- A set of keys will be maintained in a secure offsite storage in the event of an emergency to gain access to the Corrections Facility.** **\ ** **V. PROCEDURES:** [**Key Control** shall consist of, but not be limited to:] A. The shift supervisor or designee will run a report from the Keywatcher to document the inventory of all facility and vehicle keys at the beginning of shift. B. Any discrepancies will be reported immediately verbally and in writing to the Corrections Administrator. C. If warranted, the shift supervisor will order a "security override" and initiate search procedures to account for the missing keys. If the keys cannot be accounted for, the Corrections Administrator will be contacted. This activity will not be delegated. a. The override may remain in effect until the keys are found or the Corrections Administrator determines otherwise. b. All Corrections personnel will stay until all keys are accounted for. c. Should a Corrections Officer take home his/her keys, they must contact their supervisor and return the keys immediately. D. All Corrections Officers must enter a secure code to be issued a set of keys from the Keywatcher key control system at the beginning of each shift and must return keys to the Keywatcher system prior to leaving for the day. ***NOTE: Keys will never be handed to another Corrections staff member, and must always be checked back into the Keywatcher System when finished with the use of that key set.*** E. All locks, locking devices, and keys in the housing units will be checked each shift to ensure proper working order and condition. F. The Support Services Unit will be responsible to assure duplicate sets of facility keys are maintained in a secure, controlled locked box/safe. d. This Unit will also be responsible to conduct an audit and run reports of monthly, weekly, and annual inventory of all keys to assure accountability. e. This audit report of all keys will be kept on file in the Support Services Unit. G. Corrections Officers will carry and use facility keys in a secure manner. H. Keys should be fastened to the Corrections Officer's utility belt and secured to prevent loss or theft. I. No Corrections personnel will discuss keys or locks in the presence of inmates. J. Keys will always be exchanged hand to hand, never thrown or tossed. K. Keys will never be forced into locks. L. If a key is damaged or fails to work, the Corrections Officer will report the malfunction immediately in writing and take the key out of service. M. Any malfunctioning lock will be reported in writing and, if necessary, immediate repair procedures will take place by contacting the Tohono O'odham Nation Corrections Facility Manager. [Use of **Emergency key** set shall consist of, but not be limited to:] A. The keys will only be used in an emergency and at the request of the on-duty supervisor. B. These keys will not be authorized as use for entry into the Corrections Facility by any other personnel. **I. POLICY:** **It will be policy of the Tohono O'odham Nation Corrections to follow the procedures set forth in this general order to ensure the safe and secure transport of inmates. All inmates being transported will be done in such a manner that the Officer, inmate, and community will be safe and secure.** **II. REFERENCES:** ***ACA Standards: 4-ALDF-1B-01; 4-ALDF-1B-02; 4-ALDF-1B-04; 4-ALDF-1B-05*** **III. APPLICABILITY:** This order applies to all Corrections personnel within the Tohono O'odham Nation Corrections Facility assigned the duty post of Transportation Officer. **IV. DEFINITIONS:** **None.** **V. PROCEDURES:** [**Corrections Officer to Inmate Ratio** shall consist of, but not be limited to:] **NOTE:** As a general rule, when inmates are transported out of the Corrections Facility (i.e.: hospital, court, appointments*,* anywhere on or off the Nation) the following will occur: A. There will be a 2:1 ratio (two {2} Corrections Officers to one {1} inmate) at anytime the inmates leave the Tohono O'odham Nation. a. If an exception is made to this rule it will be done by the on-duty supervisor and the classification of the inmate. b. Inmates that are HIGH SECURITY status will require two {2} or more Corrections Officers to each inmate during any transport. B. Inmates that are on the Community Service list and are being utilized in the Community for assistance, will be a ratio of 1:4(one {1} Correction Officer to Four {4} Inmates). C. Community service workers will be selected based upon their classification status. D. Inmates on transport to I.H.S. (Indian Health Service) will be a 2:1 ratio (two {2} Corrections Officers to one {1} inmate). E. Inmates authorized to attend a funeral or other activity under supervision; Corrections will require that two officers per inmate (ratio 2:1) be assigned. F. Inmates that are being moved from the high security section will at all times have a minimum of two {2} Corrections Officers. [**Community Service transports** shall consist of, but not be limited to:] A. Inmates that are on the Community service list are done with a process from the Classifications Officers. Inmates assigned to Community