Discipline Guidelines in the Hoffman Estates Fire Department
- The Fire Chief has the authority to discipline any member of the department based on grounds provided in this manual.
- The Fire Chief's disciplinary guidelines are based on their own knowledge, information from citizens, or recommendations from Command Officers.
Policy
- Any infraction that may result in suspension, demotion, or discharge is dealt with according to the Board of Fire and Police Commissioner's Act and the Hoffman Estates Municipal Code.
- All charges must be proved by a preponderance of the evidence.
Grounds for Discipline
- A member may be subject to discipline, including suspension, demotion, or discharge, on the following grounds:
- Any act or omission that violates a law of the United States, State of Illinois, or the Village of Hoffman Estates Municipal Code.
- Any act or omission that violates the Administrative, Safety, Operational, or Fire Prevention Guidelines of the Hoffman Estates Fire Department.
- Any act or omission that violates the Response, Incident Management, Fire Scene Operations, Specialized Operations, Safety Operations, Target Hazard Operations, or Equipment Guidelines of the Hoffman Estates Fire Department.
- Any act or omission that violates the Hoffman Estates Village Policy Manual.
Process of Disciplinary Action
- A supervising officer may prefer charges against a subordinate for any of the above offenses.
- Charges must be made in writing and forwarded to the Fire Chief.
- A subordinate member may make a complaint against a supervising officer for violating any of the department's rules or committing any of the above offenses.
- The complaint must be made under oath, with names of witnesses, and transmitted to the Fire Chief.
- If a citizen makes a complaint under oath, supported by evidence, against a department member, and the Fire Chief deems it well-founded, charges will be preferred against the member.
- Written charges must specify the paragraph or paragraphs of the section or rule violated, and a copy must be served on the defendant at least 24 hours before any disciplinary action is taken.
