Reporting Options for Sexual Assault
- Two reporting options exist: Restricted or Unrestricted.
- Restricted Reporting: Allows time to gather information about available services and rights, without immediate investigation or legal processes.
- Unrestricted Reporting: Provides broader rights and protections but entails an immediate investigation.
- Restricted Reporting Eligibility: Active duty military or Coast Guard, reservists, National Guard, military dependents (18+), service members who experienced assault prior to enlistment, and personnel meeting specified criteria for assistance OCONUS.
- Restricted Reporting Reporting Channels: SAPR Victim Advocate (SAPR VA), Sexual Assault Response Coordinator (SARC), healthcare personnel (including FFSC counselors), and Chaplains (who can preserve the restricted option). However, victims who talk to individuals outside those designated may forgo restricted reporting rights. Legal Assistance Attorneys are excluded but can preserve restricted reporting.
- Benefits of Restricted Reporting: Appropriate medical care, advocacy, counseling, options consideration, information gathering, choice of investigation timing.
- Limitations of Restricted Reporting: No Military Protective Orders (MPOs), no reassignment for safety, perpetrator continues contact, possible loss of evidence, limited discussion to specified individuals, potential lack of perpetrator punishment.
- Unrestricted Reporting Eligibility: Active duty military or Coast Guard, reservists performing federal duty, National Guard (Title 10 status), military dependents (18+), service members who experienced assault prior to enlistment. Specific civilian categories also eligible (e.g., stationed OCONUS DoD civilian employees, contractors).
- Unrestricted Reporting Reporting Channels: SAPR VA, SARC, military or civilian law enforcement, chain of command, healthcare personnel, and Legal Assistance. Crimes must be reported to command/NCIS.
- Benefits of Unrestricted Reporting: Widest range of rights and protections, safety measures like MPOs, attacker accountability, safety of community.
- Limitations of Unrestricted Reporting: No change to Restricted Report, investigation/legal process might be intrusive, Assault information will be known, delays in investigation and court (6-18 months), potential lack of perpetrator conviction, potential personnel movement.
