**MODULE 3** **Subject: Crim Prof 212-Law Enforcement Organization and Administration** **1. Title of the Module** **Chapter 3. Philippine National Police Personnel Management** **2. Introduction** This chapter presents the comprehensive, integrated system for effectively managing the PNP personnel in order to achieve an organizational goal. This covers various schemes that PNP personnel may encounter from hiring to retiring. It also includes how the organization utilizes its resources in the process of recruiting, selecting and evaluating police performance, professionalization and other human matters in the police organization. **3. Learning Content** **PNP STANDARD POLICY ON SELECTION AND APPOINTMENT** No person shall be appointed as uniformed member of PNP unless he or she possesses the following minimum qualifications: A citizen of the Philippines; A person of good moral conduct; Must have passed the psychiatric, drug and physical tests to be administered by the PNP or by Government hospital accredited by the NAPOLCOM for the purpose of determining physical and mental health; Must possess a formal baccalaureate degree form a recognized institution for learning; Must be eligible in accordance with the standards set by the commission (entrance exam and Civil service Exam); Must not have been dishonorably discharged from military employment or dismissed for cause from any civilian position in the government; Must not have been convicted by final judgment of an offense/crime involving moral turpitude; Height requirement -- 5'4" (1.62m) for male and 5'2" (1.57m) for females or 5'2" for males and 5'0" for females under the waiver program; ***(RA 11549)*** Weight requirement -- must not be more or less 5 kilograms of the standard weight corresponding to his/her height, age and sex; 10\. Age requirement -- for new applicants, must not be less than **21 years of age** at the time of application or more than **30 years of age**. **POLICE APPOINTMENT** A New applicant maybe appointed as: 1. Temporary -- If the applicant passes through the **waiver program** 2. Probationary -- If the applicant passes through the regular screening procedures 3. Permanent -- If the applicant able **to finish the required field training program for permanency.** **Appointment shall be effected by:** 1. Patrolman/Patrolwoman to Police Executive Master Sergeant 2. Police Lieutenant to Police Lieutenant Colonel 3. Police Colonel to Police Lieutenant General 4. Police General **PNP TRAINING PROGRAMS** 1. Basic Recruit Training (6 months) - The most basic of all police training which a pre-requisite to permanent appointment is. It is conducted to insure uniformity in the standard of instruction and course contents. - This course shall not be less than 6 months. A training week shall normally consist of 40 hours of scheduled instructions. 2. The PNP Field Training (6 months) - Is the process by which an individual police officer who is recruited into the service receives formal instruction on the job for special and defined purposes and performs actual job functions with periodic appraisal on his performance and progress. - Under RA 8551, all uniformed members of the PNP shall undergo field training program involving actual experience and assignment in patrol, traffic and investigation as a requirement for permanency of their appointment. The program shall be for 12 months inclusive of the Basic Recruit Training Course for non-officers and the Officer Orientation Course or Officer Basic Course for officers. 3. The In-Service Training Program (Supervisory, Leadership, Management) a. Junior Leadership Training: Patrolman -- Staff Sergeant b. Senior Leadership Training: Master Sergeant -- Executive Master Sergeant c. Police Basic Course (PBC): Prep for (OBC) -- Master Sergeants d. Officers Basic Course (OBC): Lieutenant-Major e. Officers Advance Course (OAC): Major -- Colonel f. Officer Senior Education Course -- Colonel & above g. Directorial Staff Course -- General **PROMOTION SYSTEM IN THE PNP** - *Promotion* is a system of increasing the rank of member of the police service. The promotion shall be gender fair, which means women in the PNP, shall enjoy equal opportunity for promotion as that of men. - Under the law, the NAPOLCOM shall establish a system of promotion for uniformed and non-uniformed members of the PNP, which shall be based on: Merit -- includes length of service in the present rank and qualifications Seniority -- least consideration in promotion Availability of vacant position **Preference for Promotion** Appropriate Eligibility Competency and Vacancy Seniority Regular Promotion