License Restrictions

  • The department may not issue a license to a person under 16 years old, except for a learner's driver license to a person at least 15 years old who meets the requirements of ss. 322.091 and 322.1615.

Age Requirements for Licensing

  • A person at least 16 years old but under 18 years old must meet the requirements of s. 322.091 and hold a valid learner's driver license for at least 12 months with no moving traffic convictions.
  • Alternatively, a person in this age group can hold a learner's driver license for at least 12 months and have a moving traffic conviction if they elect to attend a traffic driving school for which adjudication must be withheld pursuant to s. 318.14.
  • A person in this age group can also hold a license issued in another state or foreign jurisdiction that would not be subject to suspension or revocation under the laws of this state.

Behind-the-Wheel Experience

  • A person at least 16 years old but under 18 years old must have a parent, guardian, or other responsible adult certify that they have accompanied the applicant for a total of not less than 50 hours' behind-the-wheel experience, including at least 10 hours at night.

Disqualifications

  • The department may not issue a license to a person whose license has been suspended or revoked, until the expiration of the period of suspension or revocation.
  • The department may not issue a license to a person who has been disqualified from operating a commercial motor vehicle, until the expiration of the period of disqualification.

Medical and Emotional Fitness

  • The department may not issue a license to a person who is an habitual drunkard, habitual user of narcotic drugs, or habitual user of any other drug to a degree that renders them incapable of safely driving a motor vehicle.
  • The department may not issue a license to a person who has been adjudged to be afflicted with or suffering from a mental disability or disease and has not been restored to competency by the methods provided by law.

Other Restrictions

  • The department may not issue a license to a person who is required to take an examination but has not successfully passed such examination.
  • The department may not issue a license to a person when the department has good cause to believe that the operation of a motor vehicle on the highways by such person would be detrimental to public safety or welfare.
  • The department may not issue a commercial motor vehicle operator license to a person who has been convicted of, or has entered a plea of guilty or nolo contendere to, any felony involving human trafficking under state or federal law involving the use of a commercial motor vehicle.
