Overtime and Court Time Policy

  • The policy establishes guidelines for overtime compensation in compliance with the Fair Labor Standards Act (FLSA) and Missouri state law.
  • Failure to comply with the guidelines may result in discipline.

Terminology

  • Call Back: Occurs when a member is called back to duty while on a regularly scheduled day off, or after more than one hour has elapsed following completion of a tour of duty. Overtime will be authorized for a minimum of four hours or the amount of time the member reported for duty until relieved of duty, whichever is greater.
  • Coded Call Back: Occurs when a member works an event that requires a special overtime code.
  • Tour of Duty: A period of time that elapses between the beginning and the conclusion of the regular hours of assignment, when a member is regularly scheduled to be on duty or stationed at a prescribed place.

Policy

  • Eligible members will receive overtime for hours worked on a scheduled day off or for time worked in excess of the total number of hours of the member's regular tour of duty.
  • Overtime will be entered into the designated timekeeping system in the same order as they actually occurred.
  • A list of positions considered Exempt, Non-Exempt, and Exempt-Managerial is on file with the Human Resources Division and posted on the department intranet.

Procedure

  • Overtime will be paid for all work performed for the benefit of the Department.
  • The following conditions must be met for approval of overtime:
    • Job duties or functions essential to the conduct of department business and which cannot be anticipated in advance or scheduled into regular hours of assignment.
    • Unusual events, the occurrence of which is beyond the control of the department or the member and for which overtime is deemed necessary.
    • Special assignments or activities required by department policy or approved in advance by a supervisor/commander.

Overtime Compensation

  • Seven minutes or more in duration of work outside the regular scheduled tour of duty will be submitted and approved for overtime.
  • Exempt-Managerial and Exempt members are allowed to conduct department related business during off-duty hours.
  • Non-Exempt members will not conduct department related business during off-duty hours, without prior approval.
  • Compensable Overtime Rate:
    • Exempt and Non-Exempt members' overtime hours worked can be compensated at the discretion of their chain-of-command as either overtime pay or compensatory time (comp time).
    • Exempt Managerial members' approved overtime hours worked must be taken in comp time only.

Compensatory Time

  • Exempt and Non-Exempt members with less than one year of service may accumulate a maximum of sixty hours of comp time during that first year of service.
  • After the first year of service, the member will not be able to earn more comp time until their comp time balance is below forty hours.
  • Members with more than one year of service may accumulate a maximum of forty hours of comp time.
