Railway Servant (Hours of Employment) Rules
- Rules framed under Indian Railway Act, 1890
- Amended in 2005 as Railway Servants (Hours of Work and Period of Rest) Rules, 2005
- Determine and regulate worker hours, rest periods, overtime, etc.
- Applicable to all non-gazetted employees including casual labor and substitutes
- Excluded employees are governed by other acts (Factory Act, Mines Act, Minimum Wages Act, Merchant Shipping Act)
Classification of Services
- Employments (excluding excluded categories) are assumed as 'Continuous'
- Classified as 'Intensive' or 'Essentially Intermittent' based on job analysis
- Intensive: Strenuous, continuous concentration or manual labor with little/no break
- Examples: Section Controllers, Telephone/Wireless Operators
- Essentially Intermittent: Daily hours of duty (including inaction) aggregate 6 hours or more, with periods of at least 1 hour and 2 half hour periods of inaction.
- Examples: Waiting Room Bearers, Bungalow peons, Saloon Attendants, Safaiwalas, Gate Men, Care Takers.
- Excluded: Specific categories (confidential capacity, health/medical, armed guards, Railway Schools, Supervisory Staff)
- These staff have no limitations on hours of employment
- Examples: Confidential Staff, Stenos, Matrons, Sister-in-Charge, Family Planning Field Workers, Projectionists
- Continuous: Staff not categorized as Intensive or Essentially Intermittent
- Examples: ASMs, Drivers, Guards, TTEs, Non-supervisory clerks, Typists
Fixation of Hours of Work
- Hours of work can be continuous, have short intervals for rest, or breaks due to service exigencies
- Railway Administration determines and fixes normal rostered hours for different categories
- Standard hours of duty, additional hours (if prescribed), and preparatory/complementary work time
- Categories of workers and their respective hours are defined (Intensive, Continuous, Essentially Intermittent)
