- Guardian refers to a person who has qualified as a guardian of an elderly person under chapter 201 of the law and does not include a guardian ad litem.
- Protected person refers to an elderly person with a court appointed conservator or guardian, or under other protective orders.
- Protective services are services required to prevent, eliminate, or remedy the effects of abuse to an elderly person.
- Protective services agency is a public or non-profit private entity designated by the Department of Elder Affairs to provide protective services to elderly persons.
Reporting and Investigating Abuse
- Protective services agencies are authorized to receive and investigate reports of abuse.
- Protective services agencies can petition the court to appoint a conservator or guardian, or for an emergency order for protective services.
- Protective services agencies can provide protective services to an elderly person with their consent, or to a protected person with consent from their guardian or conservator.
- Protective services agencies can serve as conservators, guardians, or temporary guardians for a protected person.
- The Department of Elder Affairs or their designated agency will assess and evaluate a reported case of abuse. This includes a visit to the elderly person’s residence and consultations with relevant individuals and agencies.
- The elderly person subject to a report will be notified in writing of the assessment and has the right to review related files and reports.
- An assessment that determines an elderly person is suffering from abuse triggers a service plan development process. This includes evaluating their functional capacity, situation, and resources.
- The service plan will be developed to meet the needs of the elderly person and utilize the least restrictive alternatives.
- An emergency order for protective services can be issued by a court if they determine: a disabled person has been or is being abused, an emergency exists, and the disabled person cannot consent to service.

Practice of Psychology
- The practice of psychology is defined as the provision of professional services to individuals for a fee, which includes the observation, description, evaluation, interpretation, and modification of human behavior.
- Practice of psychology includes assessing or changing undesired behavior, interpersonal relationships, work and life adjustment, personal effectiveness and mental health.
- The practice of psychology includes, but is not limited to:
- Psychological testing, assessment, and evaluation of intelligence, personality, abilities, and aptitudes.
- Counseling, psychotherapy, hypnosis, biofeedback training, and behavior therapy.
- Diagnosis and treatment of mental and emotional disorder or disability, alcoholism, substance abuse, and psychological aspects of physical illness or disability.
- Psychoeducational evaluation, therapy, remediation, and consultation.
- The practice of psychology does not include the teaching of psychology, the conduct of psychological research, or the provision of psychological consultation to organizations unless such teaching research, or consultation involves the delivery of direct services.
Licensing of Psychologists
- An applicant for a psychologist license must provide evidence that they have been licensed or certified as a psychologist by a similar board in another jurisdiction with standards as high as those in the commonwealth.
- The board can issue a license without an examination if the applicant holds a diploma from a nationally recognized board or agency approved by the board.
- It is unlawful for a person to practice psychology without a license, use the title "psychologist," or engage in the practice of psychology.
- The penalties for practicing psychology without a license include fines of up to $500, imprisonment for up to three months, or both.
- The penalties for practicing psychology without a license do not apply to:
- Persons eligible for licensure who provide consultation services for a fee less than once a month.
- Students of psychology, psychological interns, or persons preparing for the practice of psychology under qualified supervision in a recognized training institution or facility.
- The board may grant a temporary license for up to one year to psychologists living outside of the commonwealth if they practice in consultation with, or under the supervision of, a licensed psychologist, or possess qualifications acceptable to the board.
