Use of Force Policy
- Officers must place suspects in an upright position as soon as it is safe to do so, and intervene if they observe pressure on the neck or failure to do so.
- All uses of force must be reported consistently with Division policies, including notification of an on-duty supervisor.
Reporting and Investigating Uses of Force
- During normal situations, involved personnel must report uses of force to their supervisor, who will note reported uses on the Activity Log or After-Action Report.
- In civil disturbance or mass arrest situations, alternative reporting procedures may be implemented, including reporting to a supervisor for the operational period and noting uses of force on the Body Worn Camera (BWC) if possible.
- The incident commander will communicate specific use of force reporting and investigation procedures as soon as practicable.
Conducting Investigations
- The contacted supervisor may conduct the investigation or assign it to an alternate supervisor.
- IAB may conduct an administrative investigation if requested, and information compelled from the focus employee will not be shared with units conducting a criminal investigation.
Deadly Force Policy
- Sworn personnel may use deadly force when they have reason to believe the response is objectively reasonable to protect themselves or others from imminent threat of death or serious physical harm.
- Deadly force may be used to prevent escape when there is probable cause to believe the subject poses an immediate threat of serious physical harm to others.
- Officers should avoid intentionally positioning themselves in a direct path of a moving vehicle and should take evasive action if vulnerable to being struck.
- Officers may fire a weapon at the driver or occupant of a moving vehicle only when there is an articulable, reasonable belief that the subject poses an immediate threat of death or serious physical harm to themselves or others.
Procedures Following Use of Force
- Involved personnel must complete a Display of Firearm/Taser Record or Use of Force Report, and forward the investigative packet to the appropriate unit.
- Investigations of uses of force resulting in death will be forwarded to the county prosecutor, who will determine if the case will be presented to a grand jury.
- Procedures for Level of Control 0 (Display of Firearm/Taser), Level 2, and Level 3 uses of force are outlined, including requirements for completing reports, notifying supervisors, and forwarding investigative packets.
