CI/CP-2/1.10 Cleanliness at stations and in trains, Pay & Use Toilets. PAY & USE POLICY (RB letter no.2013/TG-IV/16/SAN/43/Pol. CI Dtd:30.03.2015) 1. All meaningful and necessary efforts have been made by the Railways to maintain the cleanliness at stations and in trains. 2. Cleanliness is very important in terms of passenger amenity , and efforts are being made to reach it to a higher level. 3. The "pay and use" policy is mainly divided into two parts-- i). Construction of Deluxe Toilets, ii). General "pay and use" toilet. 4. According to the different category of stations, it is decided that which station will have deluxe toilets and which station will have deluxe toilet and normal “pay and use” toilet both. 5. Construction of Deluxe Toilet will be based on PPP and BOT (Built, Operate, and Transfer). 6. A supervisor level committee will be formed for the construction of deluxe toilet, which formed by Commercial, Engineering, Electrical , Station Manager and it will be approved by DRM. 7. Open tenders will be invited through single packet system. 8. Deluxe toilets should be ready within six months from the date of award of contract. 9. The bidder will have the right to advertise through glow sign boards/ Signage’s on maximum 75% of the construction area. 10. Electrical wiring should be done with approved ISI branded material. 11. All pipeline fittings should be of ISI mark, separate arrangement for hot and cold water necessary. 12. There will be separate arrangements for men and women. 13. Special designed toilets will have to be made for the disabled. 14. There should be exhaust fan, separate water storage tank, hand wash area. 15. Deluxe toilet will have two types of facilities- I. Compulsory II. Desirable 16. The net worth of the bidder should not be less than Rs. 50 lakh and should have minimum 2 years’ experience in construction sector. 17. Cleaning will be done within the time period prescribed by the Railways. 18. Electricity bill / water bill will be bear by the service provider. 19. Deluxe Toilet Charges- Station class Bathroom & Latrine Latrine Urinal A1&A 15/- 5/- 1/- B 10/- 5/- 1/- C 15/- 5/- 1/- 20. Normal Agreement Period- 10 Years Guidelines for the policy of General "pay and use" toilet- 1. It comes under “Integrated Station Cleaning Contract”. 91 2. If "pay and use" contract has been given by any department other than commercial department, then cleaning contract should also be given at that station by the same department. 3. Renovation and maintenance of already available toilets will be based on PPP and ROMT(Renovate Operate & Maintain and Transfer). 4. Contract Period—10 Years 5. The renovation work should be completed within a period of 4 months. 6. Selection Process- Open Tender through ROMT (Single Packet System). 7. If no response is received through open tender, then in consultation with the Finance Department and with the approval of DRM, the license will be given on fulfilling the following conditions— A1 Net worth should not be less than 15 lakhs 8. The A Net worth should not be less than 7.5 lakhs bidder B Net worth should not be less than 2.5 lakhs C Net worth should not be less than 7.5 lakhs(Mumbai) & 2 Lakh(Pune) D&E Net worth should not be less than 01 lakh should have at least 2 years’ experience (in the same field). 9. The prescribed illumination level should be maintained by party. 10. Charges (Rate List)— Station class Bathroom & Latrine Urinal Latrine A1&A 15/- 5/- Free B 10/- 5/- Free C 15/- 5/- Free D&E 05/- 2/- Free 11. Electricity / water system - installed and maintained by the service provider. Also water charges and electricity charges will have to be filled according to different categories of station. (Letter No.C-383-P-P&V-Policy / Amend 2018 dt: 01/02/2018). 12. The cleaning / maintenance schedule of “Pay and Use” will have to be done within the stipulated time period. 13. All repairs / routine maintenance such as electrical fittings, cracks, sanitary fittings, drainage, signage will have to be resolved promptly. 14. Septic tank cleaning / sewerage system / white wash / mechanized grinding / polishing will be done annually. 92 15. Should prevent encroachment around toilets/ given railway space.. 16. EMD – 25% of the total contract amount (admissible in the form of DD /MR ) and the payment by checque not accepted. 17. Security Deposit – 25% of the annual license fee has to be deposited within 15 days from the date of receipt of Letter of Acceptance. 18. After the LOA, if the contractor does not start the work within 21 days as per the license fee / security deposit or agreement, then the EMD will be forfeited. 19. Service Provider will be responsible for paying all types of Government / Central Government / State Government / Local Taxes. 20. Complaint/Suggestion Register will be maintained by the Service Provider. 21. Validity of the offer—90 days 22. The Railway Administration reserves all the right to accept / reject the tender. 23. Railway can cancel the contract by giving one month's notice. 24. Arbitration OBJECTIVE 1. Facility of parking of private and public motor vehicle in railway station premises is an important amenity which is being provided by the railways or outsourced by railway. 2. Wherever outsourcing is not feasible, than this service will managed by railways. 3. Allotment of parking area at important station NSG1 to NSG6 & SG1 to SG3 should be awarded through open tender only ( Single packet system) and through quotation for short term period not exceeding six months. 4. At HG1 to HG3 category station this activity will be manned by halt contractor on suitable nominal charges decided by the railway administration in concurrence with associate finance. 5. Railway should provide a well demarcated, fenced, and leveled surface to the contractor for parking purpose with earmarking. ANTICIPATED EXPECTED EARNINGS ( Reserve Price) 1. Expected earnings for all NSG1 to NSG6 & SG1 to SG3 category of stations should be assessed on the basis of following parameters by Sr.DCM/DCM in advance before inviting tenders/quotations with the concurrence of Divisional finance- - Numbers of users - Patronage of Daily/ MST passengers - Surveys conducted on the site - Types of vehicle 94 - Parking charges at the similar other location - Parking types - Last accepted rates - Total service tax liability The total earning expected from the area shall be reduced by Taxes/ Cess /Service Charge/Staff expenses. 