Appendix EU: EU, EEA, and Swiss Citizens and Family Members

  • Purpose: Provides the basis for granting indefinite or limited leave to enter or remain in the UK for EEA citizens, other EEA nationals, Swiss citizens, and their family members, as well as family members of qualifying British citizens.

Requirements for Indefinite Leave

  • General Requirements (EU2): Granting of indefinite leave based on:
    • A valid application (EU9).
    • Meeting eligibility requirements (EU11 or EU12).
    • No suitability refusal (EU15 or EU16).
  • Joining Family Member Requirements (EU2A): Similar to EU2 but eligibility requirements are referenced to EU11A.

Requirements for Limited Leave

  • General Requirements (EU3): Granting of five-year limited leave based on:
    • A valid application (EU9).
    • Not meeting indefinite leave eligibility (EU11 or EU12) but meeting limited leave eligibility (EU14).

Other Provisions

  • Limited Leave Conditions (EU4):

    • Annex 2 applies to application and eligibility review process for limited leave or indefinite leave under this Appendix.

Valid Application (EU9)

  • A valid application meets:
    • The correct application process.
    • Proof of identity and nationality (UK application).
    • Proof of right to apply (outside UK application).
    • Provided biometrics.
    • Submitted by required date (post-August 9, 2023).
    • Not a specified enforcement case (joining family members, post-August 9, 2023).

Application Validity Rejection (EU10)

  • Applications failing to meet the requirements of EU9 will be rejected.
  • Paragraph 34BB of the relevant immigration rules does not apply to applications under EU.
  • Subsequent valid applications will be considered as variations of the previous application and only the newest one is considered.
  • If two applications are valid, applicants are informed, must select which to continue with or withdraw within 14 days.

Indefinite Leave Eligibility (EU11)

  • Specific eligibility criteria, with various conditions based on status (EEA citizen, family member, derivative right, Zambrano right,) and factors like permanent residence, continuous qualifying period, cessation of activity, death, and age of child.
