Clearwater Fire & Rescue Department Standard Department Policy: Conduct and Behavior
- Policy Objective: To maintain a professional, respectful, and safe workplace free of offensive, inappropriate, or harassing conduct.
- Scope: Applies to all Clearwater Fire & Rescue employees.
- Effective Date: 06/20/2002
- Revision Date: 05/13/2020

Unacceptable Conduct
- Definition: Any action viewed negatively or offensively by co-workers, other city employees, or the public.
- Prohibited Behaviors:
- Interference with unit readiness/responsiveness to emergencies.
- Damage to departmental or personal equipment.
- Injury to personnel.
- Compromising safety of individuals or equipment.
- Compromising any persons, co-workers, equipment, or public perception.
Sexual Misconduct

Definition: Any sexual contact or activity that occurs while on duty, stems from official duty, occurs on department property or in a fire department apparatus or vehicle, or occurs while in uniform.

Examples of Prohibited Behaviors:
- Sexual contact or activity of any nature while on duty or in an official capacity.
- Contact or activity on fire department property, in uniform, or in a fire department vehicle, even off-duty.
- Sexual contact or activity while in uniform, even off duty, if the uniform is identifiable as a member of the department.

Actor: The person accused of sexual assault or making sexual contact.

Sexual Contact: Any physical contact with intimate areas intended for sexual gratification.

Reporting Requirements
- Reporting Obligation: Any employee witnessing a policy violation is obligated to report it to their supervisor, who must immediately involve the chain of command, including the Fire Chief, for investigation.
- Supervisor's Role: Supervisors cannot resolve sexual misconduct complaints directly with the complainant.
Discipline
- Consequences: Employees violating this policy could face discipline up to and including termination, including possible criminal charges.
- Failure to Report: Employees who fail to report a known violation face the same potential disciplinary action as the perpetrator.
- Supervisory Violations: If a supervisory employee is involved, a report should be made to an appropriate command level officer, bypassing the normal chain of command if necessary.
