    Seed Inspector Procedures

    • When a Seed Inspector takes action under the Seeds Act, they must have at least two witnesses present and take their signatures on a prescribed memorandum.
    • The Code of Criminal Procedure 1898 applies to searches and seizures made under the Seeds Act similar to how it applies to searches under a warrant issued under section 98 of the same code.
    • When collecting a seed sample for analysis, a Seed Inspector must give notice in writing to the person from whom the sample is being taken.
    • In most cases, the inspector should take three representative samples, mark them, and seal them in a way appropriate to the type of seed.
    • The Seed Inspector must deliver one sample to the person from whom it was taken, send a second sample to the Seed Analyst, and keep the remaining sample for potential legal proceedings or analysis by the Central Seed Laboratory.
    • If the person refuses to accept one of the samples, the Seed Inspector must notify the Seed Analyst, who will divide the sample into two parts, seal one part, and deliver it to the Seed Inspector.

    Offences Committed by Companies
