Labor and Working Conditions

  • Fair Treatment: Ensure fair treatment, non-discrimination, and equal opportunity for all workers, including vulnerable groups (women, disabled, children, migrant workers).
  • Forced Labor Prevention: Prevent forced and child labor. This includes indentured, bonded, and any other forms of compulsory or involuntary labor. Trafficking of individuals is forbidden.
  • Freedom of Association: Support freedom of association and collective bargaining, following national law.
  • Accessible Grievance Mechanisms: Provide project workers with accessible means to address workplace concerns.

Scope of Application

  • ESS1.2: Applicability determined during environmental and social assessment (ESS1.2).
  • Project Workers: Applied depending on the nature of the employment relationship; encompasses directly employed workers, contracted workers, those engaged through third parties, primary suppliers, and community workers. Voluntary labor should be confirmed and documented. The Borrower should assess potential risks and impacts for community workers. Proportionate training is required to address specific needs and potential project risks. Grievance procedures, and monitoring of potential child labor or forced labor risks will be outlined in labor procedures.
  • Primary Supply Workers: Risks involving child labor, forced labor, and safety considerations need assessment and documentation at the beginning of agreements. Procedures should identify roles and responsibilities for monitoring. Supplier compliance to relevant ESS requirements should be addressed. Any risks need to be remedied and, if remediation is not possible, primary suppliers may be swapped with a more suitable one. Procedures for monitoring and assessing the performance of primary suppliers related to the ESS need to be implemented and documented.
  • Specific Groups: Measures of protection and assistance are required for vulnerable groups (women, people with disabilities, migrant workers, and children, where appropriate for the specific project phase/period). These measures, when required, must comply with national law.
  • Hazardous Work: Child labor and hazardous work is forbidden, for those under 18 in potentially hazardous conditions. This covers work that is likely to compromise the health, safety, or morals of children. Examples of hazardous work are provided in the text.

Requirements: Working Conditions and Management of Worker Relationships

  • Labor Management Procedures: Borrowers must develop and implement written labor management procedures, aligning with national law and ESS2 standards. Procedures need to outline the management of workers, including diverse categories of workers and how third parties manage their workers.
  • Terms and Conditions: Provide clear and understandable information about employment terms and conditions (rights, wages, benefits, working hours, etc.) including rights under national labor law and the application of ESS terms. Wages must be paid regularly, according to national law. Deductions allowed by law/labor procedures. Project workers are informed of all conditions and deductions.
  • Termination: Formal termination procedures, with appropriate severance notice/payment and details of social benefits (including details based on employment specifics, whether full, part-time, temporary, or contract-based) are needed. All wages, social security benefits, pension contributions, and other entitlements must be paid before termination. This complies with national laws and labor regulations.
  • Grievance Procedures: There should be access to a grievance mechanism separate from the general one required under ESS10, for direct workers and contracted workers, and for workers' organizations where relevant. Grievance procedures should be accessible, understandable, and free of retaliation. These procedures should be proportionate to the project size and scale and potential risks. Procedures can utilize existing mechanisms, but if modifications are needed, specific accommodations should be made.
  • Access to Resources: Facilities (canteens, hygiene, rest) appropriate to work conditions. If accommodation is provided, policies are to be in place for management and quality, for protecting and promoting the health and wellbeing of workers, and accommodating their physical, social and cultural needs. This includes access to canteens, hygiene facilities, and provisions for suitable areas for rest.
  • Collaboration: If workers are engaged by more than one party, those parties should collaborate on occupational safety and health requirements.

Requirements: Protecting the Work Force

  • Minimum Age: No employment of children under the nationally mandated minimum age, which is 14 unless national law dictates otherwise. Workers aged 18 and under must not be exposed to dangerous or hazardous work environments or work that negatively impacts their health/education/ development. This is compliant with national labor laws and international child labor standards. Risks need to be assessed and documented.
  • Occupational Health and Safety: Implement Occupational Health and Safety measures that include hazard identification, prevention, training, record keeping, and appropriate response mechanisms (accidents, illness, diseases). Ensure workplaces, equipment, and processes under their control are safe. Provide training on occupational safety and health, and issue of personal protective equipment without cost to the workers. Consultation with workers is required.

Grievance Mechanism

  • Accessible Procedures: Provide a grievance mechanism for all workers (direct, contracted, community) made accessible and understandable and without retaliation. These procedures must include detailed steps, timeframes, and consequences, and will be accessible in a language workers understand.
  • Proportionate to Risks: The grievance mechanism’s design should match the project’s scope and potential risks. It should adhere to national law and existing grievance processes.

Child Labor

  • Minimum Age/Restrictions: No employment or engagement of individuals younger than the nationally mandated minimum age. Restrictions on hazardous work for under 18-year-olds, and work that negatively impacts their development. This is compliant with national labor laws and international child labor standards. Specific measures of protection need to be in place for children. The documentation of risks should detail the specific hazards involved.

Forced Labor

  • Prohibition: Forced or compulsory labor (indentured, bonded, trafficked persons) is prohibited. All work must be freely performed. This complies with national labor laws and international standards. Clear guidelines must be in place and communicated to all involved parties about what constitutes forced labor.
