Study Notes
- As a substitute professional, you must keep a book of receipts and fill out a 2035 declaration.
- Your income is the retrocessions of fees that you receive from your holders.
- To help you with your accounting, you can use a software like Indy. Indy retrieves data from your business account and automatically classifies over 90% of transactions into the correct accounting category.
- If there is a dispute with a patient, who is responsible? The substitute physician is fully responsible for his or her medical acts and for any damage he or she may cause to patients. He is therefore obliged to take out professional liability insurance.
- Can I terminate the contract before its initial end? If the replacement contract is a fixed-term contract that should normally be completed, an early exit is still possible. Either by mutual agreement or by paying a penalty clause to the other party, i.e. a lump sum of money paid by the defaulting party.
- Is a non-competition clause possible? Yes, it is automatic for any replacement of more than three months for a period of two years. For any modification of the latter, the courts require that it be proportionate and limited in time and space. If the incumbent waives this clause or agrees to a shorter term, this must be clearly stated in the contract.
