Presidential Qualifications
- A person must be at least forty (40) years old on the day of the election.
- They must be a natural-born citizen of the Philippines.
- They must be a registered voter.
- Must be able to read and write.
- Must have been a resident of the Philippines for at least ten (10) years immediately preceding the election.
Presidential Powers
- The President has control over all executive departments, bureaus, and offices.
- The President ensures that laws are faithfully executed.
- The President is the Commander-in-Chief of the Armed Forces, and can call them out in times of emergency.
Presidential & Vice Presidential Term
- The President and Vice-President serve a six (6) year term.
- Their terms begin at noon on the 30th of June following the election year.
- The President is not eligible for re-election.
- The Vice-President can only serve two (2) consecutive terms.
Presidential Oath
- The President, Vice-President, or Acting President will take an oath before entering office.
- The oath states that they will faithfully and conscientiously fulfill their duties, preserve and defend the Constitution, execute the laws, do justice to every man, and consecrate themselves to the service of the nation.
Presidential Residence & Compensation
- The President has an official residence.
- The President's salary is determined by law and cannot be decreased during their tenure.
- The President does not receive any other emoluments from the government or other sources.
Acting President and Vacancies
- The Vice-President will act as President if the President-elect fails to qualify, isn't chosen, is momentarily unable to discharge their duties, death, permanent disability, removal from office, or resignation.
- If the Vice-President has to act as President, their term ends when the President qualifies, is chosen and qualified, or their disability ends.
- When a permanent vacancy occurs in the Office of the Vice-President, the President nominates a replacement from the Senate or House of Representatives.
- This nominee is subject to confirmation by a majority vote of all members of both Houses of Congress, voting separately.
Rules on Nepotism
- The President is prohibited from appointing their spouse and relatives within the fourth civil degree, up to first cousin, grandnephew, and grandniece during their tenure in office.
Appointments
- Appointments are extended by an Acting President and remain effective unless revoked by the elected President within ninety days of assuming office.
- Two months before presidential elections and up to the end of their term, the President is prohibited from making appointments, except for temporary appointments to executive positions when continued vacancies would harm public service or safety.
