ROWEL CENTENO GEE 2: Gender and Society General Education Department PSU-Urdaneta City Campus Policies Related to Gender International Policies… Universal Declaration of Human Rights – Article II: Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth or other status… Convention on the Elimination of all forms of Discrimination Against Women (CEDAW) (1979)- CEDAW is often described as an international bill of rights for women. Consisting of a preamble and 30 articles, it defines what constitutes discrimination against women and sets up an agenda. Convention on the Rights of the Child (CRC/UNCRC) (1989) - This United Nations convention and its optional protocols outline rights to be enjoyed without discrimination, including on the grounds of gender. The legal framework includes all fundamental human rights treaties with provisions confirming the principle of non-discrimination and equality between men and women, and boys and girls. Beijing Declaration and Platform for Action (1995) - Comprehensive commitments to women are called for under 12 critical areas of concern: poverty, education and training, health, violence against women, armed conflict, the economy, power and decision-making, institutional mechanisms, human rights, media, environment and the girl child 9 DR. ROWEL CENTENO GEE 2: Gender and Society General Education Department PSU-Urdaneta City Campus Policies Related to Gender National Policies… The 1987 Philippine Constitution - Among its salient provisions is Article II, Section 14 which provides that “the state recognizes the role of women in nation building and shall ensure the fundamental equality before the law of women and men.” Magna Carta of Women (Republic Act 9710) - The Magna Carta of Women (MCW) is a comprehensive women's human rights law that seeks to eliminate discrimination through the recognition, protection, fulfillment, and promotion of the rights of Filipino women, especially those belonging in the marginalized sectors of the society. Anti-Mail Order Bride Law (Republic Act 6955) – The law declares unlawful the matching of Filipino mail-order brides to foreigners. It penalizes the business of matching Filipino women for marriage to foreign nationals. Anti-Sexual Harassment Act of 1995 (Republic Act 7877) – The law makes incidents involving unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of sexual nature, made directly or indirectly in the employment, education or training environment unlawful. Anti-Rape Law of 1997 (Republic Act 8353) – The law reclassifies rape as a crime against persons, defining it as public rather than a private crime. It recognizes marital rape and questions the notion of 10 sexual obligation in marriage. DR. ROWEL CENTENO GEE 2: Gender and Society General Education Department PSU-Urdaneta City Campus Policies Related to Gender National Policies… Rape Victims Assistance and Protection Act of 1998 (Republic Act 8505) – The law provides assistance and protection to rape victims, establishes for the purpose a rape crisis center in every province and city and authorizes the appropriation of funds for the establishment and operation of the rape crisis center. Anti-Trafficking in Persons Act of 2003 (Republic Act 9208) – The law defines trafficking in person in terms of the acts, means and purposes of trafficking. The trafficked person is considered as a victim thus, she/he should be provided protection and support services by the State. Anti-Violence Against Women and Their Children Act of 2004 (Republic Act 9262) – The law defines violence against women and their children as a public crime. It provides for the security of the woman-complainant and her children through the availment of the barangay, temporary or permanent protection orders. Safe Spaces Act of 2018 (Republic Act 11313) - The Safe Spaces Act defines gender–based sexual harassment in streets, public spaces, online, workplaces, and educational and training institutions. The law penalizes all forms of sexual harassment in streets and public spaces, as well as in online spaces. 11 DR. Gender equality as the goal: To attain gender equality, there must be gender equity. As a tool to achieve gender equity, policies and programs must be gender-sensitive and responsive. SIDE NOTE: Covenantal Pluralism entails the obligation, the responsibility, and intentional pledge to engage, respect, and protect the other’s liberty of conscience, without necessarily lending moral equivalency to the other’s resulting beliefs and behavior.
