- Effective November 1, 1997
- Definitions:
- Accident: An incident as described in Section 124 of the Act
- Act: The Railway Act, 1989 (Act 24 of 1989)
- Claims Tribunal: The Railway Claims Tribunal established under Section 3 of the Railway Claims Tribunal Act, 1987 (Act 54 of 1987)
- Schedule: The schedule to these rules
- Untoward Incident: Incident defined in Section 123 of the Act
- Claims for Compensation:
- Compensation amounts are detailed in the schedule
- For injuries not listed in the schedule but causing complete incapacitation, the compensation is set at 4,00,000 rupees.
- For multiple injuries in a single accident, compensation is payable for each injury, but the total compensation cannot exceed 80,000 rupees.
- Compensation for pain and suffering is determined by the Claims Tribunal based on medical evidence and other circumstances.
- If an injury leads to death later, the difference between the amount payable for death and the previously paid compensation is added.
- Compensation for loss, destruction, or deterioration of goods or animals is determined by the Claims Tribunal, based on reasonableness.
- Total compensation for any one person cannot exceed 4 lakh rupees.
