- Addresses social assistance benefits, services, programs, and projects.
Continued Provision Benefit
- Guarantees one minimum wage monthly to disabled and elderly people over 65 who cannot support themselves or be supported by family.
- Family includes the applicant, spouse, parents, stepparents, single siblings, single children/stepchildren, and dependent minors living under the same roof.
- A person with a long-term physical, mental, intellectual, or sensory impairment may be considered disabled.
- Granting benefits is subject to evaluation, as determined by regulations.
- Eligibility requires a per capita family income equal to or less than one-fourth of the minimum wage.
- Accumulation of benefits with other social security or regimes is prohibited, except for medical assistance and special indemnification pensions.
- Living in long-term care facilities doesn't disqualify from receiving the benefit.
- Benefit concession requires medical and social assessment by INSS (National Social Security Institute) experts and social workers.
- INSS can partner for social assessments under its supervision.
- Beneficiaries are directed to the nearest municipality with relevant services if their municipality lacks them.
- Applicants or their legal representatives must declare monthly family income.
- Temporary financial aid or compensation for damages from dam failures, as well as income from supervised internships and apprenticeships, are not computed in the per capita family income calculation.
- Long-term impairment has a minimum effect duration of 2 years.
- Other evidence of financial hardship can be used to grant the benefit.
- Regulations can increase the per capita family income limit for eligibility to up to half the minimum wage, subject to Article 20-B of the law.
- Benefit grants and reviews require registration in the Individual Taxpayer Registry (CPF) and the Single Registry for Social Programs of the Federal Government (Cadastro Único).
- Applicants or legal representatives need to provide biometric data or face legal obligation to provide it.
- Benefits up to one minimum wage granted to the elderly (over 65) or disabled aren't counted when determining benefit eligibility for another elderly or disabled family member.
- More than one member of the same family can receive continued provision benefits if they meet the requirements.
- The following aspects are considered for broadening the financial hardship assessment:
- The degree of disability
- Reliance on others for daily living activities
- Allocation of the family budget to medical expenses, special food, or non-SUS services, which are necessary for health and life preservation
- The degree of disability is assessed using a biopsychosocial evaluation instrument, complying with Law No. 13,146 and other articles.
- The value related to the commitment of the family budget with medical expenses will be defined jointly by the Ministry of Citizenship, the Special Secretariat of Social Security and Labor of the Ministry of Economy and the INSS, based on average values of expenses made by families exclusively for these purposes, with the possibility for the interested party to prove that the effective expenses exceed the average values.
- Continued provision benefits are reviewed every two years to assess the conditions that originated them.
- Benefit payments cease when the conditions are overcome or in case of death.
- Benefits are cancelled if irregularities are found in their concession or use.
- Development of cognitive, motor, or educational skills doesn't suspend or terminate benefits for the disabled.
- Termination of benefits does not prevent renewal if the requirements are met.
- Beneficiaries can be called for evaluation of their eligibility conditions.
- Continued provision benefits are suspended if the disabled person engages in paid activity, including as a micro-entrepreneur.
- Individuals whose labor relation or entrepreneurial activity ends can request the benefit's continuation if they didn't acquire any social security benefit rights.
- Hiring a disabled person as an apprentice doesn't suspend the benefit for up to two years.
- Beneficiaries who aren't registered in CadÚnico or have outdated registrations must update their status within these deadlines:
- 45 days for small municipalities
- 90 days for medium and large municipalities
- Benefits are blocked 30 days after notification if there's no acknowledgment of the notification.
- Failure to comply results in suspension if the notification is acknowledged.
- Beneficiaries can include or update in CadÚnico until the end of the suspension period without losing benefit payments.
