Consent
- Patients have the right to make decisions about their care, even if they differ from their healthcare providers' recommendations.
- Informed consent requires the patient to be competent, receive full disclosure, understand the disclosure, act voluntarily, and consent to the proposed action.
- Informed consent must be related to a treatment, procedure, or care plan, be informed, be voluntary, and reflect the patient's choice.
- Only the most responsible healthcare practitioner can obtain informed consent.
- To consent, patients must be capable of understanding and appreciating the nature of the treatment.
- In emergencies, individuals can be treated without consent if they are experiencing severe suffering or are at risk of serious bodily harm.
Health Care Consent Act, 1996 (HCCA)
- The HCCA provides rules for determining capacity in three areas: treatment decisions, admission to care facilities, and personal assistance services.
- The HCCA sets out rules for obtaining informed, voluntary consent from the patient or their substitute decision maker (SDM) and provides for the review of incapacity findings by a provincial administrative tribunal.
Mental Health Act Forms
- Form 2 (Order for Examination): Filled out by a Justice of the Peace based on information from others, allowing police to apprehend a person for psychiatric assessment.
- Form 3 (Certificate of Involuntary Admission) : Admits a patient involuntarily for up to 2 weeks, the patient cannot leave.
- Form 4 (Certificate of Renewal): Issued when a patient continues to meet criteria for involuntary admission after Form 3 expires. It can be renewed up to three times with increasing duration.
- Form 4A (Certificate of Continuation): Replaces the fourth certificate of renewal and allows for up to 3 additional months of involuntary admission.
Personal Health Information Protection Act (PHIPA)
- PHIPA sets out rules for the collection, use, and disclosure of personal health information, applying to all health information custodians in Ontario.
- PHIPA governs the manner in which personal health information is handled within the health sector.
Disclosing Personal Health Information Without Consent
- PHIPA permits disclosing personal health information without consent:
- For managing risk, supporting quality of care programs, allocating resources, obtaining payment, and conducting approved research.
- When disclosure is needed to provide healthcare and consent cannot be obtained promptly.
- To contact a relative/friend of an injured, incapacitated, or ill client for consent.
- To confirm that a client is a resident of the facility.
- To provide general health status of a client (unless otherwise indicated).
- To eliminate or reduce a significant risk of harm to a person.
PHIPA: Privacy Breach
- A privacy breach occurs when personal health information is lost, stolen, accessed, disclosed, or disposed of inappropriately.
- Steps to take in case of a privacy breach:
- Immediately report the breach.
- Investigate the cause of the breach and take steps to prevent it from happening again.
- Notify the individuals whose privacy was breached.
- Notify the Information and Privacy Commissioner Office of Ontario.
PHIPA: Preventing Privacy Breaches

- Creating policies to clearly limit access to and protect personal health information.
- Providing privacy training sessions.