Promotion by Virtue of Exhibited Acts (Special Promotion) **Promotion by Virtue of Position** - Any PNP member designated to any key position whose rank is lower than which is required for such position shall, after 6 months of occupying the same, be entitled to a promotion, subject to the availability of vacant positions. Provided, that the member shall not be reassigned to a position calling for a higher rank until after two years form the date of such promotion. Provided further, that any member designated to the position who does not possess the established minimum qualifications thereof shall occupy the same for not more than 6 months without extension. **B. SPECIAL PROMOTION** - promotion granted to police officers who have exhibited acts of conspicuous courage and gallantry at the risk of his/her life above and beyond the call of duty. **Conspicuous courage** is a courage that is clearly distinguished above others in the performance of one\'s duty PERMANENT PHYSICAL DISABILITY Total Permanent Physical Disability (TPPD) refers to any impairment of the body which renders PNP member indefinitely incapable of substantially performing the mandated duties and functions of his positions. Entitled to **ONE YEAR\'S SALARY** and to lifetime pension equivalent **to EIGHTY PERCENT (80%)** of his last salary, in addition to other benefits as provided under existing laws **Retirement or Separation** ›Any personnel who is dismissed shall be RETIRED if he or she has rendered at least twenty **(20) years of service**; and **SEPARATED** if he or she has rendered **less than twenty (20) years** of service unless the personnel is disqualified by law to receive such benefits. **Kinds of retirement:** 1\. **Compulsory Retirement** - when a PNP uniformed personnel reaches the age of 56 years old. 2\. Optional Retirement - under sec. 40 of R.A. 6975 an officer or a non-officer may **optionally retire provided he has rendered 20 years** of satisfactory service with the approval of the Napolcom. **Lateral Entry** -- Initial rank for: 1. PNPA graduate -- Lieutenant 2. Criminologists, nurses, dentists, engineers, forensic sciences -- Lieutenant 3. Doctor of Medicine, Lawyers and Chaplains - Police Captain **PNP ATTRITION SYSTEM** Attrition by Attainment of Maximum tenure of PNP members holding key positions as prescribed herein: Position Maximum Tenure PNP Chief 4 Years PNP Dep. Director 4 Years Director for Staff Service 4 Years Regional Directors 6 Years Provincial/City Director 9 Years **Attrition by Relief** -- A PNP uniformed personnel who has been relieved for just cause and has not been given an assignment within 2 years after such relief shall be retired or separated. **Attrition by Demotion in Position or Rank** - Any PNP personnel, civilian or uniformed, who is relieved and assigned to a position lower than what is established for his or her grade in the PNP Staffing Pattern and who shall not be assigned to a position commensurate to his or her grade **within 18 months after such demotion in position** shall be **retired or separated.** **Attrition by Non-promotion** -- Any PNP personnel who has not been promoted for a continuous period of 10 years shall be retired or separated. **Attrition by other means** -- A PNP member or officer with at least 5 years of accumulated active service shall be separated based on any of the following factors: ***Inefficiency based on poor performance during the last 2 consecutive annual rating periods***; Inefficiency based on poor performance for 3 cumulative annual rating periods; **Physical and/or mental incapacity to** perform police functions and duties; **Failure to pass the required entrance examinations** twice and/or finish the required career courses except for justifiable reasons. Any personnel of the PNP who is dismissed pursuant to attrition shall be **retired if he or she has rendered at least 20 years** of service and separated if he or she has rendered less than 20 years unless the personnel is disqualified by law to receive such benefits. **PNP BENEFITS AND PRIVILEGES** The uniformed members of the PNP are considered employees of the National Government and draw their salaries there from. PNP member assigned in Metropolitan Manila, Chartered Cities and first class municipalities may be paid financial incentives by the local government unit concerned subject to the availability of funds. **Benefits and Privileges** **Incentives and Awards** -- The DILG shall promulgate standards on incentives and award system in the PNP administered by the Board of Incentives and Awards. Awards may be in the form of decorations, service medals and