Executive Order No. S-45-20: Citizen Complaint Review Board
- Purpose: To establish a process for investigating citizen complaints against Omaha Police Department members, through independent review and recommendations for improvements.
- Board Composition: Six (6) individuals and one (1) alternate member appointed by the Mayor.
- Member Appointment Criteria:
- One member from each Omaha Police Precinct, plus one at-large member.
- All members must be registered voters residing in Omaha.
- Mayor strives for diverse backgrounds and representation of Omaha's social, ethnic, and economic groups.
- Background Checks: All appointees (excluding City personnel) must undergo background checks, including criminal history, to be considered for the board.
- Prohibited Appointments: No one with a felony arrest or conviction can be appointed as a member.
- Advisory Staff: The board includes advisory staff from:
- Omaha Police Command Staff
- Human Rights and Relations Department
- City Law Department
- Training Requirements:
- All members (excluding advisory staff) must complete at least 8 hours of orientation and training.
- Training includes overview of Omaha Police Department practices, policies, and procedures, including use of force and ride-alongs.
- Confidentiality: CCRB proceedings are confidential, per City Charter, Omaha Municipal Code, state and federal law, and collective bargaining agreements. All members must sign a confidentiality agreement.
Confidentiality and Information Sharing
- Public/Media Restrictions: CCRB proceedings are not open to the public or media.
- Information Sharing Restrictions: Members cannot share information from CCRB meetings with anyone outside the Board, advisory members, Mayor, or designated Mayor staff, without prior written approval from the Mayor.
- Violation Consequences: Failure to adhere to confidentiality agreements may lead to removal from the board and potential civil action.
- Contact with News Media: All interaction with news media concerning cases before the CCRB requires prior approval from the mayor's office.
Board Term and Procedures
- Appointment Terms: Initial appointees may initially serve for terms of one, two, or three years; subsequent appointments are for three years. Representatives from the Omaha Police and Law Departments serve at the Mayor's pleasure.
- Removal: Membership can be removed for cause, including consistent non-attendance, violating board provisions, or conduct that harms the city.
- Chairperson/Vice Chairperson/Secretary Election: Chosen through elections by CCRB membership for a one-year term.
- Rules of Procedure: Roberts Rules of Order govern proceedings unless inconsistent with the City Charter or internal procedures.
- Quorum: A quorum of 4 members is necessary.
- Meetings: Scheduled meetings as needed, for citizen appeals, and special meetings when required.
CCRB Operations and Jurisdiction
- Materials/Personnel: The CCRB can request materials/assistance from the Mayor's Office for Board operations. (Equipment, staff.)
- Jurisdiction: CCRB reviews citizen complaints (Request for Review) against sworn officers.
- Investigation Timeframe: The CCRB cannot review complaints until the Omaha PD completes its investigation.
- Chief of Police Access: The Chief of Police can provide CCRB access to Internal Affairs files, but not criminal investigative files.
- Review Process Start: Review process starts only after Omaha PD completes investigation, processes the complaint through outlined city policies and procedures and the Chief has made a decision.
- Appeal/Disciplinary Cases: CCRB cannot review cases where discipline is issued or where the chief of police has requested or an outside authority (FBI, Grand Jury) started an investigation.
CCRB Duties and Oversight
- Investigative Review: Reviews investigative processes, issues, and results regarding citizen complaints when the citizen submits a "Request for Review".
- Areas of Concern: Identifies any concerns of thoroughness, training issues, violations of standard operating procedure in investigations.
- Annual Aggregate Data Review: Analyses yearly criminal complaint data from the Omaha Police Department.
- Education Forums: The CCRB arranges two community education forums for general public awareness on review processes.
