Purpose and Updates
- Establishes procedures for recreational, ceremonial, and non-permit fires.
- Updates managed by Division Chief of Community Risk Reduction (CRRD) and PPM Committee.
Authority
- Fire Rescue Administrator holds authority
- Governed by Florida Administrative Codes (FAC 5I-2 and 62-256) and Florida Fire Prevention Code (69A-60).
- Local amendments to FFPC also apply.
Scope
- Applicable to all Palm Beach County Fire Rescue personnel and reservists.
Definitions
- Ceremonial Fires: Includes bonfires and religious fires.
- Recreational Fires: Encompasses campfires, cooking fires, or fires for warmth.
- Prohibited Fires: Backyard burning for yard debris disposal is not allowed.
Policy and Requirements
- Sets requirements for non-permitted ceremonial and recreational fires.
- Actions outlined for policy violations.
Permitting Process
- Recreational Fires: No permit needed but must meet specified requirements.
- Ceremonial Fires: Requires an approval letter from the Fire Marshal, including a site map.
- Compliance with approval and local fire station verification is mandatory.
Conditions of Approval
- Backyard Burning: Allowed with approved commercial devices or fire pits.
- Residential backyard burning is allowed for recreational purposes providing the fire is contained to a commercial "off-the-shelf" devices having UL or similar approval following manufactures recommendation or in a fire pit meeting the requirements set forth by the Fire Marshal
- Fire Size Limitations:
- Recreational fires: Maximum 36 inches in diameter.
- Ceremonial fires: Height dictated by site conditions, not exceeding 30 feet.
- Materials Restrictions: Only untreated wood may be burned; other materials like charcoal, trash, or treated wood are prohibited.
- Do not burn charcoal briquette, lump charcoal, manufactured logs, driftwood, trash, leaves, papers, cardboard, plywood, painted or stained or pressure treated wood; avoid using softwoods such as pine or cedar that can throw sparks
- Safety Measures:
- Fires must be attended at all times with extinguishment means readily available.
- Must be fully extinguished when not attended
- Must not create an undue fire hazard or excessive amounts of smoke
- Must be at least 50 feet away from structures, vegetation and paved public roadways.
- No combustible or flammable liquids within 50' of the fire
- Contact the nearest fire station to check burn bans before ignition.
Investigations and Smoke Complaints
- Fire units may investigate complaints regarding recreational and ceremonial fires.
- Open burning restrictions apply; permits are not issued for these fires, but letters are.
- Personnel should use good judgment when determining if a recreational fire creates an undue hazard
- Judgment required in compliance; fires creating undue hazards or not meeting criteria must be extinguished.
- After issuing Notice of Violation, the Fire Marshal’s office must be notified via email at Fire-Marshal @PBCGOV.org
- Repeat offenders may receive a Notice of Violation.
Burn Ban
- Recreational or ceremonial fires are not permitted when a countywide burn ban is issued by Fire Rescue or the Division of Forestry due to dry conditions and/or elevated fire danger
