Union Material and Responsibilities
- If the Union President is unavailable, the Fire Chief or Duty Chief can remove Union materials and notify a Union Steward.
- Disputes over removed materials may result in a grievance process.
- The Union bears all costs for preparing and posting its materials and is responsible for maintaining an orderly bulletin board for approved postings.
Management Rights
- The City retains rights to manage its affairs unless explicitly modified by this Agreement.
- Actions by the City must comply with the Constitution, federal law, and state law, unless limited by this Agreement.
Hire-Back Bank Time
- A form is required to use Hire-Back Bank Time, allowing the City to deduct amounts from employee compensation if they separate from service before entitlement.
- Overages of hire-back time can be agreed upon as emergency duty trades with Shift Commander approval.
- Employees can request payment for overage costs due to extenuating circumstances from the Fire Chief or designee.
Compensatory Time Cash Out
- Employees can request to cash out portions of their Hire-Back bank electronically.
- The City will automatically cash out compensatory time exceeding 36 hours each year on December 31st, paid at the employee's current regular rate.
Indemnification
- The Union agrees to defend and indemnify the City against damages or penalties related to the use of Hire-Back Bank/Compensatory Time, ensuring compliance with the Fair Labor Standards Act.
Special Deployment Assignment
- Employees deployed for state mobilization will work a different schedule, including travel time but excluding unassigned or sleep time.
- Hours exceeding 49.9 in a seven-day period will be compensated at overtime or deployment policy rates, whichever is greater.
Emergency Holdover
- All personnel are subject to emergency holdover situations determined by the Fire Chief or designee.
- Efforts will be made to release personnel from holdover situations as expediently as possible.
Call Back Pay
- Employees called back for work outside normal hours will be compensated for hours worked, at a minimum for two hours, at the applicable pay rate.
- This provision does not apply to scheduled overtime.
No Pyramiding
- Employees cannot be compensated multiple times for the same hours under different provisions; they will receive the highest applicable compensation.
Compensatory Time Earned
- Employees may choose to bank hours earned through hire-back or compensatory time instead of receiving immediate monetary compensation.