Service will be selected by the shift supervisor or any Sergeant. B. The Corrections Officer will have Inmate identification wristband bar-code prior to bringing the Community Service helpers out. The Identification bar-code must have: a. Name b. Date of Birth c. Height d. Weight e. Hair color f. Eye color g. Build h. Picture C. All inmates must have their orange shirts, pants and shoes. D. Retrieve all necessary tools that may be needed (Shovels, Rakes, Picks, Gloves, etc.). E. Arrive at the location at the designated time arranged by the approving Sergeant. F. Inmates will not need to be restrained while on this assignment. G. Should an inmate leave the work site, the Corrections Officer will advise dispatch and Central Control. [**Maximum Security Inmate Movement** shall consist of, but not be limited to:] A. Cuffed and shackled with three (3) Corrections Officers when out of room. B. Cuffed and shackled with two (2) Corrections Officers when out of room. C. Cuffed and shackled with two (2) Corrections Officers when out of housing unit. D. Cuffed and shackled with two (2) Corrections Officers when out of facility. E. ESCAPE RISK. F. Two (2) Corrections Officers present when out of room. G. ISOLATION. H. Extra security restraints and precautions (cuff behind back). (*Reference: General Order, IV-D \-\-- Use of Restraints Policy)* [**Transports** shall consist of, but not be limited to:] All transports have pre- transport, transport, and post transport duties but are not limited to: A. Pre-transport Duties a. Vehicle Maintenance b. Vehicle Search c. Classification Notes d. Inmate Search e. Verification of Transport f. Vehicle is fueled g. Sign out gas card if needed h. Fully charged Radios and/or another form of communication. i. Restraints will be used on any transport except for community service. A. Transport j. Notify Central Control the number and names of inmates to be transported. k. The vehicle mileage will be called to dispatch when departing the Facility and upon arrival. l. The number of inmates that are being transported. m. Limit public contact. n. Observation o. No restraints will be fully removed unless a medical procedure requires and then in that case two {2} officers will be present at all times. B. Post Transport p. Restraints will not be removed until the inmate is at the designated location. q. Strip search each inmate individually. r. Clean the inside of the vehicle. s. Park the vehicle in the designated location. t. Sign in gas card and receipts for any out of area transports. [Protocol for **Transport Incidents** shall consist of, but not be limited to:] A. In the event that something happens while on a transport Dispatch will be notified immediately. B. If an inmate leaves the area the Corrections Officer will not leave the other inmates to pursue. C. Should an inmate either leave or experience a medical injury or condition, dispatch will be advised of the situation so proper assistance may be dispatched. D. Anytime a security threat or situation occurs, the Corrections Officer(s) will terminate the activity and return to the TOCF. E. Community Service should occur during daylight hours, and are not to exceed seven (7) hours unless authorized by the shift Sergeant. F. Dispatch will be notified at anytime an incident has occurred. [**Inmate Movement and Transport** shall also consist of, but not be limited to:] A. When transporting or moving an inmate, selection of restraint equipment will depend upon the security classification of the inmate. B. Consideration is also given to the level of anticipated public contact, the physical and mental health of the inmate, the displayed behavior or the inmate, the purpose of the movement, and the inmate's destination. C. Inmates transported out of the Corrections Facility for court appearances or medical care will have restraints applied prior to exiting the facility. This will include cuffs and shackles. D. Inmates being moved from general population to high security housing will be placed in handcuff and leg shackles. E. Adult male and female inmates will not be moved or cuffed together. F. Juveniles will not be cuffed or transported with adults. G. Inmates in transit to and from work detail do not require restraints. **I. POLICY:** The Tohono O'odham Nation Corrections Facility will use a system to physically count all inmates, which includes accountability for inmates assigned to work release, work crews, programs, temporary release, and any other activity. **II. REFERENCES:** ***ACA Standards: 4-ALDF-2A-17*** **III. APPLICABILITY:** **This order applies to all Corrections staff with regard to conducting headcounts of inmates.** **IV. DEFINITIONS:** *[FORMAL (HARD) HEADCOUNTS:] Organized counts conducted daily at a specific time that requires inmates' to be restricted to their assigned room or living area. These counts are sometimes referred to as a "lockdown headcount". A formal headcount requires that Corrections staff performing the count scan each inmate's identification wristband as well as maintain a written log. Formal headcounts will be conducted at each shift change and additionally as needed for security purposes as well as during meal servings and the administering of medication. During this period, all activity is suspended and inmates are directed to return to their assigned cell. The Corrections Officer will ensure that all inmates are awake and will inspect each inmate individually for injury and welfare.