citation badges or in monetary considerations. Authorized decorations are: **Police Medal of Valor** -- **Highest medal** Police Medal of Merit Wounded Police Medal Police Efficiency Medal Police Service Medal Police Unit Citation badge **Posthumous Award --** in case an individual who distinguish himself dies before the granting of the awards. Health and Welfare Longevity Pay and Allowances -- Under RA 6975, PNP personnel are entitled to longevity pay of 10% of their basic monthly salaries for every five years of service but the totality of such longevity pay does not exceed 50% of the basic pay. However, they also continue to enjoy the: Subsistence allowance Quarter allowance Clothing allowance Cost of living allowance Hazard pay Others **Example:** **Patrolman Di-MAGIBA is 5 years in the service and his base pay is 27,000 pesos. How much his longevity pay?** LONGEVITY PAY A uniformed personnel of the PNP is entitled to a longevity pay OF TEN PERCENT (10%) of basic monthly salaries for every **FIVE (5) YEARS** of service, which is reckoned from the date of the personnel\'s original appointment in the AFP, or appointment in the police, fire jail or other allied services to the integration of the PC and the INP. The totality of such longevity pay **should not exceed FIFTY PERCENT (50%)** of the basic pay. It should also continue to enjoy the subsistence allowance, quarter\'s allowance, clothing allowance cost of living allowance, hazard pay, and all other allowances as provided by existing laws. Retirement Benefits -- There is a monthly retirement pay of 50% of the base pay and longevity pay of the retired grade in case of 20 years of active service, increasing by **2.5% for every year** of active service and rendered beyond 20 years to maximum of **90% for 36 years of service and over**. Payment of the retirement benefit in lump sum is made within 6 months from effectivity date of retirement and/or completion. Retirement pay of PNP members is subject of adjustment based on prevailing scale of base pay of Police personnel in the active service. Permanent Physical Disability -- A PNP member who is permanently and totally disabled as a result of injuries suffered or sickness contracted in the performance of duty as certified by the NAPOLCOM, upon finding and certification of a medical officer, that the extent of disability or sickness render such member unfit or unable to further perform the duties of his/her position, is entitled to a gratuity pay equivalent to a **one year salary** and to a lifetime pension equivalent **to 80% of his/her last salary**, in addition to other benefits as provided by existing laws. Early retirement Benefit -- A PNP member at his or her own request and with the approval of the NAPOLCOM, retire from the police service and he paid separation benefits corresponding to a position 2 ranks higher than his/her present rank, whether temporary or permanent subject to conditions. **DISCIPLINARY MECHANISM** A. Personnel Discipline in the PNP - Refers to the extent of field of learning, training and conditioning of the police obedience and self-control subject to systems of rules of behaviors in the police service. It is how police personnel cope with the do's and don'ts within the police organization. Imposable penalties in Administrative Cases in the PNP Withholding of privileges Restriction to specified limits Suspension Forfeiture of Salary Reprimand or Admonition Restrictive Custody Dismissal from service B. Administrative Offenses that may be imposed against a PNP member **Neglect of Duty or Nonfeasance** -- it is the omission or refusal, without the sufficient excuse, to perform an act or duty, which it was the peace officer's legal obligation to perform; it implies a duty as well as its breach and the fast can never be found in the absence of duty. **Irregularities in the performance of duty / Misfeasance** -- it is the improper performance of some act, which might lawfully be done. **Misconduct or malfeasance** -- It is the doing, either through ignorance, inattention or malice, of that which the officer had no legal right to do it at all, as where he acts without any authority whatsoever, or exceeds, ignores or abuses his powers. **Incompetency** -- It is the manifest lack of adequate ability and fitness for the satisfactory performance of police duties. This has reference to any physical, moral or intellectual quality the lack of which substantially incapacities one to perform the duties of police officers. **Oppression** -- It imports an act of cruelty, severity, unlawful exaction, domination, or excessive use of authority. The exercise