What is a Terms of Reference (ToR)?

  • ToR for ESIA describes the purpose and objectives of a project Environmental & Social Impact Assessment (ESIA).
  • Prepared by the Environmental and Social Safeguards Officer.
  • ToR covers Background, objectives, components, relevant ESSs, project description, scope, strategy, schedule, EIA process, deliverables, timelines, reporting, and outline for ESIA or ESMP contents.

Contents of the ToR

  • Background and objectives of the ESIA.
  • Summary description of the main project features (location map, project layout diagram).
  • Relevance of the project.
  • Institutional and legal framework (summary of applicable ESSs, environmental and social screening, scoping).
  • Analysis of project alternatives.

Principal Activities: A Description of the Project

  • Detailed description of the project (environmental and social issues, risks, health & safety aspects).
  • Analysis of project alternatives considered (justification, environmental and social foundations).
  • Description of the project location & sensitive environmental and social features (map).
  • Description of associated facilities, locations, relations to the project, and potential risks & impacts.
  • Components and subcomponents (facilities, equipment, technologies, schedule, raw materials, activities, supply chain).
  • Description of project beneficiaries (socio-economic characterization, population size, urbanization).
  • Project cost details (components, sources of financing, government/proponent contribution).

Relevance of the Project

Objective of the Consultancy

Analysis of Project Alternatives

  • Systematically compare feasible alternatives to the proposed project.
  • Assess the feasibility of mitigating environmental and social impacts.
  • Consider capital and recurrent costs of alternative mitigation measures.
  • Determine institutional training and monitoring requirements.
  • Quantify environmental and social impacts (economic values where feasible).
  • Justify the selected alternative.

Measurements of Baseline Data

  • Collect data at different locations around the project and associated facilities.
  • Outdoor air quality parameters: particulate matter, NOx, SOx, CO, CO2, noise, odor, ozone (winter/summer).
  • Water quality parameters: PH, H2O, DBO 5, DCO, suspended solids, coliform.
  • Compare data with WHO and national standards (highest standards if gaps are noted).

Analysis of the Environment and Social Impacts

  • Develop a methodology for evaluating impact severity.
  • Assess and rate potential environmental and social risks and impacts of the project (long-term vs. short-term, reversible vs. irreversible).
  • Analyze impacts during project cycle phases (preparation, operation, maintenance).
  • Identify and assess project significance in relation to health, safety, environmental impact, extent, intensity and sensitivity.
  • Consider cumulative impacts (positive/negative, direct/indirect/induced, and transboundary).
  • Assess global environmental, social impacts (greenhouse gas emissions, ozone depletion, biodiversity loss, desertification, cultural loss).

Summary of Impacts

  • Impacts should be assessed across project preconstruction, construction, operation, and decommissioning phases.
  • A matrix ranging from --- to + + + should indicate the magnitude of each impact.

The Environment and Social Management Plan (ESMP):

  • Detailed description of all relevant proposed environmental and social control, monitoring and mitigation measures (activities, construction, operations, packing etc).
  • Identify detailed mitigation measures.
  • Define time schedules for each component, responsibilities, and costs.

Mitigation Measures for ESS 1

  • Table detailing project activities, potential impacts, proposed measures, institutional responsibilities and cost estimates for each phase of the project.

Additional Plans for Triggered ESSs

  • Details of the plans to be prepared according to the different headings (e.g., Labor, Resources, Biodiversity, Indigenous Communities etc)

ESMP: Monitoring Measures

  • Key conditions monitored, criteria, reasons for monitoring.
  • Monitoring locations (air emissions, waste water, hazardous waste, odour, noise, dust).
  • Define laboratory/institutions responsible for monitoring.
  • Cost of the monitoring process.
  • Actions to be undertaken for noncompliance issues or abnormalities and complaints.
  • Detailed table summarizing monitoring measures.