* *[INFORMAL (SOFT) HEADCOUNTS:] Headcounts made while inmates are engaged in various activities during the duty shift conducted at irregular times and recorded on the activity log. For example an informal headcount will be conducted during inmate programs to note the number of participating inmates for documentation purposes.* **\ V. PROCEDURES:** **[The Procedure for Headcounts shall consist of but not be limited to:]** A. **Formal headcounts will always be performed prior to each shift change by the supervisor of the relieving shift and an officer on the current shift.** B. **When entering a section to perform headcount officers conducting the headcount will inform the inmates in the section of headcount.** C. **Corrections Staff will observe and ensure that all inmates go to their designated sleeping areas before beginning the count.** D. **Corrections Staff will cease all inmate activities and eliminate distractions such as the television for safety reasons.** E. **Corrections Staff will scan the identification wristbands of inmates housed in that section (or cell by cell if applicable). In addition to scanning wristbands***, officers are also required to maintain a written count on the Headcount sheet.* F. **Corrections Staff will note the appearance of inmates to include injuries or concerns.** G. *A Corrections staff member from each respective shift (going off duty and coming on duty) will conduct the count together* H. *If the headcount is not correct, inmates may be directed to return to their cells for another count. If the headcount is not reconciled, the Corrections Administrator shall be notified immediately and all Corrections Officers will be required to remain on duty until the count is cleared* **I. POLICY:** The Tohono O'odham Nation Corrections Facility will regulate the handling and disposal of inmate razors in a manner that complies with the handling of items contaminated with blood borne pathogens. **II. REFERENCES:** ***ACA Standards: None*** **III. APPLICABILITY:** **This general order applies to all Corrections personnel within the TOCF.** **IV. DEFINITIONS:** **None.** **V. PROCEDURES:** [The **Procedures for Razor Control and Disposal** shall consist of but not be limited to:] A. **Razors will be issued to all inmates and returned daily during Day Shift.** B. **When the razor is issued, it will be examined by the Corrections Officer and the inmate to ensure it is intact.** C. **When the razor is returned, the Corrections Officer and the inmate will examine the razor to ensure it is intact.** D. **The inmate will be required to return the razor with the plastic cap covering the blade(s).** E. **Razors will be changed every day and destroyed after every use.** F. **Inmates will not leave the housing unit for outdoor recreation, court, or any other activity without first returning the razor.** G. **The Corrections Officer assigned to the issuance and return of razors will wear disposal gloves while assigned to this task.** H. **All razors will be disposed of in a "Sharps" container.** I. **Inmates that are released will not have their razor reissued to another inmate.** J. **Razors shall be returned the same shift they were issued.** K. If a blade or any other part of the razor is unaccounted for, the on-duty supervisor will be notified immediately. The on-duty supervisor may direct a search of the inmate and/or the housing unit. L. **Once the "Sharps" Container is full, the Evidence Technician will be contacted. Arrangements will be made to deliver the "Sharps" container to the Evidence Unit for disposal and the pickup of a new container.** **. POLICY:** The Tohono O'odham Corrections staff will conduct frequent and unannounced searches of persons and the TOCF properties to prevent the introduction and presence of drugs, weapons, or other dangerous prohibited contraband that can pose a danger to staff, visitors, and inmates. Searches are also conducted to detect breaches in security, identify facility maintenance issues that require attention, and eliminate the unlawful presentation of contraband during the intake process. **II. REFERENCES:** ***ACA Standards: 4-ALDF-2A-2; 4-ALDF-2C-01; 4ALDF-2C-03; 4-ALDF-2C-04; 4-ALDF-2C-05; 4-ALDF-6C-19*** **III. APPLICABILITY:** **This general order applies to all Operational Corrections personnel with regard to inmates incarcerated within the TOCF.