Importation of Dangerous Drugs

• Importing or bringing into the Philippines any dangerous drug, regardless of quantity and purity, including all species of opium poppy, carries a penalty of life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.

Controlled Precursors and Essential Chemicals

• Importing controlled precursors and essential chemicals carries a penalty of imprisonment from 12 years and 1 day to 20 years and a fine of ₱100,000 to ₱500,000.

Organizing and Financing Illegal Activities

• Organizing, managing, or acting as a financier of illegal activities carries a maximum penalty.
• Acting as a protector or coddler of any violator of the provisions under this section carries a penalty of 12 years and 1 day to 20 years of imprisonment and a fine of ₱100,000 to ₱500,000.

Selling and Trading of Dangerous Drugs

• Selling, trading, administering, dispensing, delivering, giving away, distributing, or transporting any dangerous drug, or acting as a broker in such transactions, carries a penalty of life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
• Selling, trading, administering, dispensing, delivering, giving away, distributing, or transporting any controlled precursor and essential chemical, or acting as a broker in such transactions, carries a penalty of 12 years and 1 day to 20 years of imprisonment and a fine of ₱100,000 to ₱500,000.
• Committing such acts within 100 meters from a school carries a maximum penalty.
• Using minors or mentally incapacitated individuals as runners, couriers, or messengers in connection with dangerous drugs and/or controlled precursors and essential chemicals trade carries a maximum penalty.
• If the victim of the offense is a minor or if the offense is the proximate cause of death of a victim, it carries a maximum penalty.

Possession of Dangerous Drugs

• Possessing any dangerous drug in the following quantities, regardless of the degree of purity, carries a penalty of:
  • 10 grams or more of opium: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 10 grams or more of morphine: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 10 grams or more of heroin: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 10 grams or more of cocaine: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 50 grams or more of shabu: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 10 grams or more of marijuana resin or marijuana resin oil: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 500 grams or more of marijuana: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 10 grams or more of other dangerous drugs, such as methylenedioxymethamphetamine (MDMA) or ecstasy: life imprisonment to death and a fine of ₱500,000 to ₱10,000,000.
  • 5 grams or more but less than 10 grams of opium, morphine, heroin, cocaine, marijuana resin, shabu, or other dangerous drugs: imprisonment of 20 years and 1 day to life imprisonment and a fine of ₱400,000 to ₱500,000.
  • Less than 5 grams of opium, morphine, heroin, cocaine, marijuana resin oil, methamphetamine hydrochloride, or other dangerous drugs: imprisonment of 12 years and 1 day to 20 years and a fine of ₱300,000 to ₱400,000.
