All parties who employ or engage project workers will establish and maintain a safe work environment including ensuring machinery/equipment/processes are safe and not harmful to health. Specific guidance from both general and industry-specific environmental, health and safety guidelines will be followed. These standards will be included in legal agreements and ESS documents.

    Scope of Application

    • Determined in ESS1: The applicability of ESS2 will be outlined during the environmental and social assessment in ESS1.
    • Type of employment relationship: ESS2's scope is contingent on the relationship type between the borrower and the project workers.
    • Categorizing project workers:
    • Direct workers: Employed directly by the borrower (including the project proponent and implementing agencies) to work directly on the project.
    • Contracted workers: Employed through third parties (including contractors, subcontractors, brokers, agents or intermediaries) to perform core project functions. Written labor management procedures for contracted workers, as specified in Section E, are required. Specific contracts should include ESS2 requirements and non-compliance remedies. Third-party workers need a grievance mechanism; if one isn't provided by the third party the borrower should ensure that one is provided.
    • Primary supply workers: Employed by the borrower's primary suppliers (suppliers providing essential goods or materials) to support direct project activities. Written labor management procedures for primary supply workers, as specified in Section G, are required. If significant risk for child labor or forced labor, the primary supplier must be monitored and appropriate protocols followed. Suppliers who cannot demonstrate that they are meeting relevant ESS requirements may need to be shifted.
    • Community workers: Engaged in community labor (e.g., food-for-work programs, public works), for community-development, social safety nets, or support in fragile situations. Written labor management procedures for community workers, as specified in Section F, are required. Labor is ideally voluntary but must be confirmed. Workers should be afforded fair treatment and be compliant with relevant parts of ESS2. Assessments are needed to understand their working conditions, risks and appropriate conditions.
    • Various employment types included: Full-time, part-time, temporary, seasonal, migrant workers.
    • Government civil servants: ESS2 generally does not apply, except for protections relating to the work force and work safety if there is a legal transfer of employment from their existing public entity. Workers' rights and employment terms should be acknowledged and maintained in the new job arrangement.
