Study Notes

Labor and Working Conditions

  • Introduction:
    • ESS2 emphasizes the importance of job creation and income generation for poverty reduction and inclusive economic growth.
    • Borrowers should promote good worker-management relations and safe working conditions in projects.
  • Objectives:
    • Promote safety and health in the workplace.
    • Ensure fair treatment, non-discrimination, and equal opportunity for workers.
    • Protect vulnerable groups like women, persons with disabilities, children (of working age), and migrant workers.
    • Prevent forced and child labor.
    • Support freedom of association and collective bargaining.
    • Provide workers with methods for addressing workplace concerns.
  • Scope of Application:
    • ESS2's applicability is determined during the ESS1.2 environmental and social assessment.
    • "Project workers" include those directly employed by the borrower, through third parties related to project core functions, primary suppliers, and community labor.
    • ESS2 applies to all types of workers (full-time, part-time, temporary, seasonal, and migrant).
    • Government civil servants working on the project remain subject to their existing employment agreements unless transferred to the project. ESS2 doesn't apply except to them for specific provisions protecting the work force and occupational health and safety matters. Documentation of rights will be provided as needed. Third-parties' roles and responsibilities regarding workers should be clarified in procedures. Workers will be provided with details about relevant national laws, hours, wages, overtime, compensation, and benefits, and other rights. Clarification of the ways in which the ESS impacts different workers' categories is needed. Clear and understandable procedures and information are needed for workers.
    • Procedures should detail how ESS requirements apply to various worker types, including direct, contracted, community, and primary supply workers, considering specific categories and third-party responsibilities.
  • Working Conditions and Management of Worker Relationships:
    • Borrower will create written labor management procedures.
    • Procedures address worker management, complying with national law and ESS requirements.
    • Procedures will specify roles for different worker categories and management expectations of third parties.
    • Third parties will be held responsible for managing workers within procedures. Management and implementation of procedures will consider national law. Information and documentation should be clear and understandable to all workers.
  • Terms and Conditions of Employment:
    • Workers are to receive clearly written and understandable employment details.
    • Details will cover legal rights (including collective agreements), hours, wages, overtime, compensation, and benefits.
    • Payments are to be made regularly, complying with national law and labor procedures. Deductions from wages are allowed if legal and communicated to workers.
    • Adequate rest periods, holidays, and leave will be provided, complying with applicable regulations.
    • Workers will receive written notice and details of termination. Compensation will be provided in accordance with national laws. Project workers should have access to these procedures and policies. -Documentation and procedures about wages, overtime pay, compensation and benefits should be clear and understandable. The mechanisms to monitor and enforce the provision of these benefits also need to be documented.
  • Protecting the Workforce:
    • Child labor is prohibited and employment for children under the minimum age is prohibited. National law and ESS define appropriate employment ages for children.
    • Children aged 14 and above can be employed under strict conditions if appropriate, and these conditions should exclude hazardous work, including physically, psychologically, and sexually abusive work or exploitative conditions including work underground, underwater, at heights or in confined spaces, with dangerous machinery, equipment or tools, heavy labor or transport, in unhealthy environments, exposure to dangerous substances or agents, and dangerous temperatures, noise, or vibrations. Work that affects education, health, or development is prohibited.
    • Forced labor is prohibited. Unpaid work considered dangerous or in bad conditions is not allowed. There should be no involuntary or compelled labor (such as indentured or bonded). No trafficked persons may be employed. All workers are to be provided with safe conditions, and appropriate protection, including proper personal protective equipment
  • Grievance Mechanism:
    • A grievance mechanism will be provided in projects to handle workplace concerns from direct and contracted workers.
    • The mechanism should be proportionate to the project's risks and impacts.
    • Grievance process should be consistent with national law and accessible to workers, without fear of retribution.
    • The mechanism will not impede worker rights to judicial or administrative recourse (if applicable).
    • Appropriate procedures for making claims and resolving issues will be established. The grievance procedure will be documented, and all relevant details should be kept and accessible.
  • Occupational Health and Safety:
    • Implement occupational health and safety measures, adhering to relevant regulations.
    • Measures should consider hazards, preventive measures, worker training (on prevention and safety), accident and incident reporting (records), emergency preparedness, and remedies for unfavorable impacts.
    • Safe workplaces, machinery, equipment, and procedures are to be maintained by all parties involved. Workers and parties involved should consult with each other to establish and maintain safe work environments. Workers' needs are to be considered. Personal protective equipment will be provided to workers, without cost. First aid and emergency services should be readily available.
  • Contracted Workers:
    • Borrowers must ensure contracted workers are reliable entities.
    • The Borrower will establish procedures for managing and monitoring third party performance, ensuring they meet all ESS2 requirements.
    • Contracted workers will have access to a grievance mechanism. If third parties cannot provide grievance mechanisms, Borrowers must make the system in place per ESS2 available. Third parties are to include equivalent requirements and non-compliance remedies in contracts with subcontractors. These contractual agreements should be accessible.
  • Community Workers:
    • Projects can utilize community workers, but adherence to ESS2 depends on circumstances, activities, and risk.
    • The nature of the project and worker labor will be addressed in local laws and management procedures, ensuring work is voluntary and that all ESS risks are mitigated. Assessment of risks and impacts should be conducted. Labor is to be determined as voluntary.
  • Primary Supply Workers:
    • Assess risks related to child labor and forced labor in primary supply chains.
    • Borrower will require suppliers to maintain safe conditions, meet ESS2 requirements, and provide suitable grievance mechanisms. Borrowers will put in place procedures to ensure supply chains meet all requirements. Appropriate oversight and monitoring techniques will be adapted for supply chains. Workers should be provided with information about their rights, terms, and conditions. Appropriate grievance systems are required if suppliers are not directly responsible for this. Documentation and policies should be clear and readily accessible.