of unlawful powers or other means, in depriving an individual of his liberty or property against his will, is generally an act of oppression. **Dishonesty** -- It is the concealment or distortion of truth in a matter of fact relevant to one's office, or connected with the performance of his duties. **Disloyalty to the Government** -- It consist of abandonment or renunciations of one's loyalty to the Government of the Philippines, or advocating the overthrow of the government. **Violation of Law** -- this presupposes conviction in court of any crime or offense penalized under the Revised Penal Code or any special law or ordinance **NATURE OF COMPLAINT AGAINST PNP MEMBERS** **Citizen's Complaint** -- Any complaint by a natural or juridical person against any PNP member shall be brought before the following: **Chiefs of Police** -- where the offense is punishable by withholding of privileges, restriction to specified limits, suspension or forfeiture of salary, or any combination thereof, for a period **not exceeding 15 days;** **Mayors of cities and municipalities** -- where the offense is punishable by withholding of privileges, restriction to specified limits, suspension or forfeiture of salary, or any combination thereof, **for a period of not less than 16 days but not exceeding 30 days;** **People's Law Enforcement Board (PLEB**) - where the offense is punishable by withholding of privileges, restriction to specified limits, suspension or forfeiture of salary, or any combination thereof, for a period **exceeding 30 days or dismissal.** **Breach of Internal Discipline** -- refers to any offense committed by a PNP member affecting order and discipline within the police organization. Chiefs of Police or equivalent supervisor may summarily impose the administrative penalties in all cases provided that it does not exceed 15 days. Provincial Director or equivalent supervisor may summarily impose the administrative penalties in all cases provided that it does not exceed 30 days. The Regional Director or equivalent supervisor may summarily impose the administrative penalties in all cases provided that it does not exceed 60 days. The Chief PNP or equivalent supervisor may summarily impose the administrative penalty of dismissal from service. He may also impose the penalty of admonition or reprimand, restrictive custody, withholding of privileges, suspension or forfeiture of salary, demotion, or any combination thereof for a period not exceeding 180 days. A "minor offense" shall refer to any act or omission not involving moral turpitude, but affecting internal discipline which include but not limited to the following a\. Simple misconduct or negligence b\. Insubordination c\. Frequent absences or tardiness d\. Habitual Drunkenness e\. Gambling prohibited by law. **SUMMARY DISMISSAL POWERS** NAPOLCOM PNP Chief PNP Regional Director **"NCR"** - When the charge is serious and evidence of guilt is strong. - When the respondent is a recidivist or is repeatedly charged and there are reasonable grounds to believe that he is guilty of the charges - when the respondent is guilty of a serious offense involving conduct unbecoming a police officer **ABSENCE WITHOUT OFFICIAL LEAVE (AWOL) AS A GROUND FOR SUMMARY DISMISSAL** AWOL refers to the status of any PNP member who absent himself without approved leave of absence and encompasses but not limited to the following: Absence from place of work or assignment without approved vacation leave. Failure to report for duty after the expiration of the approved leave of absence Failure to give notice to his immediate superior officer of his mobility to work on account of sickness or injury Failure to file appropriate application for sick leave Abandonment of work or assignment without prior approval of superior officer Failure to report to his new assignment within 3 days of receipt of the order of assignment or for reporting to a unit where he is officially assigned. **OTHER BUREAUS** **Bureau of Fire Protection (BFP)** Powers and Functions The Fire Bureau shall be responsible for the prevention and suppression of all destructive fires on buildings, houses and other structures, forest, land transportation vehicles and equipment, ships or vessels docked at piers or wharves or anchored in major seaports, petroleum industry installations, plane crashes and other similar incidents, as well as the enforcement of the Fire Code and other related laws. Key Positions The head of the Fire Bureau with the rank of Fire Director shall have the position title of Chief of the Fire Bureau. He shall be assisted by two deputy chiefs one for Administration and