The Bharatiya Nagarik Suraksha Sanhita, 2023
- The Act received the assent of the President on December 25, 2023.
- It is an Act to consolidate and amend the law relating to Criminal Procedure.
Preliminary
- The Act may be called the Bharatiya Nagarik Suraksha Sanhita, 2023.
- The provisions of the Act, except for Chapters IX, XI, and XII, do not apply to:
- The State of Nagaland.
- Tribal areas.
- However, the State Government may apply these provisions to the whole or part of the State of Nagaland or such tribal areas through notification.
Definitions
- "Tribal areas" refers to the territories that were included in the tribal areas of Assam, as referred to in paragraph 20 of the Sixth Schedule to the Constitution, excluding those within the local limits of the municipality of Shillong.
- "Audio-video electronic means" includes the use of communication devices for video conferencing, recording of processes, and transmission of electronic communication.
- "Bail" means the release of a person accused of or suspected of committing an offence from the custody of law upon certain conditions.
- "Bailable offence" means an offence that is shown as bailable in the First Schedule or made bailable by any other law for the time being in force.
- "Cognizable offence" means an offence for which a police officer may arrest without a warrant.
- "Complaint" means any allegation made to a Magistrate with a view to taking action under this Sanhita.
- "Electronic communication" means the transmission or transfer of written, verbal, or pictorial information through electronic devices.
