Study Notes
Sexual Assault Prevention and Response Program (SAPR)
- SAPR provides education, advocacy, response coordination, and case management for sexual assault victims in the military.
- It serves active-duty personnel, family members, and commands.
Reporting Options
- 911: Call 911 if in immediate danger.
- Restricted Reporting: Allows victims to gather information and explore options without immediate investigation or legal process.
- Eligibility: Active duty military/Coast Guard, Reservists, National Guard, dependents (18+). Note: Spouse/intimate partner assault handled through Family Advocacy Program and individuals prior to enlistment/commissioning.
- Reporting to: SAPR Victim Advocate (SAPR VA), Sexual Assault Response Coordinator (SARC), Healthcare personnel. Note: Chaplains and Legal Assistance Attorneys cannot receive restricted reports but can aid in preserving the option.
- Services: Advocacy, medical care, forensic exams, counseling, legal assistance, chaplain support.
- Benefits: Victim gets treatment, time to consider options, controls personal information, decides when to investigate.
- Limitations: No Military Protective Orders (MPOs) or reassignments, perpetrator remains with victim, evidence loss is possible, limited discussion with few people.
- Unrestricted Reporting: Leads to a full investigation, potentially involving legal processes.
- Eligibility: Active duty military/Coast Guard, Reservists (federal duty), National Guard (Title 10), dependents (18+), some civilian members (DoD employees/contractors OCONUS).
- Reporting to: SAPR VA, SARC, Military/civilian law enforcement, Chain of Command, NCIS/military. Note: reporting to command or NCIS /military law enforcement is required.
- Services: Advocacy, medical care, forensic exams, counseling, legal assistance, chaplain support.
- Benefits: Broadest rights and protection, safety/assignment assistance (MPOs etc.), accountability of perpetrator, improved community safety.
- Limitations: Cannot switch to restricted reporting, investigation/legal processes may be intrusive, widely known among trusted sources, potentially lengthy (6-18 months), no guarantee of conviction.
Important Considerations
- Restricted vs. Unrestricted Choices: Crucial to understand that unrestricted reporting cannot be changed to restricted reporting and vice versa.
- DoD Safe Helpline: 1-877-995-5247 (and text option) and website offers support and referrals to civilian resources if not eligible for SAPR support.
- Confidentiality: Understand the differing levels of confidentiality within restricted and unrestricted reporting.
