Railway Quarters and Rent Recovery

  • Railway staff quarters may be provided in situations where private enterprise cannot meet housing demand or for special reasons, staff have no automatic right to quarters.
  • Rent is charged for staff quarters, and recovery starts October 1, 1960 for group D staff.
  • Exceptions exist for non-gazetted staff previously granted rent-free quarters or house allowances.
  • Group D staff appointed before June 30, 1959 and those exempt from rent payment on the old E.B. and G.I.P. Railways, are exempt from rent.
  • Non-gazetted railway servants from ex-States Railways who enjoyed rent-free privileges prior to Federal Financial Integration keep this privilege, regardless of pay scale changes.
  • Hostel accommodations for apprentices, mechanics, and train examiners are free.

Classification of Quarters

  • Quarters are classified based on the standard of accommodation, matching employee classes.
  • Railway Board's letter 14/W2/21/46 dated October 17, 1975 and April 27, 1977 detail accommodation scales and maximum costs for various classes.
  • There's no expenditure on building houses or altering officer's houses without specific Railway Board approval (excepting repairs and maintenance up to ₹5000 in any one officer bungalow per financial year, with a total maximum of ₹1,50,000 per year for an entire Railway administration).

Standard Rent

  • Standard rent is fixed for each type of quarter across the railway network.
  • Quarters are categorized into sub-groups, with flat rent rates detailed in Railway Board letter F(X)I-87/11/6 dated September 25, 1987.
  • The existing assessed rent for sub-standard houses might be raised by 10%, and rounded up to the nearest rupee.

Emoluments in Rent Rules

  • Emoluments include pay allowances, pensions (including provident fund), fees, and compensatory allowances (excluding travel & uniform).
  • Compensation received under the Workmen's Compensation Act, 1923, and related Chapter XVII rules aren't considered emoluments.
  • Overtime, night duty, and children's education allowances are not included as emoluments.
  • Dearness pay is considered an emolument, though half of the dearness pay is used in the case of some employees as an exemption.

Recovery of Rent

  • Rent is limited to 10% of monthly emoluments.
  • Railway administrations can make exceptions for specific situations, like joint occupation of quarters for railway servants, or where occupants are transferred, or occupy quarters in a station other than where their post is located.
  • Additional fees for water, taxes, etc. might apply.

Remission and Waivers of Rent

  • General Managers can grant rent waivers in specific situations (e.g. repairs, temporary transfer, or illness).
  • These situations are limited to a maximum period of three months.
  • Non-gazetted staff who become gazetted are entitled to rent remission on specific circumstances (e.g. an increase in emoluments), up to 10% of the pay drawn.

Other Provisions

  • Quarters may be used jointly by officers and/or outsiders, with rent proportionately based on occupied area. Officials are responsible to pay rent for quarters they are assigned/occupy.
  • The incumbent of a temporary post is responsible for quarters' rent during their tenure. Officials taking temporary charge of a post in addition to a permanent post are only required to pay rent on the permanent or temporary post assignment, as decided by the general manager.
  • Tax and related fees might be leviable on tenants or the railway depending on local laws.
  • General Managers can grant leave or accommodation-related exemptions in specific situations.
  • Authorities can excuse rent when there was an error in whether or not it was due.
  • Railway servants may use quarters for their belongings during temporary absence, for example, up to four months with the concession of rent-free quarters dependent on the conditions for that employee and/or in the station or posting.