2. Once process for allotment of parking area has been initiated and no response is received, second notification may be initiated within a week, on same reserved price. In case of no response to second notification also, then third notification may will be initiated with reduction up to 10 % in reserved price without taking any finance approval, within a week. 3. As far as possible, allotment of additional area after awarding contract. EARNEST MONEY DEPOSITE (EMD) 1. For Contract of reserved price less than Rs. 5 lakh – 2% (Minimum 10K) For Contract of reserved price more than Rs. 5 lakh – 2% (Minimum 25000/-) 2. EMD can be paid through DD in favour of Sr. DFM or through Money Receipt obtained from Sr. Divisional Cashier (Pay) 3. EMD is not accepted through Cheque. 4. EMD can be adjusted as license fee / security deposit. FORFEITURE OF EMD 1. If the tenderer fail to remit the license fee or security deposit within 21 days from the date of LOA , the EMD will be forfeited. SECURITY DEPOSIT 1. Service provider shall furnish to railway a security deposit equal to 25% of annual license fees for the contract awarded for 3 years within 21 days from the LOA or within a week from confirmation of work by him whichever is later. 2. If the contract is awarded on the basis of quotation , licensee may submit security deposit equal to 25% of the license fee which is refundable after expiry of one month of contract. 3. Without submission of SD contract can not be commenced. 4. Security Deposit can be accepted in the form of Bank Guarantee, FDR,DD or Cash. 95 5. SD shall be released only after successful completion of the contract duly ensuring that the railway premises is handed over by contractor. 6. SD will be discharged within 90 days from the expiry of successful completion of contract period after deduction/ settlement of outstanding dues if any. ELIGIBILITY CRITERIA OF LICENSE A) If Reserve Price is more than Rs.one lakh than --- 1. NSG-1 to NSG-2 -- Turnover should not be less than Rs.30 lakhs 2. NSG-3 -- Turnover should not be less than Rs.25 lakhs. 3. NSG-4 -- Turnover should not be less than Rs.20 lakhs. 4. SG-1 to SG-3 -- Turnover should not be less than Rs.20 lakhs. 5. NSG-5 to NSG-6 -- Turnover should not be less than Rs.5 lakhs. Note – For station of category NSG-1 to NSG-2 , minimum 6 months working experience of similar work in railways/other Govt. establishments. For other categories experience is not mandatory. B) If Reserved Price is upto Rs.one lakh than --- Turnover should not be less than the reserve price. SUBMISSION OF TENDER FORM 1. The original receipt of EMD. 2. Cost of tender form. 3. All the general and special conditions to be signed and enclosed with the tender form. 4. Character and current antecedents verification of the tenderer ( Police verification certificate not prior to six months from the date of notification. 5. Turnover details. VALIDITY OF OFFER 1. The tender is valid for a period of 90 days from the date of receiving the tender. 2. All rights are reserved to railway to extend the validity of tender. 3. If the tenderer withdraws his offer before acceptance/rejection by the railway administration or before 90 days from the receipt of tender, whichever is earlier, the EMD will be forfeited. 96 4. If the EMD forfeited , the tender will be discharged and fresh tender will be initiated by debarring the party/firm/applicant for the period of three years. LICENSE FEE PAYMENTS 1. License fee should be on quarterly basis. 2. The penal interest of 12% per annum may be charged for the delay in payment of license fee after giving first notice of payment i.e. within 15 days. PENALTY OR PUNITIVE CLAUSE 1. At any time inspection can be done by Sr. DCM or his authorized representatives. 2. Penalties can be imposed on account of excess charging, complaints, unauthorized operation of excess area, deviation to the agreement clauses etc. as under- ACM- Fine up to 5000/- DCM – Fine up to 15000/- Sr. DCM- Fine up to 25000/- All files related to vigilance raid/inspection may be put to Sr. DCM to decide fine amount. In case of repeated occurrence of complaints , a shoe cause notice for termination of license may be served to the contractor. PARKING RATES 1. Parking rates includes the service tax liabilities. 2. Parking charges should be fixed by Sr. DCM/DCM with the concurrence of divisional finance and approval of DRM. 3. While fixing the parking rates , a survey should be carried out at other similar location in the city/area. 4. Parking charges should be in multiple of rupees five , and on the basis of hours. There should be separate tariff for monthly users. 5. If any vehicle is parked more than 24 hours ( except MST users) licensee should inform to GRP/RPF. 6. If no one claim about such vehicle up to 7 days than it will be handed over to railway administration for further proceedings. 7. If feasible, a separate parking space should be earmarked for railway employees. TENDERING 1. NSG1 to NSG6 & SG1 to SG3 categories ---- through single packet for three years. 2. If there is no response to above , than it can be carried out on quotation basis for maximum 6 months. 97 3. The process of fresh tendering should be initiated six months before the expiry of the existing contract. EXTENSION OF THE CONTRACT 1. Normally extension of contract period should be avoided by proper advance planning. 2. In unavoidable circumstances , it can be extended up to three months ( maximum 6 months). TAX LIABILITY 1. The licensee shall be responsible for all taxes. TYPES OF PARKING CONTRACTS 1. Premium parking--- For NSG1 to NSG3 category stations. 2. PCCV ( Passenger Carrying Commercial Vehicles like four wheelers, tempos, mini buses , buses. 3. Ambulance services- Free service. 4. Prepaid auto/Taxi booth—approved by DRM by getting the NOC from RTO. 5. Call Taxi/radio taxi—for up to 10 vehicles by approval of DRM. OTHER CONDITIONS 1. The licensee should not use allotted parking space for any other purposes. 2. Licensee is having rights to ask the customer for identity card/essential papers. 98
