Railway Services (Conduct) Rules, 1966

  • Short Title: Railway Services (Conduct) Rules 1966
  • Effective Date: Immediately upon enactment
  • Definitions:
    • Government :
      • For gazetted officers in the Railway Board, it's the President.
      • For other gazetted officers, it's the Railway Board.
      • For non-gazetted officers in the Railway Board, it's the Secretary.
      • For non-gazetted officers under administrative control of the Railway Board, it's the heads of concerned offices.
      • For other non-gazetted railway servants, it's the General Managers of the Railway Administrations.
      • For non-gazetted railway servants, regarding sub-rules (2) and (3) of rule 5, sub-rule (i) of rule 8, sub-rule (i) of rule 10, rule 12, rule 14, sub-rules (1) of rule 15, sub-rule (3) of rule 16, sub-rule (1) of rule 19 and rule 21, Government is the Railway Board.
    • Railway servant: A member of a service under administrative control of the Railway Board, including those temporarily lent. Excludes persons not under administrative control of the Railway Board. Includes persons whose salary is drawn from a source other than the Consolidated Fund of India.
    • Means of family: Includes wife or husband of the railway servant, whether residing with the servant or not, but excludes if separated by court order. Includes son/daughter and step-children wholly dependent on the servant. Includes other relatives by blood or marriage, wholly dependent on the servant.

General

  • Integrity: Maintain absolute integrity at all times.
  • Devotion to Duty: Maintain devotion to duty.
  • Conduct: Act appropriately, avoiding conduct unbecoming of a railway servant.
  • Upholding Constitution & Values: Uphold the supremacy of the Constitution and democratic values, defending India's sovereignty, security, and morality.
  • High Ethical Standards: Maintain high ethical standards, honesty, impartiality, and fairness in duty.
  • Political Neutrality: Maintain political neutrality.
  • Accountability & Transparency: Ensure accountability and transparency in duties.
  • Responsiveness to Public: Be responsive to the public, particularly the weaker sections.
  • Courtesy & Good Behaviour: Maintain courtesy and good behavior with the public.
  • Efficient Public Use: Make efficient use of public resources.
  • Protect Public Interest: Resolve conflicts in a way that protects the public interest.
  • Avoid Financial Obligations: Avoid any financial or other obligations that may influence official duties.
  • Decisions Based on Merit: Make choices, decisions, and recommendations based on merit.
  • Fairness & Impartiality: Act with fairness and impartiality, not discriminating against anyone, especially the poor and underprivileged.
  • Compliance with Laws: Adhere to all laws, rules, regulations, and established practices.
  • Discipline & Confidentiality: Maintain discipline in performing duties, respecting confidentiality, and following lawful instructions.

Employment of Near Relatives

  • Restrictions: No railway servant shall use their position to secure employment for family members in companies or firms with official dealings with the government.
  • Exceptions: Exceptions may be made with prior government approval if the employment cannot be delayed or is urgent.

Political Involvement

  • Restrictions: No participation in political parties, organizations, or movements.
  • Family Involvement: Prevent family members from engaging in activities that are subversive of the government.
  • Elections: Prohibits canvassing, interfering, or influencing elections, including taking part in or assisting any political activity.

Evidence

  • Restrictions on Giving Evidence: No railway servant shall give evidence in any enquiry without prior government sanction, except in certain circumstances.
  • Restrictions on Criticism of Government: No critical statements about any current or recent government policies, or actions that could embarrass relations among governments, except when performing official duties.

Subscriptions and Contributions

  • Restrictions: No railway servant shall accept or solicit funds for any cause.

Gifts

  • Restrictions: Railway servants should not accept gifts exceeding specified amounts from certain parties without appropriate sanction.
  • Exceptions: Exceptions for gifts from near relatives, or small or occasional gifts, or gifts valued under certain thresholds.

Public Demonstrations

  • Restrictions: Avoid public demonstrations that could jeopardize the sovereignty or integrity of India.

Trade or Employment

  • Restrictions: No railway servant shall engage in any commercial activity or trade without government permission.

Insolvency

  • Responsibility: Railway servants are required to manage their finances to avoid habitual indebtedness, and to immediately report any proceedings instituted against them.

Alcohol and Drugs

  • Prohibition: Railway servants are prohibited from acting or appearing in public while under the influence of alcohol or drugs.

Miscellaneous

  • Accommodation: No subleasing or vacating of government accommodation without prior sanction.
  • Investments and Finances: No speculation or financial dealings with individuals or businesses, without government permission. Note restrictions on loans and borrowings, whether for personal/ family use or professional reasons.
