Uncontrolled trade refers to the sale of Nestlé products in a market by a non-Nestlé company without Nestlé's permission.
If a non-Nestlé company sells Nestlé products in your market that you didn't import, take the following actions:
- Ensure the non-Nestlé company has Nestlé's permission.
- If not, evaluate the situation in your market's Issue Round Table (IRT).
- Make a business decision based on the evaluation.
To prevent uncontrolled trade, Nestlé, the company, or both must ensure products comply with local law.
Permission can be granted through:
- An import-export contract with a Nestlé market.
- A contract with Nestrade or NITR.
- A sales contract with a Nestlé market as a third-party distributor.
If the company doesn't have permission, you may consider:
- Tell the trader and agree on a solution.
- Tell the authorities.
- Ask Nestrade or NITR to import the products.
- Escalate.
- Inform the Nestlé Zone or Corporate.
