Exigent Circumstances
- Entry into private premises without consent or warrant is permissible under exigent circumstances
- Exigent circumstances include:
- Consent from homeowner
- Valid search warrant
- A prior complaint
- Seriousness of underlying offense is a factor in determining exigent circumstances (Welsh v. Wisconsin, 1985)
- Hot pursuit of a fleeing felon warrants entry without warrant. Entry must be in the presence of the felony.
- Probable cause is required when entering a residence without a warrant, in hot pursuit of a fleeing felon
Entering a Residence Without a Warrant
- For a misdemeanor arrest, an officer should generally obtain a warrant to enter a residence (exception is hot pursuit).
- Officer may enter without a warrant in hot pursuit to:

- Prevent imminent violence or escape
