Eligibility and Entitlement

  • A woman is eligible for maternity benefit if she has actually worked in an establishment for at least 80 days in the 12 months preceding the expected date of delivery.
  • The qualifying period for a woman to be entitled to maternity benefit is at least 80 days in the 12 months preceding the expected date of delivery.
  • A woman is entitled to maternity benefit for a maximum period of 12 weeks, of which up to 6 weeks can be taken before the expected date of delivery.

  • 'Delivery' refers to the birth of a child, including stillbirth or miscarriage.

  • 'Establishment' means any establishment or organization, including a factory, mine, or plantation.
