    Abuse Reporting for the Elderly

    • Individuals required to report abuse include physicians, physician assistants, medical interns, dentists, nurses, family counselors, probation officers, social workers, police officers, firefighters, emergency medical technicians, licensed psychologists, coroners, registered physical therapists, registered occupational therapists, osteopaths, podiatrists, directors of a council on aging, outreach workers employed by a council on aging, executive directors of licensed home health agencies or homemaker service agencies, and managers of assisted living residences.
    • Individuals with reasonable cause to believe an elderly person is suffering from or has died as a result of abuse are mandated to immediately make a verbal report to the department or its designated agency.
    • A written report must be submitted to the department or its designated agency within 48 hours of the verbal report.
    • The executive director of a home care corporation, licensed home health agency or homemaker service agency is required to establish procedures to ensure that staff who have reasonable cause to believe that an elderly person has been abused shall report such case to the executive director of the corporation or agency.
    • The executive director must also immediately make a verbal report to the department or its designated agency and submit a written report within 48 hours.
    • Individuals are protected from civil or criminal liability for reporting abuse, provided they did not perpetrate, inflict or cause the abuse.
    • Employers and supervisors are prohibited from taking disciplinary action against employees who file reports in accordance with the provisions of this section.

    • The department is required to develop a coordinated system of protective services for elderly persons who are determined to be abused.
    • Efforts should be made to avoid unnecessary, unwarranted, or counterproductive duplication between any internal investigation or inquiry by the department and the commission's investigation.
    • Reports alleging abuse of a disabled person whose caretaker is other than a state agency shall be referred by said department to the general counsel or to the department of mental health, in those cases where the disabled person is a person with an intellectual disability or otherwise mentally disabled, or to the Massachusetts rehabilitation commission, in those cases where the disabled person is physically disabled.
    • The general counsel, department of mental health, or department of public health shall immediately designate an investigator to investigate such abuse as provided in section five.
    • If a report of abuse of a disabled person may contain allegations of criminal conduct, the report shall be referred to the special investigative unit to conduct an initial evaluation and investigation.
    • The investigation shall report the results to the commissioners, and if a criminal offense is determined, the report shall be referred to the attorney general or a district attorney.
    • The attorney general or district attorney shall contact the commission to coordinate the investigation.

    Health Care Providers and Inspection of Records

    • Health care providers maintaining records for a patient are required to permit inspection of such records by the patient or an authorized representative.