** **IV. DEFINITIONS:** [PAT SEARCH AND ELECTRONIC SWEEP] is the search of an inmate's clothing by a combination of pat search and electronic scanner. This type of search may involve partial disrobing of the inmate to include just the outer shirt, coat, boots or shoes, and socks. The inmate may be changed into Corrections clothing. [STRIP SEARCHES] involve the removal of all of the inmate\'s clothing and visually inspecting the body of the inmate by a member of the same sex. It does not involve physical contact with the inmate nor the lifting or spreading of any part of the body with the exception of the inspection of the bottom of the feet. Inmates are directed to run their fingers through their hair and to open their mouth for visual inspection. Inmates are also instructed to raise their arms and turn slowly to allow visual inspection of the body. [\ ] [BODY CAVITY INSPECTION] is a strip search that involves inspection of body cavities with no physical contact with the inmate or intrusive action. This search requires the inmate to be directed to squat, cough, bend, spread and to lift body parts to allow visual inspection of body cavities. [BODY CAVITY SEARCH] is the search of body cavities, which occur only under special circumstances and with the belief that a person is concealing contraband. This search can only be done with the approval of the Corrections Administrator and is conducted and/or performed by a physician. This type of search often requires obtaining a court ordered search warrant. [CONTRABAND] is any dangerous drug, narcotic drug, marijuana, intoxicating liquor of any kind, deadly weapon, dangerous instrument, explosive, or any other article that would endanger the safety, security, or preservation of order in the Corrections Facility or any individual in the facility. Contraband is also any item not authorized by the TOCF. **V. PROCEDURES:** [The criteria for **Search of Persons and Places** shall consist of, but not be limited to:] A. Male Corrections Officers will not search female inmates unless given specific direction to do so and only under EXIGENT circumstances and when no female Corrections Officer is available within an appropriate time frame. B. Corrections Officers will not conduct or be present during a strip search, body cavity inspection, or body cavity search of an inmate of the opposite sex unless under EXIGENT circumstances for the control, order, and safety of the Corrections Officer conducting this activity. Male inmates who voice an objection based upon religious beliefs to being pat searched by a female officer will be pat searched by a male officer. C. All contraband items will be seized and disposed of according to department policy. Any property or contraband confiscated during a search will be documented and accounted for with a copy of all documentation forwarded to the Corrections Administrator. D. Criminal evidence will be referred to the appropriate law enforcement agency for disposition. E. Prohibited items will be placed in the inmate's property or handled as directed by the on-duty supervisor. F. Searches should be conducted utilizing universal body fluid precautions to prevent exposure to blood borne pathogens. G. Searches conducted for no particular reason, punitive purposes, or harassment is prohibited. H. All items in possession of inmates at time of intake will be searched before the inmate is allowed to enter the secured environment of the TOCF. I. Strip searches of general population inmates will be conducted only when there is reasonable belief that inmate may be in possession of contraband. Reasonable belief is based on a. Current charges or previous convictions for escape or possession of drugs/weapons or crimes of violence. b. Current or historical institutional behaviors of contraband possession or refusals to be searched. c. Contact with the public or exposure to public areas. J. Contaminated property present during search (i.e., dangerous chemicals; blood; urine; feces; vomit, etc.) is to be placed into a Bio Hazard Red Bag for proper decontamination/disposal. Disposed property will be taken to Indian Health Service (IHS) for Bio Hazard disposal. K. Search of an inmate that requires him any level of disrobement will be conducted in a location that affords privacy for the individual and assures no intrusion by persons of the opposite sex. The search will be conducted in a manner that is minimally intrusive and designed to avoid unnecessary force, embarrassment and indignity while considering the secure integrity of the TOCF. L. The Corrections Officer will log in any confiscated items onto the Inmate Property Release form and place the item into the inmate's property bag. It is the responsibility of the inmate to arrange for the property to be picked up within seven (7) days. Any confiscated property not picked up in seven (7) days will be discarded. [**Discovery During Search** shall consist of, but not be limited to: ] A. Any injury, illness, contraband, damage or destruction discovered during a search requires documentation by the involved Corrections Officer. B. Documentation will be given to the on-duty supervisor for appropriate action and forwarded to the Corrections Administrator. C. Any "body jewelry" that pierces the inmate\'s skin will, if possible, be removed by the individual and placed in the inmate's property. If the item cannot be removed by the individual, then medical consultation will occur. D. Should medical intervention occur, approval from the on-duty supervisor will occur in addition to