    • A follow-up investigation may be required and could include: • Interviewing victims who were initially physically or emotionally unable to be properly interviewed or provide a statement • Taking photographs of victim injuries that may not have been apparent/visible at the time of the initial response • Ascertaining if the perpetrator is on parole, probation and/or pretrial release and obtaining the name and phone number of the appropriate probation/parole/pretrial officer

    Serving Injunctions for Protection

    • Procedures for Serving Injunctions for Protection: • If picked up from petitioner after business hours, take to communications for copy to be made available, if call for assistance (violation) is received • Obtain as much information on the Information sheet as possible • Thoroughly review the injunction for specific provisions • Attempt for service of the Injunction upon respondent must be made as soon thereafter as possible on any day of the week and at any time of the day or night • Document attempts of service on the Information sheet • Complete a firearms affidavit, if initialed by judge

    Firearms Prohibition

    • As provided in section 790.233, Florida Statutes, a person may not have in his or her care, custody, possession or control any firearm or ammunition if the person has been issued a final injunction that is currently in force and effect, restraining that person from committing acts of domestic violence

    Law Enforcement or Correctional Officers Subject to Domestic Violence or Injunction

    • The following will apply to any sworn member of this agency or any other law enforcement agency: • Deputies responding to reports of domestic violence that involve sworn members of any law enforcement agency will follow the same guidelines that have been provided within this order for handling these types of incidents • The deputy will immediately notify his or her supervisor when investigating a domestic violence incident where a law enforcement officer is the suspect • Deputies who are respondents of an injunction for protection against domestic violence will notify their supervisor immediately that they have been served with an injunction

    Responsibilities

    • On-duty Supervisor: • If the suspect of a domestic violence complaint is a sworn member of a law enforcement agency, then the supervisor will respond to supervise the investigations • Immediately notify the member’s Division Commander or designee of the incident • Complete an unusual incident email to all staff providing a brief summary of the incident, actions taken, and offense number

    • Supervisor who is notified of an injunction having been served on a member: • Notify the Division Commander or designee, before the end of the shift • Take custody of all firearms and ammunition in the offender’s possession as required by federal statute • Privately owned weapons will be turned into the Evidence/Property Unit for safekeeping • Agency owned weapons will be turned over to the Professional Development Unit OIC or designee • Inform the member that he/she is not authorized to carry any firearms or ammunition while the injunction is in force

    Domestic Violence Response

    • The Escambia County Sheriff's Office aims to reduce domestic violence incidents and protect victims through a combination of law enforcement and community services.
    • Domestic violence investigations will be actively pursued, and arrests made when probable cause exists and the suspect is located.

    Deputy Response to Domestic Violence Calls

    • Deputies should maintain a high level of caution and prioritize their safety and the safety of others at the scene.
    • Backup deputies should not cancel their response until at least two deputies are on the scene and have made contact with the complainant or established control of the situation.
    • The first deputy on the scene should:
      • Position their patrol vehicle safely
      • Approach the residence or structure cautiously
      • Establish control of the scene
      • Identify and separate parties involved
      • Request additional resources as needed (e.g. medical response, backup units)

    Investigating Domestic Violence Incidents

    • Deputies should:
      • Document all incidents, even if no arrest is made
      • Take photographs of injuries and evidence
      • Collect physical evidence and witness statements
      • Identify the primary aggressor and document their actions
      • Determine if a crime was committed and make an arrest if probable cause exists
      • Explain the victim's rights and provide them with a Domestic Violence Pamphlet and Victim's Rights Brochure

    Reports and Documentation

    • Offense reports should include:
      • Detailed descriptions of the incident
      • Demeanor of parties involved
      • Statements from witnesses and victims
      • Evidence collected and photographs taken
      • Victim notification forms and Domestic Violence Questionnaires
    • Arrest reports should include probable cause information for the arrest

    Victim Assistance

    • Deputies should:
      • Convey concern for the victim's safety
      • Inform the victim about obtaining an injunction
      • Advise the victim about the processing of the case
      • Complete the Victim's Notification Form
      • Provide the victim with a Domestic Violence Pamphlet and Victim's Rights Brochure
      • Refer the victim to a domestic violence center or shelter if needed

    Custody of Children and Elderly/Disabled Adults

    • If a parent or legal guardian is arrested or hospitalized, the deputy should:
      • Contact the Abuse Registry to determine placement of children or elderly/disabled adults
      • Arrange transportation to a shelter or meeting place with a representative from the domestic violence center

    Emergency Temporary Injunction for Protection

    • The Emergency Temporary Injunction for Protection provides a means by which a victim can obtain protection from the court on weekends or holidays.
    • The injunction can provide for:
      • Restraining the respondent from assaulting or abusing the victim
      • Providing sole custody of minor children to the petitioner
      • Providing exclusive possession of the dwelling to the petitioner
      • Prohibiting the respondent from contacting the victim or going to certain places
    • The deputy should:
      • Take the victim's statement and complete the "Law Enforcement Procedures for Ex Parte Injunctions against Domestic Violence" form
      • Contact the on-call duty judge to obtain a verbal order
      • Serve the respondent with the order and provide a copy to the victim
