- The Huntley Fire Protection District and Huntley Firefighters Union, Local No. 4106 enter into a collective bargaining agreement effective from May 1, 2023, through April 30, 2027.
- The purpose is to promote harmonious relations, improve efficiency and productivity, and prevent interruptions of work.
Recognition
- The District recognizes the Union as the exclusive bargaining agent for full-time firefighters in the rank of Lieutenant and below.
- Battalion Chiefs, part-time, clerical, and civilian members, are excluded
- The Union agrees to fairly represent all members, regardless of union membership.
- The Union will indemnify and defend the District from any claims resulting from failure to fulfill its duty of fair representation.
Union Security & Rights
- The District will make payroll deductions for Union dues once per pay period for members who request it in writing.
- The Union can change the fixed amount of dues once per year, providing a 30-day notice to the District.
- Members can revoke dues checkoff authorization with written notice, 30 days in advance.
- Fair share fee deductions are deemed unconstitutional based on Janus v. AFSCME (2018).
- The District agrees to reinstate fair share fee deductions, should the law change
- The Union will indemnify and hold harmless the District against any claims due to the check-off provision.
- The Union will defend the District in legal actions related to compliance with the article, provided the District gives prompt notice, permits Union intervention and cooperates fully.
- The District can choose its own counsel at the Union’s expense if a conflict of interest is demonstrated.
Non-Discrimination
- Agreement provisions apply equally to all members without discrimination based on age, sex, marital status, race, religion, color, creed, national origin, sexual orientation, identification, or political affiliation.
- Grievances alleging a violation of this section can be processed to the Board of Trustees but cannot be pursued to arbitration.
Management Rights
- The District retains traditional management rights, including determining the mission and setting service standards.
- Additional rights include planning, controlling operations, supervising, assigning members, establishing qualifications, and setting work/productivity standards.
- Making rules and policies, evaluating members, disciplining, suspending, discharging members for just cause, and changing methods, equipment, uniforms or facilities are also management rights.
- Hiring, promoting, laying off, establishing training requirements, and setting probationary periods and job duties are additional rights.
- The District reserves the right to exercise management rights under Section 4 of the Illinois Public Labor Relations Act, following applicable Agreement provisions
- Exercising these rights should not conflict with the Agreement.
Seniority
- Seniority is defined as the member’s length of continuous full-time service since the last date of employment.
- If multiple members commence employment on the same day, the seniority ranking relies on ranking from the eligibility list used for appointment.
- Continuous service is broken when a member quits, is discharged for just cause, or retires.
- Termination can result from being absent for 3 working days without notifying the employer, failing to respond to a recall notice or not reporting after authorized leave.
- Suspensions of 30 days or less do not affect continuous service.
- Unpaid leave of 30 days or less, duty, occupational and/or ordinary disability benefits, do not affect continuous service.
- Military leaves do not break in continuous service, unless permitted by state and federal law
- New members undergo 12 month probationary period, which can be extended to get paramedic certification.
- During probation, termination won't be subject to grievance/arbitration procedures
- Members who are placed on an extended probationary period may only be disciplined or discharged for just cause, including failing to obtain paramedic certification.
- Probationary members get no seniority until completing the 12 month probationary period on a continuous, regular, full-time basis.
- Members completing probation acquire seniority retroactively to their full-time employment date.
- The District will prepare a seniority list and post it on the station bulletin board and will update as necessary.
- Members have 10 calendar days to report in writing any errors in the seniority list.
Grievance Procedures
- A grievance is defined as any difference, complaint, or dispute regarding the application, meaning, or interpretation of an express provision of the Agreement.
- Group grievances will be processed per The Union with the grievant or one grievant representing the group of grievants present at any step of the grievance procedure with the member.
- No individual member's grievance gets settled unless The Union can be present at any settlement conference, which must be consistent with the terms of the Agreement.
- The Union has the right to refuse to process/appeal unmeritorious grievances.
- Only The Union can refer a grievance to arbitration.
- File any grievance in writing with a Battalion Chief within 14 calendar days of the event, using a form provided by The Union.
- Include complaint, violated sections of agreement, violation date, relief sought, and signature
- The Battalion Chief must respond in writing within 7 calendar days of receiving.
- If unresolved, appeal to the Fire Chief/Designee within 7 calendar days of receiving Battalion Chief's response
- Within 14 calendar days, the Fire Chief must meet with The Union.
- Fire Chief/Designee has 7 calendar days to respond in writing after the meeting.