documentation and entry into Spillman under "Inmate Log". [**Intake and Intake Property Search** shall consist of, but not be limited to: ] A. All items in possession of inmates at time of intake will be searched. B. All items will be inventoried and listed into the Spillman System with special attention to brand names, color and description. C. Any contraband will be seized and if appropriate referred to the appropriate law enforcement agency for action. Documentation of any contraband seized will occur. D. Contraband of a non-criminal nature will be secured appropriately. E. All individuals will be searched by an officer of the same sex. F. During intake an officer will not observe the inmate changing clothes, unless a reasonable suspicion that an attempt to bring in contraband is being made. If such action is deemed necessary the shift supervisor will be notified immediately and the situation will be documented in an incident report form. G. Arresting/escorting Police Officer shall enter the facility and remain present until proper search of inmate is completed. [**Pat Search and Electronic Sweep** shall consist of, but not be limited to:] A. Shall be used on inmates leaving and returning to their housing units. B. Used during the intake process. (*Reference: General Order, III-G \-\-- Intake Screening & Processing)* C. Male Corrections Officers will not pat search a female inmate. D. Male and/or Female Corrections Officers are allowed to pat search male inmates unless a male inmate voices an objection due to religious beliefs. E. Any Corrections Officer may conduct an electronic sweep with a metal detector on either male or female inmates since it does not involve physical contact. At minimum, a pat search and electronic sweep shall be conducted on every inmate moving from one location in the TOCF to another. [**Strip Search** shall consist of, but not be limited to:] A. Used during intake process for all individuals booked into the TOCF. B. Used when documented reasonable doubt exists that contraband is present or a history of contraband exists. C. Performed out of sight of persons not directly involved in the search and by a Corrections Officer of the same sex as the inmate. D. Any inmate returning from an outside activity will be strip-searched regardless if they were under the supervision of a Corrections Officer. [**Body Cavity Inspections** shall consist of, but not be limited to:] A. Done when a special circumstance exits with suspicion of contraband. B. May be used on a new arrestee and an in-custody inmate when special circumstances justify. C. Used when an inmate is moved to a high security classification housing unit. D. Inmates housed in high security housing will be subject to cavity inspection based upon the following: a. Potential danger to staff and other inmates. b. Potential escape risk posed and prevention of tools/items that facilitate escape. c. Inmates in Isolation/Maximum Security will be strip-searched each time they leave and return to that unit. [**Body Cavity Searches** shall consist of, but not be limited to:] A. Used when reasonable suspicion of concealment of contraband exists. B. Used with approval of on-duty supervisor and Corrections Administrator. C. Performed by a Licensed Physician. [**Special Circumstances** shall consist of, but not be limited to:] A. History of concealment of weapons or drugs in a body cavity. B. History of or current arrest for drug use, possession, manufacture, trafficking, or paraphernalia. C. History of a combination of the above. D. The appearance of fresh needle punctures, a drug induced "high", or the appearance of a drug induced high after having been in custody for 12 hours or more. E. Other facts learned about an individual in custody that creates a belief that they are likely to be concealing contraband in his or her body orifices. [**Search of Inmate Living and Activity Areas** shall consist of, but not be limited to:] A. Inmates presence during search not required. B. Legal mail will be searched. C. Inmate areas/property will be left in the same manner as originally found. D. Inmate property searched will not be intentionally discarded, broken, damaged, or misplaced. E. Searches will not be conducted for punitive or harassing means with the highest level of professionalism exemplified at all times. F. Major searches will be conducted for cause and on a schedule determined by the Corrections supervisory staff. G. Areas selected by supervisory staff will be randomly searched to ensure a secure and sound facility. H. Isolated/Maximum Security inmates will be searched, including all inmate property once per day. [**Decontamination** of an individual who has been exposed to the biohazard of methamphetamine production shall consist of, but not be limited to:] A. Inmate Shower. B. The Corrections Specialist will assign location and duration of isolation if necessary. C. All contaminated property will be stored or disposed of consistent with Biohazard Handling. D. The Corrections Officer is to remain vigilant of any odors that are related to methamphetamine for the possibility of contamination.
