Study Notes
Anti-Nepotism Policy
- The policy aims to ensure employees' judgments and decisions are not influenced by family members or other relationships, and to prevent unqualified applicants from being hired or favored due to their relationship with an employee.
Definitions
- Employee: A person hired by BSO or in the service of another under contract with BSO.
- Family Member: A person related to an employee, including grandparents, parents, spouses, children, siblings, aunts, uncles, first cousins, nephews, nieces, in-laws, step-relations, and other family-type relationships.
- Other Relationship: A physical or romantic relationship that could interfere with BSO's operation.
- Supervise: A function that includes hiring, transferring, suspending, promoting, assigning, or evaluating other employees.
Policy Provisions
- Employees cannot appoint, employ, promote, advance, or advocate for appointment, employment, promotion, or advancement of their family members or other relationships.
- Employees cannot influence BSO to hire their family members or other relationships.
- Employees must advise their director of any family member or other relationship who is or may be assigned to their area.
- Employees cannot serve or be appointed, promoted, or transferred to a position where they would directly or indirectly supervise a family member or other relationship.
Conflicts of Interest
- Decisions involving appointments, promotions, or transfers cannot be made by employees whose family members or other relationships are under consideration.
- If a conflict of interest occurs, the involved decision-making employee must request the next employee in the chain of command to render the decision.
Employment Decisions
- Decisions cannot be entirely based on whether an employee has a family member or other relationship employed with BSO.
- BSO may refuse to hire or transfer employees or applicants if a family member or other relationship would directly or indirectly supervise them, unless it's in BSO's best interest.
Transfers and Reclassification
- Employees with family members or other relationships where an employee is working under the direct or indirect supervision of another family member or other relationship may be transferred and/or reclassified.
- Transfers and/or reclassification will occur within 30 days upon notification or when practical.
- Non-supervisory employees may be transferred and/or reclassified if a family member or other relationship is employed in the same area.
