Relationship between IHRL and IHL
- IHRL primarily governs the relationship between states and individuals, protecting individuals' claims against the government.
- IHL regulates conduct during armed hostilities between conflicting parties.
- Historically, IHRL only applied in peacetime, but its application in armed conflicts is now established.
- Some rights are governed by IHL (e.g., conduct of hostilities, treatment of wounded), while others are governed by IHRL (e.g., freedom of the press, right to vote).
- Both IHRL and IHL prohibit torture.
- The applicability of IHRL in armed conflicts has been debated. The ICJ's advisory opinion on the legality of the use of nuclear weapons stated that IHRL doesn't cease to apply in armed conflicts.
- While some rights (like the right to life) can be derogated in times of conflict, the "arbitrariness" in depriving people of life must be evaluated in the context of IHL.
- The text discusses application of IHRL in relation to occupation by military forces
Additional Points
- European Court of Human Rights (ECtHR) has asserted state obligations under the European Convention on Human Rights (ECHR) in armed conflicts (e.g., Al-Skeini case).
- The ICJ's advisory opinion on the construction of a wall in the occupied Palestinian territory highlighted the complex relationship between IHL and IHRL. The court found violations of the right to work, the right to health, the right to education, and the right to a basic standard of living.
- The relationship between IHRL and IHL can be further clarified within the context of specific armed conflicts or situations.
- The appropriate application of laws and instruments (like the ICCPR and CRC ) are essential for resolving cases during conflicts.
