HOFFMAN ESTATES FIRE DEPARTMENT STANDARD OPERATING GUIDELINES SOG Category & Identification Number: EFFECTIVE DATE: ADMINISTRATIVE – 008 January 1, 2022 NIMS COMPLIANT SOG Title: Discipline Guidelines Revision: 2 APPROVED BY: NUMBER OF PAGES: Re-evaluation Date: Alan Wax January 1, 2024 Fire Chief 2 PURPOSE The Fire Chief is hereby authorized to discipline any member in the manner provided in this manual on any grounds contained in or referred to in this section. The Fire Chief's disciplinary guidelines are based on his own knowledge; information furnished him by any citizen, or on recommendation of a Command Officer. DEFINITIONS POLICY BOARD OF FIRE AND POLICE COMMISSIONERS A. Any infraction for which a suspension, demotion, or discharge is sought, shall be dealt with as provided in the Board of Fire and Police Commissioner's Act (65 ILCS 5/10-2.1-1 et seq.) and/or modified by Article 4-5 of the Hoffman Estates Municipal Code and the Rules and Regulations of the Board of Fire and Police Commissioners of the Village of Hoffman Estates. 1. All charges shall be proved by a preponderance of the evidence. 2. Infractions, which in the opinion of the Fire Chief do not warrant suspension, demotion, or discharge, shall be dealt with by the Fire Chief at his discretion consistent with fairness to the member charged and the need for discipline to maintain the efficiency of the Fire Department. B. A member shall be subject to discipline, including suspension, demotion, or discharge on any of the following grounds: 1. Any act or omission which, if proved in court, would constitute a violation of a law of the United States, or State of Illinois, or the Village of Hoffman Estates Municipal Code. Conviction of such act or omission violating such a law or ordinance shall constitute a prima facie violation of this section. 2. Any act or omission, which violates the Administrative, Safety, Operational or Fire Prevention Guidelines of the Hoffman Estates Fire Department. 1 3. Any act or omission which violates the Response, Incident Management, Fire Scene Operations, Specialized Operations, Safety Operations, Target Hazard Operations or Equipment Guidelines of the Hoffman Estates Fire Department. 4. Any act or omission, which violates the Hoffman Estates Village Policy Manual. C. Any supervising officer may prefer charges against any subordinate for any one or more of the foregoing offenses. Such charges shall be made in writing and forwarded to the Fire Chief. D. Any subordinate member of the Fire Department may make complaint against any supervising officer for the violation of any of the rules of the Department or for the commission of any one or more of the offenses above enumerated. He/she shall make statement thereof, under oath, attaching names of witnesses, if any, and transmit the same to the Fire Chief. E. In cases where any citizen makes complaint under oath, and supported by evidence, against any member of the Department, and if the Fire Chief deems such complaint well-founded, he shall cause charges to be preferred against such member. F. Written charges shall specify the paragraph or paragraphs of section or rule violated. A copy of such charges shall be served upon the defendant no less than twenty-four (24) hours before any disciplinary action is taken. Return of such service shall be by receipt of the defendant upon a retained copy of such charges or by affidavit of the person serving the same. G. Any infraction listed or referred to herein, may be punishable by the appropriate authority with any of the following sanctions:  Verbal reprimand.  Written reprimand which is inserted in the member's personnel file.  Eight (8) hours to thirty (30) calendar days.  Demotion  Dismissal PROCEDURE EXCEPTIONS REFERENCES Rules of the Fire and Police Commissioners Chapter VIII Local 2061 CBA Article XXII DEFINITIONS End of Document 2
