Ministry of Labour Workplace Inspections
- Purpose: To guide Toronto Fire Services staff during Ministry of Labour (MOL) compliance inspections.
- Workplace Definition: Any land, premises, location, or thing where a worker works.
- Responsibility: All Toronto Fire Service staff are responsible for reviewing this guideline and participating in MOL inspections.
Guidelines for MOL Inspections
- General Inspections: MOL Inspectors conduct inspections to ensure regulatory compliance. Inspectors are authorized to enter workplaces for inspections, investigations of complaints, work refusals, and critical injury accidents.
- Inspector Requests: Inspectors may request documents (e.g., MSDS, training records) and ask for equipment demonstrations or answer questions.
- Employee Cooperation: Employees are required to comply and cooperate with Inspectors.
MOL Inspector Visits
- Introduction: The Duty Officer or most senior supervisory staff from the Support Division will be introduced to the Inspector(s).
- Duty Officer/Supervisory Responsibilities: Duty Officers/Supervisors will determine the purpose of the visit, contact Communications Officer for appropriate personnel (e.g. Co-Chairs), and accompany the Inspector. They will: provide facts, note details of conversations, make and keep copies of documents, ensure all items seized are clearly documented, and inform the Platoon/Division Chief about the visit.
- Inspection Report: MOL Inspectors will leave a report with officers. Duty Officers/Supervisors will acknowledge receipt, submit the report, post a copy, and send a copy to the JHSC.
Stop Work Orders
- Imminent Danger: If a situation poses imminent danger to workers, the situation can be verbally ordered to stop and confirmed in writing.
- Supplemetary Order: Work must be stopped safely until a supplementary order rescinds a Stop Work Order. Duty Officers/Supervisors are responsible for ensuring the work stops safely.
Prosecution or Search Warrant
- Contact Central Committee: If an Inspector indicates prosecution or enters with a search warrant, the Central Health and Safety Committee Co-Chair must be contacted immediately .
Ministry of Labor Refusal
- Worker Responsibilities: Upon refusing to work, workers must report the refusal to their supervisor immediately. The employer will investigate the worker's refusal, along with a representative of the worker(s). Other workers should be present.
- Committee Support: A representative from the Committee should represent the workers.
Additional Information
- Documentation: Copies of all relevant notes, reports, and documentation must be kept and provided to relevant authorities if requested.
- Co-Chair Attendance: It's often advisable for Co-Chairs to be present during visits if possible.