one for Operations as well as a Chief of the Directorial Staff all with the rank of Chief Superintendent. Philippine Public Safety College Creation There is hereby created the Philippine Public Safety College **(PPSC),** which shall be the premier educational institution for the training, human resource development and continuing education of all personnel of the PNP, Fire and Jail Bureaus. Composition The College shall consist of the present Philippine National Police Academy (PNPA) established pursuant to Section 13 of Presidential Decree No. 1184, the Fire Service Training Center, the Philippine National Training Center (PNTC), the National Police College, and other special training centers as may be created by the Department. Other Bureaus Bureau of Jail Management and Penology (BJMP) Powers and Functions The Jail Bureau shall exercise supervision and control over all city, municipal and district jails. The provincial jails shall be supervised and controlled by the provincial government within its jurisdiction. Key Positions The head of the Jail Bureau with the rank of Jail Director shall have the position title of Chief of Jail Bureau. He shall be assisted by two deputy chiefs one for Administration and one for Operations as well as a Chief of the Directorial Staff all with the rank of Chief Superintendent. The DILG shall consist of the DEPARTMENT PROPER, the NAPOLCOM, the PPSC, and the following bureaus: PNP, BFP and the BJMP. The department proper consist of the office of the Secretary, 2 Undersecretaries (1 for Local Government and 1 for Peace and Order and 3 Assistant Secretaries. **Related Laws** **Article XVI Section 6** of the Philippine Constitution provides that the state shall establish and maintain one police force, (pnp) which shall be national in scope and civilian in character to be administered and controlled by the NAPOLCOM, the authority of Local executives over the police units in their jurisdiction shall be provided for by law. (most relevant laws) **PARTICIPATION OF LOCAL GOVERNMENT EXECUTIVES IN THE ADMINISTRATION OF THE PNP (under R.A. 8551)** \"Employment\" refers to the utilization of units or elements of the PNP for purposes of protection of lives and properties, enforcement of laws, maintenance of peace and order, prevention of crimes, arrest of criminal offenders and bringing the offenders to justice, and ensuring public safety, particularly in the suppression of disorders, riots, lawlessness, violence, rebellious and seditious conspiracy, insurgency, subversion or other related activities. And power of deployment.- the power to move \[policemen from one place to another. \"Deployment\" shall mean the orderly and organized physical movement ofelements or units of the PNP within the province, city or municipality for purposes of employment as herein defined.\" Republic Act No. 4864 - Otherwise known as the \"Police Act of 1966\". An act creating the Police Commission, amending, and revising the laws relative to the Local Police System, and for other purposes. It created the NAPOLCOM as the agency mandated by the 1987 Constitution and the major police reform laws, RA\'s 6975 and 8551, to administer and control the PNP. (Approved August 08, 1966) In 1966, Congress enacted R.A. 4864 known as the \"POLICE ACT OF 1966\" to provide the foundation for the much needed police reforms in the country. POWERS AND FUCTION \-\--ADMINISTRATIVE CONTROL and OPERATIONAL SUPERVISION over PNP. Presidential Decree No. 765 - Otherwise known as the \"Police Integration Law\". The INP was composed of the PC as the nucleus, and the integrated police, jail, and fire forces as components. (Approved August 8,1975) Republic Act No. 9708 - An act extending for five (5) years the reglementary period for complying with the minimum educational qualification for appointment to the PNP and adjusting the promotion system thereof, amending for the purpose pertinent provisions of RA 6975 and RA 8551 and for other purposes. (Approved August 12, 2009) Republic Act No. 11200 - An act providing for the rank classification in the Philippine National Police, amending for the purpose section 28 of Republic Act No. 6975, as amended, otherwise known as the \"Department of the Interior and Local Government Act of 1990.\" (Approved February 8, 2019) Republic Act No. 11549 - An act lowering the minimum height requirement for applicants of the PHILIPPINE NATIONAL POLICE (PNP), BUREAU OF FIRE PROTECTION (BFP), BUREAU OF JAIL MANAGEMENT AND PENOLOGY (BJMP), and BUREAU OF CORRECTIONS (BUCOR), amending REPUBLIC ACT NO. 6975, as amended, REPUBLIC ACT NO. 9263, AND REPUBLIC ACT NO. 10575.
