Officer's Probable Cause Statement
- Must include the name of a sergeant or higher approving the incarceration.
- For minor misdemeanors, officers should generally order-in instead of jailing unless there's resistance.
Interference with Police Authority
- It is unlawful to interfere or hinder police officers during their duties (DRMC 38-31).
- Actions must demonstrably affect an officer's duties for prosecution; mere insults or running from police generally do not suffice.
- Subjects must knowingly interfere; officers may safely advise them of this.
Arrest Paperwork Protocol
- All paperwork related to arrests, including statements and probable cause statements, must be promptly forwarded to the investigative section/unit.
- Original documents should be sent to the Records Unit for scanning.
