Policy
- Leave of absence is granted as per Civil Service Regulations and the directive's rules
- New employees on probation cannot get leave unless it is Military Leave
Leave of Absence Without Pay
- Permanent employee's unpaid leave cannot exceed one year
- Requires approval from the Fire Commissioner and Personnel Director
Funeral Leave - Uniformed Members
- In case of death in immediate family (spouse, parents, children, siblings, in-laws, grandparents, grandchildren), funeral leave with pay may be granted until 0800 the day after the funeral.
- The department determines leave amount if there is a long period between death and burial
- Death of a relative or in-law in member's home follows the same leave procedure as immediate family deaths, but the Fire Department reserves the right to judge each case individually.
- Funeral leave with pay for one tour may be granted for the night of the viewing, the day of the funeral, or the night after the funeral, if attended
- For combined services, funeral leave can cover the last night tour before the service day, if the member attends, or the first or last night tour of duty if the service is held between night tours.
- Submit funeral leave requests through channels via the "Application for Leave of Absence (Form 76-63)
- Include requested time and reason, as well as proof of death
- The Commissioner or designee must approve all funeral leave requests
Military Leave
- Unpaid leave is available for active duty in the US military, reserves, national guard, or public health service corps
- Military Leave is typically for one term of service, unless further service is required due to a national emergency
- Military leave can extend up to 90 days post active duty or after treatment in a Veteran's Hospital following duty
- Within 90 days, employees must confirm ability to return in writing or in person.
- Failure to report by the Military Leave's expiration results in termination.
Military Encampment or Training Leave
- Paid leave of up to 15 days (120 hours) per calendar year is available for active training in the US military reserves, national guard, or public health service reserve corps.
- Unpaid military leave is given for duty/training beyond 15 days.
Jury Duty
- Paid leave is granted for court-appointed jury service, unless excused
- Members summoned to jury duty must immediately notify their Commanding Officer and send the notice to the Personnel Office
- A timely jury duty notice results in the member being excused from jury duty.
- Members are not to send jury selection questionnaires to the Personnel Office, but complete and return them to the Jury Selection Commission.
- If not excused from jury duty and must miss a work tour, complete a Leave of Absence form and forward it with a copy of the Jury Duty Notice to the Personnel Officer
- Leave begins at 0800 on the first excused day, ending at 0800 the next day, or adjusted if jury duty is between night tours
- For jury duty lasting more than one day, the member must immediately inform their company officer or unit commander
- Remit Jury Service payments to the Fiscal Officer, Fire Administration Building, if excused with pay
- If jury duty extends from one calendar week into the next, members are excused from duty on Saturday and Sunday, given they report for jury duty the following Monday
- This schedule adjustment does not apply to members released from jury duty on Friday or serving for one calendar week or less.
- For jury duty over one calendar week, the Leave of Absence request is completed and forwarded post-service, starting at 0800 on the first day of jury duty and ending at 0800 on the following calendar day.
- All jury duty payments received from excused work tours must be remitted to the Fiscal Officer, Fire Administration Building.
- Any unusual circumstances or questions about this policy should be directed to the Personnel Officer.
Education and Training
- Paid leave for education and training can be in part or whole, and payment for tuition and/or course fees
Other Leave of Absences
- Unpaid leave of absence may be available for personal or private legal matters, or if appearing under subpoena
- The Fire Commissioner, with Personnel Director approval, can authorize paid or unpaid leave for full-time employees for specific training related to their position, with possible certificate requirements
- Full-time elected officers of recognized labor organizations/unions in Philadelphia can get unpaid leave for their service upon written request
Serious Illness - Medical Leave
- Personnel Director grants leave of absence in cases of serious illness after examining the facts
Responsibility
- Battalion Chiefs and Deputy Chiefs review, initial if approved, and forward Leave of Absence requests.
- Commanding Officers comply with the directive, prepare and forward leave requests (refer to forms directive), and record information in their journal upon approval
- Uniformed Members should make requests promptly, provide support documentation, and comply with directive provisions
- Members must give their company officer a copy of military orders ASAP before the effective date
- Orders must be official, on letterhead, signed, and with dates member is ordered to attend
- "Plan of the Month" and orders listing select dates are not acceptable
- Members must also sign the "Application for Leave of Absence" form.
- Members with military service orders must report to the Personnel Officer at the Fire Administration Building for leave papers, and bring their orders
- Failure to apply for Military Leave can lead to AWOL status and dismissal per Civil Service Regulations.
- Upon being granted Military Leave, members must turn in department property to their company officer.
- Personnel Officers ensure requests comply with Department/City rules before forwarding.
- The Commissioner or designee approves/disapproves and signs the Leave of Absence request.
