Policy
- Miami-Dade Corrections and Rehabilitation Department (MDCR) establishes a protocol to comply with state and county regulations regarding nepotism.
- MDCR hires, appoints, and promotes employees based on merit and fitness.
Definitions
- Nepotism: Showing favoritism toward relatives based on relationship, rather than ability.
- Relative: Individuals related to an employee (father, mother, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, husband, wife, etc. including step and half-relations).
Restrictions
Employment of Relatives
- MDCR prohibits appointing, employing, promoting, or advancing relatives of employees with authority to make such decisions.
- The prohibition applies to all personnel with such authority, including those who have delegated that authority.
- The limitation doesn't prevent relatives from working together in other roles but restricts the hiring, promotion, employment of relatives of specific personnel.
- Employees in specific managerial and supervisory positions (MDCR Director, Assistant Directors, Division Chiefs, Facility Bureau Commanders, Managers, Supervisors, etc.) cannot employ or promote relatives.
Supervision/Assignment of Relatives
- Employees cannot evaluate, discipline, or otherwise participate in employment actions involving relatives.
- Any direct supervision of relatives by an employee must be reported to the appropriate Division Chief.
Fraternization
- Employees should avoid non-platonic or dating relationships with subordinates where they have approval/disapproval or evaluation responsibilities.
Training
- Nepotism policy is included in MDCR training programs (e.g., New Employee Orientation, Executive Orientation, Supervisor Certification, and Ethics Awareness.
- MDCR provides policy and online resources.
Documentation
- Each employee signs a Nepotism Statement of Understanding.
- The statement is maintained in employee files.
