Legislative Department
- Bills originating in the House of Representatives: Appropriations, revenue, tariff, public debt, local application, and private bills
- Senate's role: Propose or concur with amendments
- Bill requirements: Embrace only one subject expressed in the title.
- Bill Passage: Three readings on separate days, printed copies distributed 3 days prior; no amendments allowed on final reading; yeas and nays recorded.
- Bill Veto: Presented to President, if vetoed, returned to originating house with objections, two-thirds vote in each house to override. President must communicate veto within 30 days or becomes law. Veto can be specific to item(s) in an appropriation bill.
Bill of Rights
- Due Process: No deprivation of life, liberty, or property without due process of law. All persons are entitled to equal protection of law.
- Search and Seizure: Unreasonable searches and seizures are prohibited, warrants required with probable cause and specific detail. Privacy of communication is inviolable except by lawful court order or for public safety. Evidence obtained illegally is inadmissible.
- Speech and Assembly: Freedom of speech, expression, the press, assembly, petitioning the government is protected.
- Religion: Freedom of religion and worship without discrimination is guaranteed. No religious test for civil rights.
- Abode and Travel: Liberty of abode and changing it is protected, except by court order. Travel rights are protected unless constrained by public safety, national security, or public health.
- Information on public matters: Citizens have a right to access government records and data related to government acts for policy development.
- Union organization and societies: Right for the people of both the public and private sectors to form unions, associations, or societies is protected.
- Private Property: Private property cannot be taken for public use without just compensation.
- Obligation of Contracts: No law impairing the obligation of contracts shall be passed.
- Free access to courts and legal assistance: Everyone has access to judicial process and legal assistance.
- Rights during investigations and trials: Individuals have a right to remain silent and a lawyer, no torture or coercion allowed during interrogation; inadmissible confessions. The accused is presumed innocent until proven guilty; right to be heard, informed of charges, speedy and public trial, confront witnesses, compel testimony.
- Bail: Right to bail unless charged with a major offense or substantial evidence of guilt. Bail cannot be excessive.
- Criminal offenses: No criminal offense without due process; accused have rights to legal representation, informed of charges, a trial and speedy disposition. The privilege of the writ of habeas corpus (except in invasion of rebellion when public safety requires it).
- Compelled testimony: No one is compelled to be a witness against themselves.
- Involuntary servitude: No involuntary servitude will be allowed except as punishment for a crime; Detention for specific reasons only, such as political beliefs, is forbidden.
- Excessive punishment and fines: Excessive punishments or fines are prohibited; the death penalty is permitted under certain circumstances but may be replaced by perpetual imprisonment depending on the crime.
- Imprisonment for debt: No imprisonment for debt; no imprisonment for non-payment of poll taxes.
- Jeopardy: No person shall be twice put in jeopardy for the same offense.
- Ex post facto laws/bills of attainder: These laws (those that retroactively penalize actions) are prohibited.
