Locate Person and Citation Request Policy
- The supervisor of the Originating Officer may delegate the duties of the Originating Officer to another officer within their Squad or Unit.
- A Locate Person Form (OPD Form 99) is used to:
- Detain a subject long enough to contact an Investigating Officer or the Information Channel about the purpose of the Locate Person.
- Obtain current information about a subject (e.g., address or vehicle description).
- Locate a subject who may be a witness to a crime or a person of interest in a crime.
- A Locate Person Form will not normally specify that a subject be arrested, except in limited circumstances where probable cause exists and an arrest warrant is being drafted.
Completing a Locate Person Form
- The Originating Officer shall complete the Locate Person Form (OPD Form 99) in its entirety, including:
- Specific instructions on what Contact Officers should do if the subject is located.
- The reason for locating the person.
- Any required reports (e.g., Supplementary Report, Information Report, or Field Observation Card).
- The Originating Officer will use the same RB number on the Locate Person Form that corresponds with the case they are working.
Review and Approval
- All Locate Person Forms will be reviewed and approved by a supervisor prior to dissemination.
- The supervisor shall also ensure an OPD Overnight Report is sent out in a timely manner with the completed Locate Person Form attached and any other additional pertinent information.
Data Review Squad
- The Data Review Squad will immediately enter and assign the data number and locate number to the Locate Person Form.
- The Locate Person Form will then be forwarded to NCIC for the item number to be assigned.
- The Data Review Squad will forward two copies of the Locate Person Form to CIB, keep one copy for their Locate Person file, and forward the forms on to the Records Squad who will scan the original OPD Form 99 into RMS, and file the original OPD Form 99 in the Records Section.
Contacting the Subject
- When Contact Officers locate the subject of a Locate Person Form, they shall:
- Notify the Information Channel, the Investigating Unit, or the Field Investigations “A” Shift Squad.
- Follow the directions of the Investigating Officer.
Citation Requests
- A Citation Request Form (OPD Form 99B) is used by Investigating Officers to locate a subject when probable cause exists to issue a misdemeanor citation and the subject is not on scene and/or cannot be reached.
- A Citation Request Form:
- Does not allow officers to enter a residence or to remove a subject from private property without the subject’s consent.
- Does not transmit or imply any use of force to detain the subject while information is being retrieved.
- Gives officers reasonable cause to detain a subject for long enough to contact the Investigating Officer or unit about the purpose of the Citation Request.
Canceling a Locate Person or Citation Request
- ONLY the Originating Officer or an officer designated by the supervisor of the Originating Officer shall complete a Felony Wanted/Locate Person/Citation Request Cancellation Form (OPD Form 208).
- The Originating Officer shall notify the Data Review Squad to cancel the Locate Person or Citation Request and ensure the cancellation is entered into NCIC.
